3 types of benefits for a child at birth

Quite often you can hear rave reviews regarding mothers with many children. “What a great fellow you are!” - everyone says. But for some reason, many people forget about the contribution of fathers to raising their own children. After all, they bear no less responsibility than their mother. A father must not only provide for his family, but also raise his children. And this is not an easy task. Therefore, the state does not forget that there is a father with many children in the family; benefits are provided to him as well. Which ones exactly? Let's look at it in this article.

Legislative basis.

A father with many children has the right to apply for assistance from the state. This situation is regulated not only by federal legislation, but also by municipal acts.

First of all, when considering this issue, you need to remember the rules in accordance with which a father can be recognized as having many children.

They are contained in Presidential Decree No. 431.

It also says that the rules for the provision of compensation and benefits are established at the municipal level.

Therefore, we can conclude that upon the assignment of the status of having many children in relation to the father, one must refer to regional legislation.

Legislative framework of the issue

The norms of current law, regardless of the gender of a single parent, provide for the provision

social guarantees. The equalization of men's and women's responsibilities regarding child care is regulated by legal acts in the international arena.

Initially, there was a problem in the unsecured legal status of the father, who is raising the child alone. Representatives of government bodies often interpreted the provisions of the legislation in the field of receiving benefits and maternity capital inappropriately, referring to the indication in official documents of the term “mother” and not “father”.

However, today the issue has been resolved and does not cause controversy.

Who is the father of many children?

Most often, men with three or more children fall into this category. It does not matter whether they are their natural children or were once adopted.

Here one more condition must be met - the children are dependent on the father. And this can only be proven in one way - they must live with their father.

In addition, the following are treated as having many children:

  • children over 18 years of age with disabilities and
  • children 18-23 years old studying at a university full-time.

Who is considered a large family?

In modern legislation there is no clear concept of a large family or a parent with many children.
According to generally accepted opinion and guided by the standards established by GOST-R 52495-2005, a father or mother with many children is a person who is raising three or more children who have not reached the age of majority and are duly recognized as having many children. At the same time, regions are given the right to independently determine the threshold for large families.

In addition, a father or mother of many children is a person who is dependent on three adopted children, as well as adopted children under 18 years of age and children who, for some reason, live separately from their parents.

Please note that a large family does not include children under guardianship or guardianship, as well as those who are fully supported by the state.

After amendments were made to the Child Protection Law, a family raising children other than their common children (stepdaughters and stepsons) is also considered to have many children, whereas previously such a family could not obtain such status.

Both mother and father living in a legal marriage and raising three or more children automatically receive the status of parents of many children.

To receive benefits, it is necessary that children register or live in the same living space with a father or mother with many children.

Types of assistance for fathers with many children.

Despite the fact that benefits are most often determined at the regional level, the presidential decree contains provisions that must be complied with.

Here is a minimum list that fathers with many children in the regions can definitely apply for.

The Ministry is obliged to monitor the amount of assistance to fathers with many children and index it.

A father with many children is provided with the following benefits:

  • special conditions for medical care,
  • reimbursement of part of utilities,
  • free travel around the city,
  • priority enrollment of preschool children,
  • free meals at school,
  • provision of form,
  • benefits for business development,
  • labor benefits.

Let's look at some types in more detail:

Social benefits.

Benefits associated with preschool and school general education institutions. Take even such a benefit as free food. If a child in a large family has to pay for meals, not every family budget will be able to cope with this task. Especially when the father raises the children alone.

The same goes for buying a school uniform. The priority right to enrollment is necessary so that the father can quickly go to work and provide for his family.

The state has not forgotten about the cultural component. Benefits for a single father with many children come down not only to direct financial assistance, but also to indirect.

For example, he can:

  • take your children to the museum for free (no more than once in 30 days),
  • obtain a loan or mortgage on preferential terms,
  • obtain a plot of land for individual housing construction or for farm development.

This includes:

  • 100% tax reduction,
  • reducing the tax rate on your business,
  • compensation in the amount of 25%, provided as a deduction from the university education tax,
  • the usual tax deduction for each child is in the amount of 1400-3000 rubles.

Housing and communal services benefits.

Dads can qualify for reduced utility costs. Utility reimbursement varies from 30 to 50% depending on the region.

Naturally, water, electricity and other services are consumed more in a family with children. This support will help reduce utility costs.

In addition, a father with many children living in a private house with his children can claim firewood and solid fuel, the amount of which is established at the regional level.

Labor benefits.

The next thing a father of many children is entitled to is benefits at work .

  • They are obliged, first of all, to be provided with jobs, subject to certain qualifications and experience,

  • they cannot be sent on business trips, assigned to work at night (without consent),
  • if a father alone is raising a child under 5 years of age or a disabled child, he is entitled to 4 days off in 30 days in addition to the generally established ones (with salary retention),
  • vacation at any time chosen by an employee with many children.

Transport benefits.

Who belongs to this category? The concept of "single father"

There is no legal interpretation of the concept of “single father” in Russia. The status of a single parent is acquired regardless of gender; the father and mother have undivided rights and responsibilities during family life.

The opportunity to obtain legal recognition for a single dad in 2021 is achieved by meeting certain requirements:

  1. The need to provide a document in the event: The mother is deprived of her rights to the child in court or otherwise.
  2. Confirmation of the fact of his wife's death.
  3. She was declared missing.
  • A joint child is under the full guardianship of the father.
  • A woman's presence outside the family for a long time or the end of a marriage are not the determining factors for a man to be recognized as a single father.

Rights and benefits for single fathers. Changes in 2021

According to the legislator, single-parent families are considered the most socially vulnerable category and require comprehensive government support. You can find out what benefits a single father has in a particular regional district by contacting the social security authorities at your place of residence.

Benefits for pensioners on the railway

    Benefits available:

    • social;
    • housing;
    • labor;
    • tax.

There are no changes to the established list of benefits and privileges for single fathers for the next year.

    Social benefits

A father raising a child without the participation of the mother has the right to receive the privileges provided by law. These include:

    1. A one-time payment associated with the birth of children.
    2. Paid maternity leave to care for a baby.
    3. Monetary compensation for the maintenance of a child until he reaches adulthood.
    4. Coverage from the local or regional budget of some expenses for the parent when paying for a preschool educational institution.
    5. Pension provision in case of loss of a breadwinner (death of a spouse).
    6. Collection of alimony (allowed by court decision in divorce proceedings).

    Housing benefits

The legislator provides single dads with privileges in the provision of housing with adequate living conditions.

If we are talking about the use of office premises as a “family home”, the management bodies of the enterprise do not have the right to evict a single father even after dismissal.

Upon registration, this category can count on free residential repairs. Privileges of this nature are provided not at the state level, but at the regional level, by decision of local authorities.

There are special programs that allow you to purchase housing at the best prices.

    Labor

Additional benefits are guaranteed in the field of labor law. The goal of the legislator is to create equal working conditions for various categories of the population, an ideal combination in the implementation of professional and family qualities.

A special attitude is manifested in the following:

    1. An employer does not have the right to refuse an application for employment by a single parent. The prohibition applies to reducing the salary level of such an employee. Disagreement with employment must be in writing and provided to the potential candidate for the position. The reason for refusal cannot be the presence of minor children. An unlawful action by an employer is subject to challenge in court.
    2. Getting a working dad to work overtime requires special rules. The point is to obtain the written consent of the employee to perform professional duties beyond the established working hours. It is necessary to comply with medical indications for the actions performed.
    3. Refusal to fulfill professional obligations at night is not a violation of labor regulations. A father (guardian, adoptive parent) who has a child under 5 years of age is not legally obliged to fulfill this kind of requirement of the employer. Consent to night work is provided in writing, taking into account the state of health.
    4. Part-time work can be established by signing an agreement on mutual terms.
    5. Dismissal at the initiative of the employer is prohibited, except in cases directly regulated by the Labor Code of the Russian Federation.
    6. Possibility of additional leave without pay. Temporary rest from everyday work is allowed at any time convenient for the employee, except for use in the next calendar year.
    7. Sick leave is provided for a longer period. If the child is disabled, then 4 additional days off are provided monthly.

    Tax benefits

State privileges in the field of tax law are characterized by the concept of “tax deduction”. In the case of being raised by a single parent, the amount is double. The guarantee is possible until the child reaches 18 years of age.

The paperwork and calculation of the amount are carried out at the tax office at the place of employment.

The right to use becomes invalid if the income portion for the tax period is equal to an amount above 280,000 Russian rubles.

    Types of financial support

A single father is equal to the status of a single mother, and accordingly the monetary payments are the same. However, the man's earnings level will be an important factor. If the amount earned is below the established subsistence level, there is hope of receiving government assistance, otherwise the chances are practically excluded.

To date, the following financial support is stipulated by law:

Name of monetary compensationSize / Russian rubles / %
1.One-time payment in connection with the birth of a child 15500
2.Care amount up to 1.5 years
    (first)

3.Payment for preschool for the first-born child

The amount of additional local payments should be clarified with the social protection authorities at your place of residence.
