Maternity capital: how to get it through the MFC or State Services

The law stipulates that mothers who have given birth or adopted since 2007 can receive state support.

Applicants need to obtain a certificate, that is, a document indicating the possession of financial resources. The certificate is issued by the Pension Fund of the Russian Federation (PFR).

The registration procedure can also be completed at any MFC where it is convenient for the applicant or his representative to contact. If documents are submitted by a representative, a power of attorney is required. You can bring your application with you, but it is better to fill it out right in the center to avoid mistakes. The employee will fill it out based on the documents provided, make and certify copies of certificates and passports, and give a receipt of receipt. The MFC must inform you additionally about the date of issue of the certificate.

MK funds can be used to obtain and repay one type of loan - a mortgage loan. It is permissible to use MK funds to repay the loan available at the time of the birth of the second child, spent on purchasing housing. It doesn't matter which parent the bank gave the money to. The main condition is the registration of residential premises in the common possession of family members.

The owner of maternal capital who decides to take out a mortgage can do this as soon as he issues a certificate. You can use the funds received as a down payment or for partial repayment of an already issued loan.

According to the law, the fund issues money to the home seller after the transfer of ownership. But at this moment the first installment must already be paid. Banks use the following scheme:

  1. The father or mother is issued a consumer loan in the amount of the down payment.
  2. A mortgage is issued according to existing rules, buyers take money from a targeted loan, pay the seller for the apartment and receive ownership.
  3. The documents are submitted to the Pension Fund, which, after verification, sends the maternity capital to the bank, and the latter repays the consumer loan.

If the family is not satisfied with this scheme, they can save up for the down payment on their own, apply for a mortgage without the participation of the Pension Fund, and then request funds from maternity capital for partial early repayment of the loan.

At first it was assumed that the state support program for families with children would be valid for 10 years, until 2021. Later, legislators decided to extend it for 2 years, and then, on the basis of federal law 423-FZ, the validity period was extended until December 31, 2021. The mother will have the right to apply for MK if she gives birth to a second child before 2022. It will be possible to issue a certificate and use the required financial resources after this date for an unlimited period of time, subject to the requirements of 256-FZ. Perhaps legislators will raise the issue of extending the validity of 256-FZ for some more time.

Who is entitled to mat capital?

Federal Law No. 256, which contains information on measures of state support for the population, including maternity capital, establishes the basic rules that apply to program participants.

In order to obtain the right to use maternity capital, you must be the parents of a second or subsequent child who was born after 2007. You must be a participant in the program for the first time, that is, you have not received this measure of government support before.

The following categories of citizens have the right to financial support:

  1. These are mothers who gave birth to a second and subsequent child , provided that they did not use the right to receive capital.
  2. The second category is women, as well as families who adopted a second or subsequent child, but did not use this measure of state support.
  3. Fathers also have the right to maternal capital, but if they are the only adoptive parents and have not previously used this measure of state support.

Rules and nuances of registering maternity capital through the MFC in 2021

Article 3 256-FZ fully describes the range of possible applicants for state support. It states that it is quite possible for a family to receive money for 3 children at the federal level. This is possible if an application for maternity capital was not submitted at the birth of the second one. The appearance of the first two children in the family could have occurred before 2007, when the regulatory act on state support was not adopted.

The owner of an MK can receive money by bank transfer from the Pension Fund in the form of:

  1. Benefits for a second child from 0 to one and a half years old according to 418-FZ. The volume of this payment will be equal to the minimum subsistence level for children approved in the republic, territory or region in which the parents live. The amount varies by region, on average about 10 thousand rubles.
  2. Payments for the purchase of building materials, hiring contractors to build your own home.

The categories of persons entitled to support from the state are:

  1. women who gave birth or adopted a second child, whose birth occurred after January 1, 2007. The same rule applies to all subsequent children - third, fourth, etc.;
  2. citizens who have registered for adoption or foster care after the entry into force of legislation regulating the issues of financial support for families with two or more children;
  3. biological parents or male adoptive parents, when the biological or adoptive mother of their children lost the right to maternity capital due to death;
  4. minor children receiving formal education if both parents have lost their right to a subsidy for any reason. An employee of the guardianship authorities, a foster carer, a guardian, etc. acts on behalf of a minor citizen.

Items 1 and 2 of the list apply exclusively to citizens of the Russian Federation. Paragraph 3 also refers to non-residents whose spouses have or had Russian citizenship.

The obvious advantage of contacting the MFC is working on the “one-window” principle. This means that all issues, including consultation and transfer of documents, are resolved during one appointment with one employee.

Another advantage of the MFC is its territorial independence, which allows citizens to apply regardless of their place of registration. You can submit documents to the Center in any region of the country. This cannot be said about the Pension Fund, where subsidies are issued only at the place of permanent registration.

In general, no further significant differences are observed between applying to the MFC and the Pension Fund.

In addition to processing documents to receive a subsidy, the right to spend it is exercised through the MFC. To do this, submit a corresponding application with attached documents. Their list is determined by the direction of spending that the applicant has chosen.

In all cases, the person applying to the MFC attaches to the application:

  • parent’s passport and SNILS;
  • subsidy certificate.

If a minor child who is officially recognized as legally competent has the right to maternity capital, the list is supplemented with a document certifying this fact. This could be a marriage certificate, a court decision, or a decision from the guardianship authorities. When representing the interests of a child at the MFC by a third party, a notarized power of attorney of the representative and a copy of his passport are attached.

Registration of maternity capital in the MFC

When spending maternity capital to improve living conditions, the basic package includes:

  • registered purchase and sale agreement - for citizens buying new or secondary housing. If payment is made in installments, a certificate from the bank regarding the unpaid balance must be attached;
  • mortgage lending, purchase and sale and pledge agreements - if housing conditions are improved through the purchase of housing with a mortgage;
  • agreement for the provision of educational services – when maternity capital is spent to pay for the child’s education;
  • a shared construction agreement and a certificate from the developer confirming full or partial payment of the share - upon joining the participants in shared construction;
  • an agreement for a construction contract, an official building permit, a title document for a land plot - when constructing a private house with the help of a construction company or on its own;
  • title document for housing - if maternity capital funds are required to reimburse expenses associated with major repairs or reconstruction of a home;
  • an up-to-date rehabilitation program for a disabled child, checks or payment orders confirming the fact of purchase, an act of establishing the availability of goods - when providing for disabled children;
  • agreement on opening a savings account - if maternity capital is used to create a funded pension.

  4. The process of registering maternity capital can be divided into two stages . The first stage is the initial one, and involves issuing a certificate for budget funds. The second is final and is expressed in the sale of money in the directions chosen by the family. Each stage has legally defined rules and a separate package of documents.

    Within the framework of clause 6 of Order No. 138n, from the beginning of 2021, a certificate can be issued without an application already with the birth of the first child. So, after receiving information about the birth of a baby, the Pension Fund of Russia independently:

    1. They check information about the birth of the baby and his parents.
    2. Send requests to the appropriate authorities to confirm the citizenship of the newborn, family composition and other data required to make a decision on providing state support.
    3. The certificate is issued electronically.
    4. The father and mother are notified of the decision made and the availability of the certificate.
    5. They reconsider the decision to increase the amount of capital if the family did not apply for funds after the birth of their first child.

    To manage maternity capital funds, it is not necessary to receive a certificate in paper form; the electronic version has the same legal force and can be implemented in the manner prescribed by law.

    Before March 1, 2021, the established period for consideration of an application for a certificate was 15 days. If Pension Fund employees need to make additional inquiries to verify the accuracy of the information provided, the period may be extended to one calendar month.

    Now, this period has been reduced to 5 days when submitting an application in person. The applicant is notified the next day of a positive decision to issue a certificate.

    There is also a change in the timing of consideration of applications for the use of maternal capital. If before March 1, 2021, this took a whole month, now the decision must be made within 10 working days . A day is given to notify the applicant.

    In order to receive a certificate, you must make an appointment at the MFC or visit the organization and get advice from a specialist on a first-come, first-served basis.

    A citizen can choose a branch of an organization not only at his place of residence, but also where he is located.

How to use maternity capital to buy a home

Cases often arise when not everyone knows how to use the received cash certificate in the most profitable way, especially since there are many nuances.

The family receives this assistance in the event of the birth of a second child, and can use it when this child reaches 3 years of age, with the obligatory condition of allocating living space for each child.

The procedure for improving living conditions is carried out in the following order:

  • Choosing housing that meets the living conditions for all family members;
  • An agreement between the seller and the buyer on the use of maternity capital, since the transaction is reviewed through the Pension Fund within 2 months;
  • A preliminary contract for the purchase and sale of housing is concluded, and then the documents are transferred through the MFC to the Pension Fund for consideration;
  • After the procedures have been completed, subject to the approval of the Pension Fund, the transaction is carried out by signing the main purchase and sale agreement and transferring funds to the seller’s account, bypassing the needy family.

There are several ways to buy housing using maternity capital, but for this you need to take into account all the conditions and features provided by the state.

Without using a mortgage

In this case, you need to go through several stages of registration: signing an agreement with the seller, registering a cash loan from a bank or an agreement with the seller on the use of capital, submitting documents to the Pension Fund on the sale of the certificate, crediting funds to the account of the loan provided to the bank or seller, and then registration property in Rosreestr through the MFC.

Using a mortgage

In this case, the amount of maternity capital can pay off either the entire amount of the mortgage or its down payment. The whole procedure is divided into the following stages:

  • the choice of bank, the package of loans provided contains an offer to provide a mortgage using maternity capital;
  • review by the bank of the client for solvency;
  • registration and collection of documents for the purchase of housing;
  • registration of a mortgage transaction with the provision of all necessary documents relating to the purchased housing;
  • registration and signing of the purchase and sale agreement and the acceptance certificate;
  • registration of property in Rosreestr through the MFC;
  • provision of a complete package of documents to the Pension Fund through the MFC for consideration;
  • funds are credited to the account of the bank providing the mortgage.

Maternity capital through the MFC.

In order to repay a mortgage with maternity capital through the MFC, you will need to do the following:

  • Notify the financial institution of your plans.
  • Obtain a certificate from the bank about the loan balance.
  • Prepare a receipt from a notary for the allocation of equal shares in real estate to all family members, including minors.
  • Write an application to the MFC and attach the necessary documents to it.

The bank statement must indicate the bank account details for the transfer of funds. It usually takes 1-2 days to issue a certificate.

At the same time, some financial institutions recommend that you first write an application for early repayment of the mortgage or part thereof.

The shares that will be allocated to children in the property can be determined by agreement. However, in general, their cost should not be less than the amount of the subsidy.

The ability to issue a certificate through the MFC greatly simplifies the procedure. A parent eligible for payment can visit the Center, submit an application and attach documents to it. The service is provided free of charge.

The MFC also accepts applications for the disposal of maternal capital funds. In this case, the documents themselves are transferred to the Pension Fund, whose employees make the final decision.

An application for a certificate can also be submitted through the Government Services Portal or in your personal account on the Pension Fund website.

You can submit an application to the MFC for repayment of the mortgage with maternity capital before the child turns three years old . To do this, the applicant must contact the territorial department of the MFC with an application and the following list of documents:

  • The obligation to register housing as the common property of all family members, certified by a notary.
  • An account statement about the receipt of loan funds - in the case of using family capital to pay off the principal debt and repay interest on loans or borrowings (including mortgages).
  • Mortgage agreement that has passed state registration - when funds are spent to pay the down payment or repay the principal debt and interest when taking out a loan for the purchase or construction of housing.
  • A registered agreement for participation in shared construction - when sending MSC to repay the principal debt, as well as pay interest on a loan or loan (including mortgage), if the house has not yet been put into operation.
  • Loan agreement for the purchase or construction of housing (loan agreement) - when MSC funds are spent to pay the down payment for the purchase or construction of housing, as well as to repay the principal debt and interest on the loan.
  • Payment order - when sending funds to pay the principal and interest.
  • A certificate from the lender about the amount of the remaining principal and interest debt - when repaying the principal and interest on the loan.

The main change in legislation regarding the registration of maternity capital in 2021 is the extension of the period for its issuance. Federal Law No. 432-FZ stipulates that certificates for mat. capital will be issued until the end of 2021.

Initially, the program was designed for 10 years: from 2007 to 2016, then the validity period was extended until December 31, 2021.

Families raising 2 or more children can receive maternity capital if the second child appeared in the family after January 1, 2007. The period for obtaining a certificate expires when the child turns 18 years old, after whose birth it could have been issued.

The following are eligible to apply for a certificate:

  1. Women citizens of the Russian Federation at the birth or adoption of a child;
  2. Men citizens of the Russian Federation who are the sole adoptive parents of a child;
  3. A man who is the parent or adoptive parent of a child if the child’s mother has died or been deprived of parental rights.

How to obtain a certificate for maternity capital

The list of documents that need to be collected to obtain maternity capital is as follows:

  • Passport and SNILS of the applicant;
  • SNILS for each child;
  • Birth certificate of children (or decisions on their adoption).

Original documents must be presented to the MFC; copies can only be provided if they are certified by a notary.

You can fill out an application at home or directly at the MFC. The application must indicate:

  1. Name of the organization to which the documents are sent;
  2. Full name and passport details of the applicant;
  3. Degree of relationship with the child (mother, father);
  4. Nationality of the applicant;
  5. Insurance number;
  6. Registration address and place of actual residence;
  7. Information about all children raised in the family (the list is compiled in chronological order as children appear in the family);
  8. Date of application and signature.

After receiving the documents, the center specialist checks their authenticity and the existence of grounds for obtaining a certificate. The procedure can take from 5 days to 1 month, if additional clarification of data is required in other authorities. The applicant is then notified of the decision.

In case of refusal to issue a certificate, the applicant is notified of the reasons for such a decision.

No changes were made regarding the areas of use of maternal capital in 2021. In accordance with Article 7 of Law No. 256-FZ “On additional measures to support families with children" funds can be spent on:

  • Improving the family's living conditions;
  • Education of children, including preschool;
  • Savings pension for mother;
  • Compensation of costs for the purchase of goods and services for disabled children.

Required documents - what and where to submit

In matters of obtaining maternal capital, it is very important to give an important role to the collection of documents. An incorrectly compiled list or an incorrectly formed package is grounds for denying you this subsidy.

Therefore, we recommend that before contacting the Pension Fund branch with a package, call and clarify what documents are needed and the number of required papers:

  1. First of all, parents need to decide who will be the applicant. As a rule, this is the child's mother.
    An application is drawn up on her behalf, in which the family requests that this measure of state support be used. The applicant provides his passport, which proves his identity.
  2. It will not be superfluous to provide a marriage certificate, photocopies of the father’s passport, and the children’s birth certificate.

Is it possible to register maternity capital at the MFC?

Before contacting the MFC, it is important to familiarize yourself with the legal requirements regarding documentation. Otherwise, there is a high risk of having the papers returned and having to go through the procedure from scratch.

For 2021 you need:

  • An application that is drawn up taking into account the requirements of current laws.
  • SNILS and personal document (passport) of the applicant.
  • SNILS for children.
  • Documentation confirming the fact of replenishment of the family. If we are talking about a natural child, this is a certificate, and in the case of adoption, the corresponding paper from the guardianship authorities.

Regular copies are not suitable for issuing a certificate of financial assistance; they must be certified by a notary. If possible, it is better to submit the original papers. In some cases, MFC employees may require additional documentation to confirm the legality of providing financial assistance. Such requirements are legal and must be fulfilled by the applicant. If the MFC has requested additional documents, a person has two options - deliver the papers upon request or refuse maternity capital.

To receive maternity capital using a multifunctional center, you need to fill out an application. To avoid refusal, it is important to fill out the document correctly and indicate the following information:

  1. The name of the organization to which the application is being submitted.
  2. The applicant's full name, as well as other important information.
  3. Who is the person who seeks help for the newborn child?
  4. Information about the representative who acts on behalf of the applicant legally (if any).
  5. Information about children who are adopted or born. It is recommended to sort by age - start with the oldest, and then move on to the younger ones.
  6. Signature and date of application.

Due to the fact that maternity capital is issued if there are 2 or more children, there is no need to pay a state fee.

At the initial stages of the Maternity Capital program, according to Federal Law No. 256, regional branches of the Pension Fund of the Russian Federation were authorized to issue a certificate for the issuance of cash assistance. However, in 2014, changes were made to the rules for obtaining a certificate, thanks to which you can apply for its registration at Multifunctional Centers (MFCs), which provide public services in all 85 regions of the country.

Since the majority of citizens entitled to receive a certificate do not follow changes in the rules for issuing it, many of them have no idea whether it is possible to register maternity capital at the MFC, and therefore traditionally apply for the document to the nearest branches of the Pension Fund.

This method is associated with many inconveniences, because the flow of visitors increases, as does the workload of PF employees.

An alternative to visiting the Pension Fund may be to submit documents for a certificate through the MFC. After verification, the documents are sent to the territorial body of the Pension Fund, where a decision will be made within a specified time frame.

So, to the question of whether it is possible to obtain a certificate for maternity capital at the MFC, there is a positive answer. The procedure, package of documents and response times are almost identical to those established for the Pension Fund.

Having decided to use the services of the Multifunctional Center, you should find out what documents are needed to submit an application for maternity capital at the MFC. Their list is identical to the package of documents for the Pension Fund and includes:

  • a statement drawn up in accordance with the requirements of the law;
  • passport and SNILS of the applicant;
  • SNILS of each child in the family;
  • a document confirming the Russian citizenship of the mother or adoptive mother;
  • birth or adoption certificates of children, if adoption took place.

In some cases, to resolve the issue of the legality of issuing a document for maternity capital, the center’s specialists may request additional papers. This requirement is legal and must be fulfilled by the applicant.

After acquiring the right to receive a maternity capital certificate, citizens are faced with a dilemma - to submit documents to the MFC or the Pension Fund. The conditions and algorithm of work in both institutions are absolutely identical and include:

  • filing an application;
  • providing the same package of documents in both cases;
  • making a decision: positive - in the form of a certificate, negative - in writing, indicating the reason.

Thus, issuing a certificate through the MFC and the Pension Fund has no fundamental differences. The advantages of applying to the MFC include the comfort and convenience of the applicant, because in this case you can save yourself from standing in long lines by using a pre-registration.

In order to use maternity capital funds, families with children must obtain a certificate in the manner prescribed by law. Receiving a document through the Pension Fund and the MFC has no formal differences. The scheme for obtaining the certificate, the package of documents and the form for obtaining the result are similar in both institutions. Executed documents can be presented to dispose of funds allocated by the state. They have legal force.

The process of obtaining a certificate and reviewing an application for the use of maternal capital through the MFC differs only in convenience for the applicant and takes less time.

In order for the interaction between citizens and government bodies to be carried out more efficiently and with minimal time losses, a federal program was implemented to create special multifunctional centers.

When contacting the MFC, the “one-window” principle applies, which means the possibility of contact with various government agencies related to receiving a variety of services without wasting time going through numerous offices.

Today, there are multifunctional centers in all regions of the country and in almost every municipality. MFCs have convenient schedules and operating modes, which is extremely important for recipients of various government services.

The right to receive maternity capital must be documented. That is why there is a certain minimum of documents that must be provided to a multifunctional center specialist.

Documents at the MFC must be presented in originals; the employees themselves make the necessary copies and scans during the reception process.

The list of papers that must be submitted to the multifunctional center to receive maternity capital includes:

It consists of several stages.

  1. Make an appointment. You can receive the necessary service at the MFC at any time, determined by the center’s work schedule, and without an appointment, however, there is a possibility of losing a lot of time in the live queue. Therefore, it is much more comfortable and faster to submit papers by choosing a time and date in advance. This can be done by calling the selected center. In addition, they can also register through the website of a specific MFC through their personal account. To register a personal account, you must have a confirmed entry on the State Services portal.
  2. Provision of documents. At the appointed time, the citizen must go to the MFC and apply at the specified window. The specialist will check the completeness of the documents, help you draw up an application and advise you on any issues related to this procedure. At the end of the reception, the center employee will issue a receipt for accepting documents, which will indicate the date the certificate is ready.
  3. Obtaining a certificate. If the completeness and authenticity of the submitted documents do not raise questions among Pension Fund employees, then the application is subject to approval, and the applicant is issued a certificate for maternal capital of the established form.

What documents are needed

Before visiting the MFC, you must collect a package of documents, which includes

  • Application for maternity capital (you can download it in advance, but it’s better to fill it out with an employee to avoid mistakes).
  • The original passport of a citizen of the Russian Federation from one of the parents (adoptive parents), the one who submits the application, and a copy of the second (can be done on the spot).
  • Original birth certificates of all children, and court decisions recognizing adoption.
  • A document that confirms Russian citizenship for the natural mother or adoptive mother, in most cases a passport.

The MFC specialist will accept and check the entire package of documents, you will receive an extract, by the number of which you can track the readiness of execution of the decision on maternity capital.

How to apply for maternity capital through the MFC?

For a long time, the pension fund was given one month to consider an application for a certificate. However, after they started paying benefits to low-income families from maternity capital, this period became prohibitively long. In this regard, the certificate must now be issued by the state pension fund 15 days in advance.

Please note that the countdown begins from the moment the fund receives the relevant application. Thus, the fastest way to obtain a certificate is by directly contacting the Pension Fund or submitting an application electronically through your personal account on the pension fund website.

When contacting the MFC, this period can be extended by another 2-3 days, since in this case the time for transferring documents to the Pension Fund and for delivering the paper form itself to the service center is not taken into account.

There are no fees or charges for obtaining a maternity capital certificate. This applies to both receiving a document directly through the Pension Fund and through multifunctional centers. In addition, there are no additional services for issuing a certificate earlier than the deadline established by law. In general, multifunctional centers do not require the public to pay for their services.

Citizens, among other things, can obtain a certificate for maternity capital by submitting an application to the multifunctional center. The list of documents and the procedure itself are practically no different from those when applying to the Pension Fund. However, it should be taken into account that obtaining maternity capital through the MFC takes more time. This service is not subject to duty and is completely free.

And this is very convenient for people who cannot take time off from work to submit documents. The Pension Fund can only accept applications on weekdays, and this is inconvenient for most citizens.

Important! The certificate received in hand, whether it is issued by the MFC or the Pension Fund of Russia, will be absolutely the same and will be considered the legal basis for a large family to receive maternity capital.

The MFC is still a fairly new structure in the country, but this does not prevent the organization from being the most convenient solution for citizens when processing a huge number of documents.
