Information from legislation

Article Part 2.1 of Article 169 of the Housing Code of the Russian Federation speaks about the right of regional authorities to provide compensation and about the categories of the population who are entitled to it. Among them are pensioners over 70 and 80 years old, disabled people and families with disabled children.

Special conditions must also be met: the benefit is only available to non-working pensioners, and it is calculated based on regional standards.

For example, in the Black Earth Region the social standard for the housing area of ​​a single owner is 33 square meters, for a couple - 21 square meters each. There will be no refund for “extra” meters.

Article Part 2.1 of Article 169 of the Housing Code of the Russian Federation determines the exact list of categories of beneficiaries and the conditions under which the payment is provided. In general, the issue of benefits is considered in Federal Law No. 271.

Overhaul in the Moscow region and Moscow

It is important to remember that Article 169 of the Housing Code of the Russian Federation gives beneficiaries full or partial exemption from payment, and does not oblige them. Compensation is received from the regional budget.

All regions have adopted legislative acts that detail the registration procedure, conditions, and the amount of benefits.

The region with the highest tariffs is Moscow and the region. It is there that most people apply for a discount on the payment of contributions for major repairs. Every day, the MFC receives more than 1,000 applications for benefits.

Pensioners over 70 years of age living in the central regions of Moscow pay 50 percent of the amount using receipts that have already been recalculated and deducted. For the rest, the amount is returned in the form of a subsidy. In addition, when applying for a subsidy, Moscow residents do not have to present a personal account number; they can use a Muscovite card.

Who is eligible among pensioners over 80?

Payment for major repairs after 80 years - who is entitled to receive benefits? The category of beneficiaries includes:

  • a pensioner living alone over 80 or a married couple, one of whom has reached the specified age);
  • unemployed;
  • owning housing that meets certain social standards;
  • an important point is the absence of debt and fines: compensation will not be paid to debtors and those who boycott the obligation to pay contributions.

Who can count on receiving benefits

Today, many are given a 50 or 100% discount on fees for major repairs. This category includes citizens:

  • veterans, participants of VO;
  • heroes of the USSR;
  • disabled combat veterans;
  • Chernobyl victims and many other persons provided for by federal legislation.

Also, changes were made to the law that apply to pensioners over 70 years of age. Beneficiaries may also include:

  • the owner is over 70 years old, does not work and lives alone, then he can count on 50% compensation;
  • if a pensioner is over 80 years old, then he is given the opportunity not to pay these contributions at all;
  • disabled people of groups 1 and 2. Or the family is raising a disabled child. Then they are entitled to 50% compensation.

When calculating a subsidy, two important components are taken as a basis:

  • from the fee for 1 sq. meter;
  • You may underpay for the minimum area of ​​the apartment. One pensioner is entitled to 33 sq. meters, if a married couple lives, then 21 square meters. meter for each.

Single pensioners are considered to be people who have reached the age of 70, registered at their place of residence alone or together with the same pensioners who may qualify for benefits. It may be the case that if a pensioner who has reached the required age lives with a pensioner who is under 70 years of age, then he is assigned the status of not being single and cannot qualify for a subsidy.

To pay or not?

The most common question that social service workers are asked in connection with contributions to the fund for capital repairs of apartment buildings and processing compensation: “I am 80 years old, should I pay for capital repairs of my house?” After all, it seems like Putin exempted pensioners over 80 years old from paying housing and communal services for major repairs.

To receive compensation for major repairs, pensioners over 70-80 years old are still required to pay for major repairs. Let us be clear: we are not talking about a complete abolition of payments!

Elderly people over 80 receive a refund of the amount paid in the amount of one hundred percent . But this does not relieve them of the obligation to pay receipts on time, but the expenses will be fully reimbursed every month.

Citizens over 70 years of age from the category of beneficiaries will receive a refund of 50 percent of each monthly contribution.

Do Don pensioners need to pay for major repairs after 80 years of age?

Since not all people of his age will be able to taste the joy of renovation, a law has been passed in the Rostov region according to which people over 80 years of age are actually exempt from paying contributions: they pay them into the capital repair fund, but the social security system is built in such a way that each time they are compensated for this money in in full from the budget. But this system cannot be understood by a veteran.

— For four and a half years, they have been sending me receipts to pay for future major repairs, which will no longer be carried out during my lifetime, since today I am already 90 years old. I pay them regularly every time. Otherwise, I will not be able to take advantage of the discount on utility bills. But I don’t have to pay anything! - says Pavlenko. And I decided to refuse payments for major repairs altogether. For the fourth month, on the advice of well-wishers, he has not paid his dues, and his debt is accumulating. Accordingly, now he certainly does not receive compensation.

RG turned to the regional Ministry of Social Protection for clarification. According to regional law No. 511-ZS “On providing compensation for the costs of paying contributions for capital repairs to certain categories of citizens,” non-working owners of residential premises who have reached the age of 80 or more, living alone, like Vasily Alekseevich, have a 100% discount on paying for major repairs

. — Many people, and this applies to people after 70 years of age, who, in fact, are recipients of benefits for major repairs, have the belief that the regional law exempted them from paying contributions - after 70 years - by 50 percent, after 80 - by one hundred percent . And that’s why they are very indignant when they receive receipts for payment,” explains the Ministry of Labor and Social Protection of the Rostov Region.

In fact, all owners of square meters in apartment buildings pay into the capital repair fund. It is this money that is used to clean up residential high-rise buildings. Another thing is that beneficiaries are reimbursed for the funds they spent, but from a completely different source - from the regional budget.

Thus, the achievement by the owner of the premises of the age of 70 - 80 years or the status of a beneficiary is not a basis for stopping the issuance of payment documents for the payment of contributions for major repairs or reducing the size of such a contribution in the payment document. “Federal and regional legislation does not provide for an exemption from paying contributions for major repairs of common property in an apartment building; calculation and payment of compensation is made after payment of monthly contributions,” the ministry’s official response says.

Liberation in various regions of the country

Despite the fact that the program was officially adopted in January 2021 and funds for its implementation are included in the budget, a number of regions lag behind, and social security and regional operators receive questions, complaints and claims :

  • in the Tambov region it was decided to preliminarily calculate the number of beneficiaries;
  • in the Khabarovsk Territory the decree has been in effect since February;
  • in the Kostroma region, all documents were signed before the new year and the resolution came into force;
  • The Belgorod region promises to return the money paid since January, but only in July;
  • in the Kaluga region, the law applies exclusively to 2021. Based on the results, a decision will be made about his fate;
  • The Bryansk region is just beginning to develop new regulations;
  • The Vladimir and Kursk regions were the first to join in and are already reimbursing pensioners for what they spent;
  • in Tula the bill is just being prepared for consideration.

A number of regions are reporting problems with the budget and administrative delays, but one way or another, the law will work for everyone.

According to Rosstat, there are almost 3 million pensioners in the country who will be assigned a social support measure.

Who can't pay?

The changes that were made to the legislative draft in 2021 continue to apply. And they relate to the provision of benefits to certain categories of citizens. At the same time, to confirm the benefit it is necessary to provide a considerable number of documents.

Did you let relatives into the apartment? Be prepared to pay a fine!

The following categories of citizens are completely exempt from contributions aimed at carrying out major repairs:

  1. Single property owners over the age of 80.
  2. Family members of pensioners over 80 years of age.

Thanks to the new legislative draft, you can get a 50% discount. Disabled people (first/second group), children with disabilities and those who care for them have the right to receive. Also single property owners over 70 years of age, family members of pensioners over 70 years of age.

Partial compensation for contributions to major repairs is also possible for the following persons:

  • disabled people and WWII participants;
  • low-income persons (documentary evidence required);
  • families that have been assigned the status of “large families”;
  • persons with the title “Veteran of Labor”;
  • citizens who have been rehabilitated after repression.

The listed citizens can count on compensation only if the amount contributed for major repairs is more than a certain share of income.

How to get compensation?

As a result of the Presidential decree, pensioners may not make contributions for major repairs from the beginning of this year. Accordingly, for the past time from January to the present day, you can receive compensation for contributions, because they were paid in the prescribed manner.

To receive compensation payment, you need to prepare a package of documents. Receipts for payment of housing and communal services will be required. It is also assumed that you will need a printout of the payments made from the management company - it is also the basis document for compensation.

The director of the legal service “Unified Center for Protection” (edin.center) Konstantin Bobrov answers:

Unfortunately, in your case there are no benefits for paying for major repairs. Article 153 of the Housing Code of the Russian Federation establishes that the obligation to pay contributions for major repairs in an apartment building arises for homeowners from the day when ownership of the premises was registered. Persons who are simply registered in this residential area do not have such responsibilities. That is, family ties in this case are not relevant to the calculation and payment of contributions for major repairs.

From January 1, 2021, settled disagreements regarding the provision of benefits to pensioners (owners of premises) for paying contributions for major repairs will come into force. The list of pensioners entitled to this social support has expanded. Pensioners 70 years of age and older can benefit from a refund of paid contributions for major repairs.

The provision of benefits is of an application nature (the application with the necessary list of documents is considered within 10 working days). To provide it, you need to prepare supporting documents and submit them to multifunctional service centers or social protection. Also, this benefit is essentially compensation. That is, the owner must make a monthly contribution for major repairs, and then the money will be returned to him according to the details specified by the applicant.

When pensioners may not pay for major repairs

  • If the pensioner’s age exceeds 70 years, then, upon his application to the social protection authorities, half of the paid contribution amount is returned.
  • If the pensioner’s age exceeds 80 years, then, upon application to the authorized bodies, the payer will be fully compensated for the costs spent. An important condition is that both in the first and second paragraphs, the pensioner must be unemployed.
  • When a pensioner lives in dilapidated or dilapidated housing. For housing that cannot be restored, it is quite natural that you do not need to pay into the capital repair fund.
  • If the house in which the pensioner lives, and accordingly the land under it, is seized for state needs. It is true that when a residential property is repossessed, concerns about major repairs are not relevant.
  • If it’s really difficult to pay, you can consider transferring housing from the pensioner’s property to municipal ownership. Residential tenants do not pay for this expense, but it is necessary to be aware of all the legal consequences of such a transaction. By ceasing to be the owner, the pensioner will lighten the load on his wallet a little, but will also lose the right to sell, bequeath, and even register family members there without the permission of municipal authorities.
  • If the apartment in which a pensioner lives is located in a new building, then, depending on regional legislation, the owners of such apartments are exempt from paying money to the capital repair fund for a period of three to five years.
