We are talking about guardianship and trusteeship authorities - the constant companion of those who decide to take an orphan into their home. This satellite begins to loom on the horizon long before the baby crosses the threshold of your home. It is the guardianship and trusteeship authorities that you go to first as soon as you make a final decision, for example, about adoption. Guardianship is your first step towards a child.

List of documents that will be required from you in guardianship

So. You must bring the following list of required documents to the guardianship authorities: – a short autobiography; – a certificate from the place of employment indicating the position and salary or a copy of the income statement; – a copy of the financial personal account; – an extract from the house register or a document confirming ownership of the apartment; – certificate of no criminal record for an intentional crime against the life or health of citizens; – a medical report from a state or municipal health care institution on your state of health and a copy of your marriage certificate (if you are married).

When the documents are collected, you attach them to the application, in which you ask for an opinion on the possibility of becoming adoptive parents, and take everything to the guardianship authorities. To prepare a conclusion on the possibility of becoming adoptive parents, the guardianship and trusteeship authority draws up an act based on the results of an examination of your living conditions.

Based on the application and the documents attached to it, as well as the inspection report, the guardianship and trusteeship authority, within 15 working days from the date of filing the application, prepares a conclusion on their ability to be adoptive parents, which is the basis for registration as candidates for adoptive parents (do not forget : the conclusion is valid for a year from the date of issue).

After registration, the guardianship and trusteeship authority considers the application and submitted documents within 10 days from the date of receipt. If the citizen agrees to adopt the child proposed to him, the relevant operator issues him a referral to visit this child.

The referral is issued to visit one child and is valid for 10 days from the date of its issue. The validity period of the referral may be extended by the relevant operator if there are grounds that prevent the citizen from visiting the child within the prescribed period (illness, business trip, etc.).

Appealing the actions of the PLO

Sometimes there is a need to appeal the activities of the guardianship and trusteeship authorities, but not everyone knows where to go and what exactly to do.

  1. First of all, you need to contact the Moscow Department of Social Security and leave a complaint.
  2. Complain to the district administration.
  3. File a claim in court about unlawful acts on the part of the PLO. But you definitely need to have physical evidence.
  4. Complain to the Department of Guardianship and Trusteeship.
  5. Complain to the Ombudsman for Children's Rights.

The place of appeal depends on the situation in which the plaintiff finds himself.

It is important to know

If you were unable to find a child for adoption at your place of residence, you have the right to apply for information about the child subject to adoption to another guardianship and trusteeship body or to an executive body of any subject of the Russian Federation, or to the Ministry of Education and Science (federal operator state data bank on children left without parental care), of their choice. There will probably be questions about the reasons for adoption or guardianship; here, in my opinion, it is not necessary to delve into medical problems - only at your request. Tatyana Plotnikova
: I heard that it happens like this - they come without warning (so be prepared for this), walk around the entire apartment, looking into closets, the refrigerator... But usually, before visiting, the employees of our PLO call and agree on a convenient time. They arrive at the appointed hour and only enter the child’s room.

Identification of potential mentees

In order not to leave people who require special assistance without support, the state creates special bodies. They are, as a rule, formed in the structures of regional authorities. The guardianship department collects information about orphans, dysfunctional families, and so on. That is, his responsibilities include control and monitoring of the situation in the territory under his jurisdiction. In practice, the guardianship department receives data on children from village councils. It is quite difficult to see from the regional center what is happening in each family. Therefore, connections are being established with employees of local governments, schools, and concerned citizens. When a child gets into trouble, these people take care of his affairs. They collect documents and submit them to the guardianship authority. In addition, those who know the situation often help select a guardian. This is a responsible and rather delicate matter. Guardians almost always become relatives of the child. The decision is quite reasonable. The baby is used to his aunt or grandmother and does not experience additional stress. But in families, conflicts sometimes arise over the identity of the guardian, related to selfish interests. Therefore, choosing the person responsible for the child is a serious and responsible matter.

– What benefits can a child taken into care count on (rest, public transport, education, etc.)?

: A benefit of 15 thousand rubles - up to 12 years, 20 thousand - after. But you need to submit annual reports on the use of this money, showing that “we do not live on her/his money.” You need to collect receipts for large purchases. In addition, there is free additional education in city and municipal organizations, priority enrollment in any kindergarten and school, free two meals a day at school, free public transport (including a free toilet at the station), placement of a child and his almost priority admission to a specialized hospital. Theoretically, once every 2 years there is a free vacation with a guardian at the expense of the state, but in reality, you have to “catch” trips on the state website. There are also free camps, to which, as the guardianship workers themselves say, they send disadvantaged people and orphans. As for the cultural program, this is a free skating rink in MEGA, benefits in state museums and a gift for the New Year and sometimes a ticket to the Christmas tree (1 ticket) - in my memory it happened 1 time.

– Are the benefits automatic (that is, as soon as you become a guardian, your child receives them) or is it necessary to prove each time that your child has the right, say, to free travel on the subway, etc.?

: In Moscow there are no problems with this, everything is automatic, you just need to notify the person you came to that in front of him is a child left without parental care, that is, show documents. But on the periphery, every step is fought.

Regions and people

As for those very peripheries, the overall picture is different in different regions, many guardians note, and again depends on specific people on the ground. Roughly speaking, in one city, guardianship authorities can differ radically from each other in their attitude towards people and the services they provide. Central cities like Moscow and St. Petersburg are no exception. So, from Tatyana Dyumina in the same capital guardianship, two different employees demanded different documents:

– According to one employee, my husband and I, living in my parents’ apartment and at that time raising two children, did not have the required number of square meters to accept a state child into the family. She also wanted us to have my husband and I enter into a free rental agreement with our parents, since it was not written down there. This girl also told me that we should have enough income so as not to live on Yulina’s money, but we spent more on her tutors. Although our living wage was close to our own children, even before the birth of the youngest, whose imminent appearance I hid until recently. In general, while we were collecting numerous medical papers and going through a school of foster parents that was absolutely unnecessary for us, parents of many children, this guardianship employee went on maternity leave, and another one came in her place, who just asked to bring a receipt from all the relatives registered in the apartment, that they allow Yulia to live in this apartment.

Advantages and disadvantages

I asked my interlocutors to say what is the usefulness of such an institution as guardianship authorities for them personally. Tatyana Dyumina and Tatyana Plotnikova

: “With the help of this institute, we received guardianship and benefits.
The advantages are that all matters related to the adopted child are conducted in one place - centrally. Cons: bureaucracy. This is the issuance of certificates, permits and their copies with a blue seal. When registering a child, you need to collect a huge number of medical certificates with different validity periods. After registration, any sneeze also requires a certificate. Yulia Bashinova
: I don’t see any pros, the minus is an extra step on the adoptive parent’s path. The declarative functions of the guardianship authorities are to protect the rights of children and incapacitated citizens. In reality this is not always the case. This structure does not help me, I generally try to communicate with it as little as possible. Only when necessary.

When to contact the guardianship authorities

Quite often, the reason for a government agency to develop an interest in a particular family is an appeal from neighbors who are confident that the parents treat their child badly, infringe on his rights, and improperly organize his life.

Unfortunately, some of these reports turn out to be true, but there are also erroneous statements. Therefore, citizens are advised to keep a few tips in mind.

If a neighbor does not see that there is a direct threat to the life of a minor (in these cases the police should be called immediately), or the person doubts that there are grounds for depriving a parent of his rights, it is worth trying to solve this problem on his own.

Raising your voice can become part of the educational process, so you shouldn’t immediately ruin other people’s lives, because if the guardianship authority comes to an official call, the specialist will re-check the child’s position in the family for a long time, look at his living conditions (if his parents divorce or in other difficult situations).

If, after identifying the circumstances of the incident, the neighbor is still not sure about the safety of the minor, he has doubts that the mother and father of the child are properly fulfilling their parental responsibilities, he has the right to write a statement to the guardianship and trusteeship authority.

Where to complain

Of course, no parent is immune from conflicts with guardianship authorities. These conflicts are different in each case, but they always cause harm to both parties, and most importantly, to the child. Without being able to overcome the misunderstandings of officials and eliminate the problems that have arisen yourself, you can always send complaints to the official authorities against the guardianship employees whose work you are dissatisfied with.

First of all, you can complain directly to the Moscow Department of Social Security. The department's hotline is open 24 hours a day. You can also send a complaint by fax, or write an appeal outlining all the facts through the online reception.

There are other ways. As the same mother Tatyana Dyumina, who, by the way, is a lawyer, says, you can easily complain about employees of the guardianship and trusteeship authorities to the district administration at your place of residence, to the prosecutor’s office, and, finally, to the court. “But in each specific case you need to operate with specific articles and laws that, in your opinion, were violated,” Tatyana notes. “In this regard, you also need to be prepared and it would be good to have a lawyer who understands these issues.”

In a word, decide for yourself how best to interact with the guardianship and trusteeship authorities. Each guardian and adoptive parent has his own experience and opinion on this matter: some are happy, some are not very happy, others are completely unhappy.
