  • Constitution. Article 7 indicates the need for state social support for mothers.

  • Federal Law No. 165 of 1999 describes the main principles of social insurance.
  • Federal Law 81 of 1995 defines the general system for the payment of benefits.
  • Federal Law-418 of 2021 talks about monthly transfers to families with children.
  • It is also necessary to find out annually the content of the Government Resolution regarding the percentage by which the benefit will be indexed. So, in 2021 this is Resolution number 32, approving a coefficient of 1.043.
  • Federal Law No. 82 of 2000 establishes the minimum wage. From the beginning of 2021, this amount is equal to 12,130 rubles. for the working population without taking into account the region.
  • Federal Law 255 of 2006 describes the rules for maternity and temporary disability insurance.
  • Order 677n of 2021 establishes the procedure for issuing benefits to the Social Insurance Fund for the birth of a child when a person is not employed or such benefits cannot be obtained from the employer.
  • Art. 217 of the Tax Code determines what is not subject to taxes (including benefits).
  • At the municipal level, laws and other regulations may also be adopted that are aimed at providing financial support to non-working mothers. Somewhere the possibility of receiving money for the first child is separately discussed, somewhere we are talking exclusively about large families, etc.

Where to start collecting documents at the birth of a baby:

  1. Firstly, when a mother and newborn are discharged from the maternity hospital, she is given a certificate, on the basis of which the main document can then be issued - a birth certificate.
  2. The certificate is filled out according to form 103\u. There is no need to delay obtaining the main document; the certificate is limited in time and is valid for only 1 month.
  3. When registering a birth certificate, the mother receives a certificate, which will then allow her to apply for lump sum payments.
  4. The document is issued in Form 24. This is usually provided to the employer. If the mother does not work, then the paper should be taken to social security.

Unemployed and working mothers on maternity leave: is there a difference in accrual?

When a mother does not work, the employer does not make payments to the Social Insurance Fund, and therefore these mothers cannot count on the support that working women receive. However, the state has provided for such situations and provides certain social benefits to the most vulnerable categories of the population. This also includes unemployed mothers who are planning to give birth to a second baby. Therefore, appropriate support is provided, but its amount is less than that of a working mother.

The employment status is as follows:

  • workers - women, officially employed, the employer regularly makes appropriate contributions;
  • unemployed – women working without employment or unemployed, but not registered accordingly;
  • unemployed – women who have unemployed status and are registered at the Employment Center.

Thus, unemployed and unemployed mothers belong to different categories. But the payments are the same, albeit with some minor differences.

Allowance for caring for a disabled child for a non-working parent

Regardless of whether the father or mother raising a child with a disability is employed, he is entitled to certain monthly benefits :

  • cash payments from 1,478.09 rubles (if you refuse social services - 2,527.06 rubles);
  • able-bodied non-working caregivers are provided with 5,500 rubles - for guardians and parents, 1,200 rubles - for other persons;
  • pension benefit for a disabled child - 11,903.51 rubles;

Depending on the group that was assigned to the disabled person since childhood, the amount of assistance will vary:

  • Group 2 - up to 12,446.79 rubles;
  • Group 3 - up to 6,238.84 rubles.

The social pension for children with disabilities is set at 11,903.51 rubles.

The set of social services for this preferential category includes:

  • provision of medicines, food;
  • provision of sanatorium-resort treatment;
  • the possibility of free travel on railway and intercity transport when traveling for treatment.

One-time support for unemployed mothers.

Either parent can take advantage of the right to receive this benefit. Its issuance has its own nuances:

  • if twins, triplets, etc. were born, then it is necessary to make a payment for each baby,
  • if the child was stillborn, no payment is made,
  • if the baby was born alive but died soon after, the money must be transferred.

One-time assistance depends on the regional coefficient. Because in the capital and St. Petersburg it is not, then mothers in these cities will receive 17,479.73 rubles.

To receive a payment, you must contact social security. Don't delay it - you can get the money within the next six months after the baby is born.

If the applicant misses this deadline, he will have to go to court and prove that there were good reasons for this.

In addition, when the mother does not work, this benefit can be received at the father’s place of work or from the Social Insurance Fund.

To do this, you need to submit the following documents:

  • statement,
  • a certificate from the second parent’s work confirming that they have not received this measure of support,
  • certificate from the registry office,
  • extract from the work book,
  • divorce certificate (if available).

Payment must be made by the 26th day of the month following the month of submission of documents.

  1. One-time payment at the birth of a child.
  2. Federal child care benefits for one parent.
  3. Putin's payments if you meet the conditions.
  4. Regional payments. Most likely, you will need to confirm the status of a low-income family.

Unfortunately, you will not be able to receive payments for maternity leave. Since you are not officially working, there is no vacation.

Now about each point in detail.

One-time payment at the birth of a child

How much - 17,479.73 RUR. In 2021, the benefit amount will be higher; every year from February 1 it is increased slightly. This money is paid one time.

To whom - one of the child's parents. Whether you are married or not does not matter. The main thing is that the child’s birth certificate indicates who will receive the benefit.

Where to apply - at the social security department at the place of residence of one of the parents. They are called differently in different cities.

Please note: you need a birth certificate, not a certificate. These are different documents. Both documents are issued by the registry office. The work record book must be certified at the last place of work. But employers usually do not provide labor assurance to former employees. In this case, you can bring the original work report and copies of the completed pages to the social security agency.

If there is no employment contract at all, you must write in the application for benefits that under the employment contract you have never worked and are not working now. This is also possible. Benefits must be paid.

The order does not say anything about what needs to be done if you have lost your work permit or the employer has not given it to you. There is no point in writing in your application that you have never worked, because a request for information from the Pension Fund of the Russian Federation will show that this is not the case.

I advise you to write that you are currently not working under an employment contract, you were fired from your last job on such and such a date, you are not operating as an individual entrepreneur, a lawyer, a notary engaged in private practice, and you are not one of the other persons whose activities are subject to registration or licensing.

If you have previously issued a work permit, try to restore it. You need to contact your last employer. Neither the Pension Fund of Russia nor the MFC will help with this. If the employer has left the work record in the archives, you need to pick it up. If he refuses to give it back, you can demand the issuance of a work book through the court.

In practice, you will most likely have to explain the situation to a social security employee. Social security benefits are paid to those who are not working right now, so the fact of previous work activity is not so important. Bring copies of your work record book, if you still have them. If you have a copy of the dismissal order, that may also be useful.

In any case, consult with the social security employee who will accept your documents. And keep your work record if you have one once.

How long to wait - 10 days before the benefit is assigned and about a month before it is paid. The money must arrive no later than the 26th day of the month following the month you submitted your application.

If you register for unemployment, you will have to choose between this benefit and unemployment benefits.

Unemployment benefits may be more profitable, but not for long: the maximum 8,000 rubles can be received only for 6 months and only if you officially work for a year before applying for benefits. Otherwise, they will pay 1,500 rubles and only 3 months a year. In this case, you will need to go to the employment center and for interviews.

If you want to make payments on yourself, you should definitely choose a care allowance, since your last official job was in 2021. The unemployment benefit in your case will be minimal.

Where to apply - at the social security agency at the place of registration.

What you will need is an application and a package of documents. There are more of them than with a one-time benefit, so I will give it in a list:

  1. Passport.
  2. Child's birth certificate with a copy.
  3. Birth certificates of other children in the family.
  4. Work record book with copies or certified.
  5. A certificate stating that the second parent does not receive this benefit.
  6. Certificate from the employment center regarding non-payment of unemployment benefits. Employment centers are usually created by district; you need to contact the one to which your home is registered.
  7. Information about the registration of the child and the person receiving the benefit must match. For adults, information about registration is in the passport, and for children, the Ministry of Internal Affairs is given a sheet with information about registration at the place of residence. But they may require a certificate from the passport office.

Putin's payments

How much - in the amount of the subsistence minimum for children in the region for the second quarter of last year. This is from 8,247 R in the Belgorod region to 22,222 R in the Chukotka Autonomous Okrug. In 2020, these amounts will increase; current amounts can be viewed on the pension fund website.

To whom - one of the parents. The family income must be below two subsistence levels in the region; the subsistence level for able-bodied citizens is taken. This rule has been in effect since 2021; now it is required to receive no more than 1.5 times the subsistence minimum. A family consists of parents and children; there is no need to count the salaries and pensions of grandparents.

Family income is added up and divided among everyone. If there is no official income, there is nothing to add.

How I received Putin's child benefits

Let's look at an example. In 2021, your income will be compared with the cost of living for the second quarter of 2021. In the Krasnodar Territory in the second quarter, the cost of living is as follows:

  • per capita - 11,107 RUR;
  • for the working population - 12,030 RUR;
  • for children - 10,639 RUR.

We take the value that is determined for the working population, that is, 12,030 RUR. We multiply by two, since you will receive payments for a child in 2021, we get 24,060 RUR. The average per capita family income for the last year should not be more than this quantities. If we imagine that parents have a stable salary that they receive from month to month, then the upper limit of total income for the month will be 72,180 R - 72,180 / 3 = 24,060.

It turns out that if your total monthly income with your husband is less than 72,180 RUR, in 2021 in Krasnodar you will be able to qualify for Putin’s payments.

You will receive 10,639 RUR.

You can spend this money on monthly payments for up to three years, an apartment, building a house, or educating a child. The application must be submitted to the MFC or Pension Fund.

Regional payments

Regions are introducing their own payments for children. Each subject of the Russian Federation has its own rules, so it is better to look at regional laws. If you are not interested in the laws, ask the social security department. They know for sure.

Regional payments require registration at the place of residence. It is also often necessary to prove an income below the subsistence level for a valid reason or to have more than two children.

Let's see what is in the Krasnodar region.

Child benefit - 206 RUR. This amount is paid every month to one of the parents until the child turns 16 years old. The average per capita family income must be below the subsistence level.

What to do with unofficial income

Unofficial income is a double-edged sword. On the one hand, a small income according to documents and tax returns is a basis for applying for Putin’s payments for a child and even receiving low-income status.

On the other hand, unofficial income is also income, even though you have not declared it. If the social security authorities determine that you have incorrectly indicated your earnings, the benefits will be canceled and everything paid will be forced to be returned. Before assigning benefits, requests will be sent to the tax office and the Pension Fund. If there is information that you earned something, but did not report it, the payment will be refused.

Under civil contracts, responsible customers pay taxes on income for all work performed by you. Even if it’s a small translation or an article worth 500 rubles. It will be a shame to be rejected because of such a trifle. Therefore, I do not advise deceiving the state, and before applying for benefits, I recommend sending requests to the Pension Fund and the tax office yourself. Benefits for a single mother in Russia

A sad example. A family with four children received regional child benefits. My husband worked unofficially. To confirm his income, his wife took an income certificate form from the social security agency. The individual entrepreneur for whom the husband worked part-time filled out this certificate. After some time, the paid benefits were asked to be returned. Neither the tax office nor the pension fund had information about deductions for the income indicated in this certificate. Social Security recognized it as unreliable, and this is grounds for refusal. In fact, officially the husband did not receive anything at all, but the court decided that the refusal to pay benefits was lawful.

A joyful example. The woman gave birth to a child and went to process Putin’s payments. She brought certificates of paid state benefits, as well as a 2-NDFL certificate for the last year. The social protection department refused her because she did not have a certificate from her place of work. The woman went to court, and he explained to social security that she did not work, her employer had been liquidated, so she could not give a certificate. There is no special form of income certificate. The submitted documents confirm the woman’s income. We need to give her an allowance.

I must warn you: receiving Putin’s payments and at the same time having unofficial income is a criminal offense. The legislator recognizes the provision of false or unreliable information when receiving social benefits as fraud. It does not matter what amount was hidden from the state. Formally, it is enough to submit incorrect information about your income once and receive money from the state. This is already a crime. There are different types of punishment: from a fine to arrest for 4 months.

If you receive more than 250 thousand rubles based on false information, the fraud will be considered major. For this they can be imprisoned for up to 6 years.

Where to complain if something goes wrong

If the social security department refuses to pay you, write a complaint addressed to the head of this body with approximately the following content:

  1. When did you submit your application, what benefits were asked to be assigned, what documents were attached.
  2. What did the employee answer to you, what reasons did he give for the refusal?
  3. Why don't you agree?

Ask to understand and give a written, reasoned answer. With this answer you can already go to court if the problem is not solved.

Let me summarize:

  1. Parents who do not officially work are strictly entitled to two payments - a one-time benefit for the birth of a child - 17,479.73 R and a monthly allowance for caring for the first child up to one and a half years old - 3,277.45 R each month.
  2. If in 2021 you confirm an income below two subsistence levels for each family member, you will be able to issue Putin payments. Each month they will pay an additional amount of about 10,000 rubles. Each subject of the Russian Federation has its own amount.

Categories of the unemployed

According to the laws of the Russian Federation, the unemployed are divided into:

  • dismissed during the liquidation of individual entrepreneurs;
  • students;
  • unemployed people registered with the employment center.

Maximum social guarantees at the birth of a child, of course, are provided to an employed parent. He is the insured person in case of temporary loss of ability to work, and in connection with the onset of maternity.

The Social Insurance Fund (SIF) pays maternity money to this category of citizens based on the average monthly income calculated for the 2 years preceding the birth of the baby. But in relation to non-working women, the legislation establishes minimum benefits from social insurance authorities.

Unemployed single mothers are not entitled to any special benefits; they are included in the same categories: laid-off workers, students or members of the Labor Center and receive payments on a general basis.

Allowance for the wife and children of a military man.

The standard benefit amount in 2021 is 11,863.27 rubles, but it is subject to change. It depends on the regional coefficient.

Because This indicator is not provided for Moscow and St. Petersburg, then residents of these cities receive basic assistance.

Every year the benefit is indexed depending on inflationary growth.

When and where to apply for benefits

Child care benefits for an unemployed mother are assigned and issued by a social security institution (Sobes).
An unemployed applicant must contact the territorial Social Security at his place of registration with a package of documents for state support. It is possible to contact the MFC (subsequently, the applicant’s data is sent to Social Security), as practice shows, it is in the MFC that it is easier and more efficient to start the process (less queue, longer daily work hours, sometimes closer to the applicant’s place of residence, etc.).

If we are talking about an individual entrepreneur who is voluntarily insured by social insurance (pays contributions for himself), then such an entrepreneur requests benefits from the service department of the Social Insurance Fund.

You can submit an application with attachments from the day the child is born (in advance, that is, this cannot be done before birth).

The deadline for applying is no later than when the child turns 2 years old. If the application is made outside this period, the monthly allowance will be refused. Only in court can such a period be restored (but serious reasons will be needed to recognize the absence as valid; this is a very rare judicial practice).

Maternal capital.

Issued even to non-working mothers. To obtain it, the main condition is the presence of a second or next child born from 2007 to 2021.

The amount of this state support is 466,616 rubles.

Capital is issued once. So, if a mother received MK for her second baby, then she will no longer be able to obtain such assistance for her third. The fact is that MK is issued not for the child, but for the family as a whole. You cannot receive funds directly from capital.

There are areas where you can spend government support funds without waiting for your child to turn three years old.

The validity period of the certificate granting rights to the MK is limited:

  • death,
  • deprivation of the applicant's parental rights.

In addition to the mother, the father or other relative who is raising the child (as a rule, these are unemployed grandparents, aunts, uncles, etc.) have the right to receive child care benefits.

In a standard situation, the calculation is made according to the formula: “FR (fixed size)” X “RK (regional coefficient)” .

Where, the fixed amount (also, in other words, the minimum amount of accruals) from June 1, 2021 does not depend on the number of children the recipient of child benefits has and is equal to 6,752 rubles .

Previously, until the end of May 2021, the minimum amount for the first child was two times less than for the second and subsequent ones.

Mothers who received state support before 06/01/20 in a smaller amount will automatically be transferred to a new size, which applies to children born since June of this year.

Moreover, the specified amount will be indexed in the future. This has been a tradition for many years now. In January-February of each year, the Government of the Russian Federation annually increases the value of financial assistance.

Regional coefficients are established in the Information Letter of the Department of Income and Living Standards of the Ministry of Labor and Social Development of the Russian Federation No. 670-9 dated May 19, 20103. Not all regions apply coefficients (based on difficult climatic conditions).

Example No. 1 . Ivanova S.E. is unemployed and lives in the Kemerovo region. This means that when calculating assistance, you need to multiply the minimum indicator by the coefficient. 1.3. Thus, child benefit for Ivanova S.E. will be equal to 8777.60 rubles. If care payments are made simultaneously for two or more children, then all accruals are summed up.

Example No. 2 . Student Grigorieva A.E., a resident of Saratov, gave birth to a daughter in January 2021, and in March 2020, twin boys. Since January 2021, she has been charged a monthly payment of 3,277.45 rubles. in February 2021 it was indexed and its size was 3,375.77 rubles, and in June 2021 the size changed to 6,752 rubles, so Grigorieva A.E. is already due for the first, second and third baby in a total amount of 20,256 rubles. These calculations are equally applicable to other non-working relatives who care for minors in the absence of the mother (died, deprived of rights, declared dead by the court, seriously ill and physically unable to take care of the baby, etc.).

Those fired during maternity leave

The calculation formula is as follows: “SMZ (average monthly earnings)” X 0.4 X “RK (regional coefficient)”

In this calculation, the SMZ is taken for 12 months. The last month included in this one-year period is the one preceding the month in which the maternity leave was granted (not the month of actual dismissal). Let’s say my mother went on vacation on May 20, 2020, and quit on July 13, 2021, then the SMZ is calculated within the range from 05/01/2019 to 05/01/2020.

In any case, dismissal must be during the vacation period and on the basis of: liquidation of an organization, termination of the functioning of an individual entrepreneur, notary, law office, etc.

If, when paying wages, the employer calculated the regional coefficient, then it does not appear in the calculation formula, since it is already actually taken into account.

There are limits for this type of state support (regardless of the calculation results):

  • cannot be lower than 6,752 rubles. (for any number of children);
  • should not exceed 13,504 rubles. (the number of children does not affect the indicator).

Often the amount of state support assigned in connection with going on maternity leave changes upon subsequent dismissal.

Example No. 3 . Spiridonova A.A., a resident of the Samara region, had an average income for 2021, 2021 of 37,000 rubles. On March 14, 2020, she went on vacation. She was given a monthly amount of 14,800 rubles. Due to the liquidation of the employer, she was fired on June 30, 2020. From July 1, 2020, the amount of state support will be 13,504 rubles, since the previous value (14,800 rubles) was higher than the maximum allowable amount of child care benefits for a non-working mother.

Mothers fired during pregnancy

Two calculation methods are used, which depend on whether the mother was on maternity leave or not.

When the stage of pregnancy is early (that is, the vacation is still premature), then the amount of maintenance is determined as in the situation for the unemployed, students, individual entrepreneurs, etc., that is, 6752 rubles .

When a pregnant woman officially went on maternity leave, no matter before or after giving birth, the calculation formula looks the same as for those fired during maternity leave:

Formula: “SZ” X “RK” X 0.4 Values: SZ - average monthly earnings for 1 year, taken up to the month (inclusive) after which the dismissal took place. RK - regional coefficient.

In these situations, it is important that the basis for dismissal should be the fact of liquidation of the employer, so to speak, forced dismissal. And when determining the size, there are also upper and lower limits (12,569.33 and 3142.33/6284.65, respectively).

Example No. 4 . Anfiskina A.F. on maternity leave from December 20, 2019. And after 2 months (she had not given birth yet) she was fired due to the termination of the individual entrepreneur (employer) of its activities, that is, on February 20, 2020. For the period from January 2019 to January 2021 the average monthly salary was 22,000 rubles. Since Anfiskina A.F. lives in Perm, then the regional coefficient is 1.15. Anfiskina A.F. gave birth to a daughter on 03/05/2020. Therefore, she is due to receive 10,120 rubles. (22 thousand X 0.4 X 1.15).

Who is considered a single mother?

According to the laws of the Russian Federation, not every woman who is not in a relationship and is raising a child outside of marriage can be considered a single mother! According to official documents, only a woman who:

  • gave birth and is raising a child, not the name of the married status;
  • When registering with the registry office, she registered the child under her last name and did not submit an application to establish paternity.

Important: a distinctive feature of a single mother is the fact that her child officially does not have a father. She should not be confused with a single woman whose ex-husband or partner simply does not live with the child!

It is important that in the baby’s certificate there is a dash in the “father” column, and the baby’s middle name is written down exclusively from the words of the mother. Immediately at the registry office, a woman raising a child without a father is issued a special certificate that officially confirms this status (certificate No. 25).

Alas, if paternity has been officially recognized and indicated in documents, a woman will not be able to count on any benefits as a single mother, even if she has not lived with her second biological parent for a long time and does not receive support from him.

But a woman who has a dash in the paternity column on her child’s birth certificate does not lose her status as a single mother even after she gets into a new relationship and gets married.

The right to receive child benefits also remains with her. The only exception is a situation in which the new spouse decides to officially adopt the child.

In this case, benefits for the child cease to be accrued, because now the baby has a father.

Russian legislation strictly defines the norms according to which a woman has the right to the status of a single mother. In total, three categories of such mothers can be distinguished:

  1. Women who gave birth and are raising a child without being married. In this case, the paternity of the child should not be established (i.e., there cannot be a joint statement from the parents, drawn up in the registry office, or a court decision establishing paternity);
  2. Women who gave birth to a child during marriage or within 300 days after its dissolution, if the fact of paternity was then disputed and the court issued the appropriate paper.   3. Women who have decided to adopt a child without being married.
