How to arrange redevelopment of an apartment through State Services

Procedure

Redevelopment of an apartment through the MFC is agreed upon in the following order:

  1. The citizen submits an application and a package of documents.
  2. The center specialist accepts the submitted documentation and issues a receipt to the applicant.
  3. The set of documents is sent by MFC employees to the appropriate authority.
  4. The authorized authority makes a decision on the citizen’s appeal and issues permission to renovate the residential premises (notification of refusal).
  5. The completed document is sent to the Multifunctional Center, whose employee informs the applicant about the decision made on the same day.
  6. The citizen pays a visit to the institution at the appointed time and receives permission to carry out work (reasoned refusal).

Procedure for contacting the MFC

Obtaining permission for redevelopment through the MFC occurs in the following order:

  1. The owner or responsible tenant collects documents for the apartment and orders a project from an architectural bureau.
  2. The finished project with other documents and an application is submitted to the MFC department.
  3. MFC employees check the submitted documents and issue the applicant a coupon with a list of accepted papers, the employee’s signature and the date the service was provided.
  4. The application is forwarded by MFC employees to the town planning committee of the local administration.
  5. Employees of the town planning committee check the documents and make a decision.
  6. MFC employees inform the applicant about the committee’s decision using the contact information provided in the application.
  7. The applicant collects from the MFC a copy of the administration’s resolution approving the redevelopment.

When visiting the MFC, you must obtain an electronic queue number by selecting the required department at the terminal - in most regions this is the department of architecture or construction.

It is important to note that in all MFCs the following persons are served without a queue:

  • WWII participants and home front workers;
  • disabled people of 1st and 2nd groups;
  • Heroes of Russia and the USSR;
  • combatants.

When registering an application, an MFC specialist checks the completeness of the necessary documents and the correctness of the text of the application, informing the applicant about any inaccuracies identified. The accepted package of documents with the application is sent to the town planning committee within 2 working days.

After receiving the documents, specialists from the town planning committee check the project submitted by the applicant for compliance with sanitary standards and safety requirements. In particular, the following types of work during redevelopment are prohibited:

  • destruction or transfer of load-bearing structures;
  • placing a bathroom above the living room of the neighbors below;
  • combining a balcony or loggia with a living room;
  • moving gas stoves to living rooms or corridors;
  • increasing the area of ​​rooms due to the kitchen or bathroom.

Consideration of the application lasts up to 45 working days. If the decision is positive, the applicant enters into a contract with contractors to carry out the work and presents them with the project and permission for redevelopment received from the MFC.

It should be remembered that after carrying out the redevelopment work, it is necessary to order a new technical passport for the apartment from the BTI.

What is redevelopment

Redevelopment is a set of works to change the configuration of a residential premises, upon completion of which it is necessary to correct the information specified in the technical passport of this property.

Part of the redevelopment activities also includes work on dismantling, changing, moving and other re-equipment of utility networks, which are called redevelopment of a residential property.

The procedure for approving and carrying out redevelopment (reconstruction) of an apartment is approved by Art. 25-29 of the Housing Code of the Russian Federation. In accordance with this regulatory act, any of the above actions must be coordinated with the district administration.

It is advisable to obtain permission from the authorities before carrying out construction work. But if the work has actually already been carried out, then such unauthorized refurbishment of the premises also requires approval, and the changes will have to be legalized in court.

Types of redevelopment

There are two main types of redevelopment: coordinated and uncoordinated (unauthorized). Most often, problems arise with the second type.

Agreed

This type of redevelopment is prepared by the owner in advance. He orders design documentation, goes through all the necessary authorities with it, obtains permits, and only after that begins directly to work. The option is long, and without guarantees that they will allow everything to be done as planned.

Unauthorized

In this case, the apartment owner first carries out the redevelopment as he sees it, often without any project or pre-prepared plan. Only then, when everything is ready, does he approve the redevelopment with the relevant authorities. The advantages of the method are that the work begins immediately, and the processing of documents begins only later.

The disadvantage here is much more serious. Often, during unauthorized redevelopment, apartment owners make changes that, based on current legislation, are simply impossible to agree upon. As a result, those in charge will oblige the owners to return everything as it was or to carry out another redevelopment so that at least the basic elements are brought into compliance with legal requirements. Otherwise, punishment will follow.

Acceptable and prohibited “alterations”

Any redevelopment work that does not violate the approved SanPiN 2.1.2.2645-10 and SP 54.13330.2016, and also complies with the Decree of the State Construction Committee of the Russian Federation dated September 27, 2003 No. 170 and other current regulations, is considered acceptable.

Some types of repair work do not require a permit at all.

For example, you can safely do:

  • cosmetic renovation of the apartment;
  • installation of mezzanines;
  • replacement of windows and doors;
  • installation of built-in furniture;
  • replacement of engineering equipment if it is installed in the same place;
  • installation of air conditioners on building facades;
  • construction of sliding partitions, shop windows;
  • moving a gas stove indoors without laying additional networks.

The most common types of premises refurbishment subject to approval include the following construction work:

  1. connection of the loggia with the adjacent room;
  2. demolition of internal walls (only if they are not load-bearing) both between living rooms and in the bathroom;
  3. allocation of utility rooms or connection of existing storage rooms to the living space;
  4. changing the shape or moving doorways and windows;
  5. transfer of communications;
  6. construction of walls and partitions from concrete and other materials, creating additional load on supporting structures;
  7. replacing a gas stove with an electric one;
  8. installation of doorways and windows in load-bearing walls with mandatory strengthening of supporting structures with transverse beams;
  9. relocation and expansion of the bathroom within the non-residential part of the area.

It is strictly not allowed:

  • combining a bathroom with a living room;
  • demolition of load-bearing walls;
  • installation of a bathroom or kitchen above the living quarters;
  • installation of heated floors connected to the water supply system;
  • removal of batteries to the loggia (balcony);
  • covering ventilation shafts;
  • dismantling fire escapes;
  • demolition of the partition between the living room and the kitchen with a gas stove;
  • combining premises located on different floors without additional strengthening of structures.

If there is no clear understanding of the question of whether the planned alteration relates to the types of premises refurbishment subject to approval, and whether such work can be carried out at all, it is worth seeking advice from the competent authorities (district administration, housing inspection, etc.).

How to legitimize government services through the portal?

  1. Authorization in your personal account on the portal (you must enter your username and password).

  6. After the application is completed, you must attach the necessary documents in scanned format.

Documents for redevelopment of an apartment in the MFC

If the property belongs to the applicant by right of ownership, the following set of documents will be required:

1) Application in the prescribed form (the form will be issued by a center employee).

It contains the following information:

  • the name of the territorial authority where the application will be submitted;
  • Full name, passport details, place of residence, telephone number, details of the power of attorney (if an authorized person acts instead of a citizen) from each of the owners (tenants, tenants) of the premises;
  • location of the property;
  • the reason for the application, indicating the details of the rental agreement or the document establishing ownership of the premises;
  • duration and mode of construction work;
  • in cases where the premises are used under a social tenancy agreement, the following must be filled in: full name, passport details and signatures of adult family members of the tenant who agree with the redevelopment.

Note: residents’ signatures are placed in the presence of the MFC official who accepts the documents. Otherwise, a notarized consent of family members must be submitted, the presence of which is recorded in the appropriate column of the application.

3) Title documents for the property subject to redevelopment, if the right is not registered in the Unified State Register of Real Estate.

4) Residential redevelopment project.

    Methods for submitting documents and obtaining results

    When obtaining permission for redevelopment, the main part of the costs arises at the stage of collecting documents (development of the project by a third party, ordering certificates from various authorities, etc.).

    The term for the provision of services for approval of redevelopment is expressly specified in clause 4 of Art. 26 Housing Code of the Russian Federation. According to this rule, the procedure may take up to 45 days (from the date of submission of the application with attached documents).

    What documents are issued at the end of the procedure?

    Based on the results of consideration of the application for approval of redevelopment, the applicant may be sent one of the following decisions taken by the authorized body:

    1. On approval of the project for changing the configuration of the premises presented by the owner - the form of this document is approved by Decree of the Government of the Russian Federation No. 266.

    Terms of service provision

    The territorial authority is obliged to make a decision on the applicant’s appeal within 45 days from the date of receipt of the application and a set of accompanying documentation.

    A completed permit (refusal) is issued at the Multifunctional Center within a period not exceeding 3 working days from the date of such decision.

    You can track the status of the application through the MFC website using the receipt number issued by the official upon receipt of papers at the institution, or by calling the hotline.

    In some regions, MFCs inform the applicant about the readiness of documents via SMS.

    Other options

    In addition, there will be other options to ensure that the completed redevelopment is legal. With widespread access to the Internet, many citizens use this opportunity to solve one problem or another.
    In this case, you can also use the World Wide Web by visiting the State Services website. This portal provides citizens with the opportunity to receive certain government services without leaving their homes. To submit all correspondence to the selected authority, and after receiving permission to make changes, you will need:

    1. Register on the government services resource by creating your own account (if you don’t have one).
    2. Provide accurate information about the location of the property and the existing ownership rights to it.
    3. Decide which redevelopment option will be used (you can choose from the available options or offer your own).
    4. Wait for the decision to be made by the authority.

    If the answer is positive, you can begin to carry out repair and construction work. Upon completion, you need to contact the housing inspectorate and obtain the appropriate act, so that later the redevelopment will not be recognized as illegal.

    Thus, in order for the redevelopment done in the home to have a legal basis, the entire procedure must be official. To do this, it will be enough to go to the multifunctional center, where, after submitting documents, employees will do all the work for the applicant, who will no longer have to contact other authorities. In addition, submission of documents is also possible through the State Services portal.

    Further actions after receiving permission

    After receiving permission to carry out the reconstruction, you can begin repair work.

    Please note that a redevelopment permit is usually valid for a year from the date of its signing.

    The owner of the premises must inform the acceptance committee of the district administration (housing inspection) about the completion of construction work one year after the permit is issued, or earlier if the alteration was completed ahead of schedule.

    If the work is not completed on time, the permit can be extended for one month, and the number of extensions is unlimited.

    The commission, called at the request of the owner of the premises, checks the result of the changes made and, if no violations are identified, signs an act of completed redevelopment.

    This document must be presented to the BTI to call an engineer who will measure the apartment and record updated data. Then the owner will be issued a new technical passport of the residential premises.

    Redevelopment of an apartment through government services

    If the owner decides to carry out redevelopment in his residential or non-residential premises, then he will have to go through the approval procedure.

    • The standard approval procedure includes the following list of actions:
    • obtaining BTI documents from the inventory bureau;
    • preparation of documents for approval (real estate ownership documents, applicant’s passport or power of attorney, various permits from certain structures, application for redevelopment, etc.);
    • contacting the design bureau for the development of design documentation;
    • submission of the project, technical documents and the rest of the set of documents to the MFC, so that they can then be transferred to the housing inspectorate;
    • obtaining permission to carry out redevelopment.

    Permission for redevelopment:

    Having gone through all the listed procedures, it will be possible to carry out repair work and, as a result, pass it in order to receive new technical documents and a certificate of completed redevelopment and reconstruction.

    However, not all owners can afford to undergo such a procedure.     How to arrange redevelopment of an apartment through government services?

    In order to use government services for redevelopment approval, you must do the following:

    • register a personal account on the government services portal;
    • enter correct and correct contact and personal information;
    • select a redevelopment approval service from the list;
    • fill out an application electronically and attach scans of all documents required for approval;
    • enter the address (the series of the house will be determined automatically);
    • choose a ready-made, suitable standard redevelopment project or attach a scan of your version, which you order in advance from the design organization;
    • send all the data and wait for a decision.

    Next, the procedure proceeds in the same way as with a standard approval: if you receive a refusal, you correct the shortcomings and resubmit the application, or receive permission and begin repair work. The permit is issued approximately 20 days after submitting the documents.

    The commission arrives before redevelopment if it is planned to affect the load-bearing structures. A technical opinion will also be required here.

    The second visit of the commission takes place after the completion of the renovation, when it is necessary to “hand over” the premises. If no violations or deviations from the redevelopment project are found, the owner will be given an act of completed redevelopment and updated BTI documents.

    Making changes to the Unified State Register of Real Estate

    To complete the legal redevelopment procedure, it is necessary to make changes to the characteristics of the property reflected in the Unified State Register of Real Estate.

    4) Current extract from the Unified State Register of Real Estate on the main characteristics and registered rights to the property.

    • submit a request, a Russian passport and a receipt confirming payment of the state duty.

    Documents for redevelopment

    The procedure for obtaining permission for redevelopment is called approval - as part of this event, an engineering project is drawn up, which is assessed by BTI employees for compliance with building codes.

    For approval, the owner of the premises must prepare the following documents (clause 2-2.1 of Article 26 of the Housing Code of the Russian Federation):

    Owners of premises can obtain an extract from the Unified State Register of Real Estate at any branch of the MFC by applying with a passport.

    To create a redevelopment project, you need to contact an architectural bureau that has a license to create engineering and construction projects that meet safety requirements in residential buildings. Creating a project takes from 3 to 15 days and can cost from 5 to 30 thousand rubles, depending on the scale of the planned work, the location of the living space and the region of circulation.

    The text of the application for approval must indicate:

    • Full name and passport details of the applicant;
    • address, cadastral number and area of ​​the apartment;
    • the purpose of the work;
    • type of right to use living space;
    • date and signature of the applicant;
    • list of attached documents.

    When redevelopment approval is required

    • simplified
