What is a certificate of employment and when is it issued?

The issuance of a certificate of employment is regulated by Art. 62 Labor Code of the Russian Federation. It refers to documents related to work and is issued for presentation at the place of request. The document is in the nature of confirmation or clarification of the requested information. Such certificates are often required by social security authorities, banking, credit institutions and others. The certificate is issued free of charge upon the employee’s oral or written request within three days from the date of application.

To obtain a driver's license

The adult generation has recently become increasingly interested in the question of how to obtain a certificate to obtain a driver’s license. According to the latest changes in the order of the Ministry of Health dated March 26, 2016, a similar document is provided when:

  • Applying for a job as a driver.
  • Obtaining a new category of driving license.
  • The desire to re-issue a driver's license after the driver was deprived of his license by a court decision.

A large number of motorists, both entering training and undergoing repeated medical examination, must provide this document before receiving the certificate itself. The procedure for issuing a certificate of this type is regulated by Order of the Ministry of Health of the Russian Federation No. 344n dated June 15, 2015. You can get it in a public or private clinic that has the appropriate license. The medical report is drawn up on form 003-Vu. In addition to the driver’s personal data, the text of the certificate indicates the category of the vehicle that he will subsequently drive. Its validity period is determined by order and is twelve months from the date of its issue.

What information is indicated in the certificate of employment?

The information that must be indicated in the certificate of employment is provided by the employee himself. It can be:

  • salary certificate;
  • about personalized accounting and length of service;
  • about the nature and conditions of work at the main place of work;
  • that the employee does not enjoy certain types of benefits;
  • other.

The places where certificates of employment can be presented can also be very different. This:

  • embassies, travel agencies for visa processing;
  • for presentation to courts;
  • to the pension fund; to a new place of work;
  • in the organization of social security;
  • other.

Where and when is help required?

  • privatization of real estate;
  • receiving housing subsidies;
  • registration of various child benefits for low-income families;
  • purchasing an apartment (to check the history of transfer of rights);
  • use of maternity capital;
  • collection of alimony through the court;
  • change of place of registration;
  • military registration;
  • getting a job in a government agency, etc.

Popular certificate forms

There are standard certificates, for example, a salary certificate - form 2-NDFL. It contains information about the employee's source of income, his salary and taxes withheld. Issued by the employer for a certain period (usually a year).

The form of the certificate for the calculation of temporary disability benefits by the future employer was approved by Order of the Ministry of Labor of the Russian Federation dated April 30, 2013 No. 182n. Contains information about:

  • on the amount of salary for the two calendar years preceding dismissal and the current year for which insurance premiums were calculated;
  • how many calendar days of the specified period fell during periods of temporary disability, maternity leave, child care, release from work with full or partial retention of wages, if insurance contributions to the Social Insurance Fund were not accrued on the retained wages for this period.

The employer must issue such a certificate on the day the employee is dismissed, otherwise the employee has the right to apply for it later.

Important!

There is a recommended form for such a certificate in Letter of the Ministry of Labor of the Russian Federation dated August 15, 2016 No. 16-5/B-421.

You can draw up a certificate in any form; only the details of the enterprise and information about average earnings for the specified period are required.

To obtain the right to a pension you will also need certificates from work:

  • in the form of SZV-experience, approved by Resolution of the Board of the Pension Fund of the Russian Federation dated January 11, 2017 No. 3p;
  • in the SZV-M form - by Resolution of the Board of the Pension Fund of the Russian Federation dated 01.02.2016 No. 83p;
  • completed third section of personalized information for calculating insurance premiums - the calculation form is approved by Order of the Federal Tax Service of the Russian Federation dated October 10, 2016 No. ММВ-7-11/ [email protected]

When is a certificate of employment issued for a visa ? This document is required by the embassy; it certifies the reliability and solvency of the tourist.

Not only the listed types of certificates are required to be issued by the employer.

Example

When applying for child care benefits, you will need a certificate from the second parent that he does not receive similar compensation at his job.

When providing additional days off while caring for a disabled child, a certificate from the other parent’s work is also provided stating that he did not take advantage of this right.

Some types of certificates are directly regulated by the Labor Code. For example, Art. 283 requires the provision of a certificate about the nature and conditions of work at the main place of work when applying to another organization on a part-time basis.

Let us remind you that combination is prohibited if the main work involves harmful or dangerous conditions.

An employee may request information about the approved vacation schedule in the main organization in order to receive vacation from a part-time job.

Important!

Art. 286 of the Labor Code states that annual paid leave in the place of combination is provided simultaneously with leave for the main job.

Also, a new employer may ask to bring a reference from the new employee’s place of work.

This is an incomplete list of what a work certificate may be required for and what information it may contain. Currently, the employer prepares and issues many certificates on the day of dismissal without the employee’s application.

According to the bank form

Since a loan has ceased to be difficult in terms of collecting a package of documents, conditions, etc., issuing certificates for the bank is not uncommon for anyone. This is an alternative to a certificate in form 2-NDFL. Using it, it is possible to indicate information about income that the employer cannot reflect in a standard document. If this document needs to be submitted to the bank, the latter, as a rule, provides either a sample or a ready-made form for the employer to fill out. There is another option when the organization in which the employee works issues a certificate on company letterhead reflecting the following details:

  • The position of the employee, his last name, first name, patronymic.
  • Date of hire or information about length of service. If a fixed-term employment contract is concluded, its expiration date is indicated.
  • The amount of wages for the last six months (a different period may be specified depending on the requirements of the recipient of the certificate). In some cases, the amount of tax deductions made may be indicated, but this is not mandatory.
  • Information about the employer, his full legal and actual address, name, contact numbers.
  • Signature of the manager, chief accountant (if he is not on staff, the certificate must indicate this), seal of the organization.

What do you need to obtain a certificate from your place of work?

The request for a certificate can be either written or oral. This depends on the document flow adopted in the organization. Sometimes the employer requires a written request indicating the purpose for obtaining the document and a description of the information that needs confirmation. In accordance with Art. 62, the employer is obliged to issue a document related to work within 3 days after submitting the corresponding written application.

Who needs to receive an epidemiological certificate?

Often, a certificate of the epidemiological environment is required to obtain a child’s trip to a children’s camp. You may also be asked to provide this document when enrolling a child in kindergarten or school.

In 2021, due to the coronavirus pandemic, both children and adults must receive a certificate of the epidemiological environment to check into a sanatorium. The document must indicate no contact with infected people within 14 days before arrival at the institution. According to the requirement of Rospotrebnadzor, you need to receive a certificate no later than three days before leaving on vacation.

Rules for drawing up a certificate

There are several types of certificates that have approved forms. We have listed them above. Basically, such documents are issued arbitrarily - there is no single form of certificate of employment, template or sample. The organization itself can develop and introduce a form for such certificates. Then it must be included in the enterprise’s document flow and approved by order.

There are general rules that must be followed when preparing documents of this type.

Who issues the certificate

Depending on the type of certificate, different departments can issue it:

  • about salaries, paid contributions - accounting;
  • about work experience in this organization - HR department;
  • the immediate supervisor also has the right to issue a certificate if it does not indicate special information.
Important!

Regardless of who prepares the certificate, it must be certified by the head of the organization or an authorized employee.

The traditional validity period for such documents is 10 days.

Who has the right to request a certificate

According to the general rule, defined in Articles and 84.1 of the Labor Code, an employee has the right to demand work-related documents from the employer. To do this, he needs to contact the management of the organization in writing. An employee has the right to request from the employer copies of documents, certificates, extracts related to his work activity, both while working for this employer and after dismissal. Labor legislation does not establish an exhaustive list of such documents, as well as a sample certificate of employment.

Important!

The statutory deadline is three days for the issuance of documents relating to the employee’s work activities.

Rules for issuing a certificate

And although there is no approved form for a certificate of employment, you can list some typical data that the document should contain. Be sure to provide the following details:

  • Name of the organization;
  • date of issue;
  • a description of the information that needs to be confirmed;
  • signature of the company director.

It is not necessary to indicate where and what the certificate is intended for. Instead of this data, it is often indicated: “At the place of requirement.”

External and internal

Depending on whose address the certificate is to be issued, it can be of an informational, reporting or analytical nature. Such a document may be intended for internal or external use. As for the first, the content of the certificate will be of an informational nature. In the second case, some preparation is required for drawing up the document. As a rule, it is printed on the organization’s letterhead or according to an established template issued by government agencies (GOST R 6.30-2003).

It is not difficult to draw up a certificate using a unified form, since reference books and other similar documents contain all the necessary instructions for filling it out. The situation is much more complicated with the free form of its writing. This is associated with the risk of losing sight of important details and details.

One of the most popular forms of external certificates is 086у. Based on this document, the employer determines the professional suitability of the employee. You can get it at a medical institution that has the appropriate permission and licenses. To do this, you need to contact a therapist, who gives a referral to specialized specialists (ENT, surgeon, ophthalmologist, neurologist), and at the end makes a conclusion. This form is approved by the Ministry of Health of the Russian Federation; today the order No. 834n dated December 15, 2014 is in force. Both sides of the medical certificate must be filled out with the obligatory indication:

  1. Dates, document numbers, information about the medical institution.
  2. Last name, first name and patronymic of the subject, date of birth, place of study/work where the document is being drawn up.
  3. Data on previous diseases and the presence of chronic ones, as well as information on vaccinations and vaccinations performed.

Information received from doctors during the examination is entered on the basis of test data and fluorography. Filling with a black or blue ballpoint pen is allowed. The certificate must be certified by the chief physician of the medical institution that issues this document; its validity period is six months from the date of issue.

Who can obtain a certificate of family composition?

The issuance of the document is regulated by Federal Law 5242-1 (dated June 25, 1993). You can get a certificate of family composition:

  • owners of living space;
  • those who are registered in the facility;
  • residents with temporary registration;
  • parents or guardians of a minor resident of the apartment (subject to the provision of a birth certificate);
  • a third party with a power of attorney;
  • representatives of law enforcement agencies and security forces upon official request;
  • lawyers and notaries.

The information contained in the document is protected by the law on the protection of personal data of individuals.

Form 7 - accompanying document

Often, when applying for a certificate of family composition, people take an extract in Form 7, which describes the technical characteristics of the housing:

  • floor and number of storeys of the building;
  • footage of the room;
  • number of rooms;
  • ceiling height;
  • year of last major overhaul;
  • date of construction;
  • building wall material, etc.

Form 7 is provided free of charge upon request of the applicant and is issued within 2 days. The certificate is valid for up to 1 month from the date of receipt.
