What to do if an employee does not pass the medical examination?

Sometimes such a nuisance happens that the applicant has not passed the medical examination. He will be given a conclusion about certain medical contraindications, which can be either temporary or without specifying a time.

If health problems are temporary - no more than 4 months, then the employee may be offered another vacancy for a certain period, and then transferred to the desired position. If the contraindications are more serious, then the employer does not have the right to hire such an employee (Article 76 of the Labor Code of the Russian Federation). He can only give him an alternative vacancy if one exists.

The procedure for conducting mandatory preliminary and periodic medical examinations (examinations) of employees was approved by Order of the Ministry of Health and Social Development dated April 12, 2011 No. 302n.

According to this order, the preparation of a document on suitability for work in a specific position involves the following steps:

  1. Receiving a referral from a potential employer to undergo a preliminary medical examination (clause 7), which must contain all the details and information (clause 8).
  2. Contacting a medical organization with which the company has concluded a corresponding agreement (its address is indicated in the referral), with the documents listed in clause 9 (the main ones are a passport and a referral).
  3. Passage of all medical specialists, the list of which is established in relation to specific harmful and dangerous factors and conditions.
  4. Presentation of the received certificate to the employer for registration of employment.

This form of medical certificate is two-sided and has 12 points. Filled out by the physician of the medical institution indicating the personal data of the employee with a list of previously suffered diseases and information about vaccinations.

This form of certificate contains a conclusion indicating that the citizen of the Russian Federation does not have diseases that prevent him from performing civil or municipal service in the Russian Federation.

This certificate is also used to verify that the person undergoing the examination has a disease that makes it impossible to undergo these types of services. The certificate is signed by the doctor who issued it. The signature of the head physician and the seal of the medical institution are also affixed.

The certificate (form No. 001-ГС/у) is valid for twelve months from the date of issue.

Rights and responsibilities of the parties

The procedure for undergoing a medical examination involves the responsibility of both the employer and the employee.

An employee, when required by law, must agree to a medical examination upon entering work. This is both his right and duty. Of course, before starting a new job, he can refuse to undergo a medical examination, basing his refusal on the fact that he is not an employee of the enterprise and is not obliged to follow the instructions of his potential employer before signing an employment contract. However, then the company administration has every legal right not to hire him (Article 69 of the Labor Code of the Russian Federation).

If an employer violates the law and hires a new employee without a medical examination, then in accordance with Part 3 of Art. 5.27.1 of the Code of Administrative Offenses of the Russian Federation, he will suffer certain administrative punishment. The specified article of the Labor Code of the Russian Federation provides for the imposition of a monetary fine:

  • in the amount of 15 to 25 thousand rubles per official;
  • in the amount of 15 to 25 thousand rubles per individual entrepreneur;
  • ranging from 110 to 130 thousand rubles. to a legal entity.

When hiring without a medical examination is repeated, then in accordance with Part 5 of Art. 5.27.1 of the Code of Administrative Offenses of the Russian Federation, the perpetrators will be punished:

  • a fine of 30 to 40 thousand rubles. or disqualification for a period of one to three years for officials;
  • a fine of 30 to 40 thousand rubles. for individual entrepreneurs or administrative suspension of activities for up to three months;
  • from 100 to 200 thousand rubles. or suspension of the enterprise’s activities for a period of up to three months.

Initial medical examination for work and renewal of certificate
