Issuing an employment order is a mandatory procedure established by law.
The order is issued strictly according to the rules of the Labor Code, and violation of the algorithm may lead to negative consequences in the form of administrative sanctions.

Publication cases
Article 68 of the Labor Code clearly states that employment must be confirmed by an order, which is issued and signed by the employee and employer no later than 3 days from the moment the employee is allowed to work.
At the same time, the order must contain the details of the employment contract, which means that the general hiring algorithm[/anchor] begins with the signing of an agreement between the company administration and the employee.
It follows from the norm of Article 57 of the Labor Code that the employment contract must contain information about both the employer-organization and the employer-individual. From this we can conclude that the employment order is issued by all employers without exception:
- organizations;
- entrepreneurs;
- individuals (these are ordinary people, not representatives of companies or individual entrepreneurs).
An order is always issued when labor relations are seen in the relationship between two persons:
- the scope of work has been determined;
- the work is not one-time;
- Payment will be made regularly.
For example, an ordinary person hired another as an assistant. If the help consists of performing certain work, for example, work in a poultry house, regular payment will follow for the work (per month, per week), the assistant is already considered an employee, and the employer is considered an employer. To formalize the relationship, an agreement is signed and an order is issued.
As required by Article 68 of the Labor Code, a certified copy of the order must be given to the employee upon his written request.

- An order for appointment to a position is issued in relation to employees holding managerial positions and refers to documents on the main activities of the enterprise.
- The order on taking up a position largely repeats the standard order on hiring; it is distinguished, first of all, by its name - “Order on appointment to a position.”
- The document on the appointment of a manager may be signed by the manager himself.
- The basis for issuing the order is the employment contract, and in relation to the manager - also the decision of the founders.

Order function
Based on the analysis of labor legislation, the dates of start of work and dismissal are recorded in orders. The period between dates is included in the length of service. And length of service affects the payment of various benefits, including payment of sick leave and maternity leave, as well as the calculation of pensions.
That is, the task of the order is to determine and fix the start date of work in a specific company.
Features of the order for the employment of a minor
An employer has the right to hire minors subject to the following conditions:
- the nature of the work will not harm the health and mental development of the young citizen (the list of works where the work of minors is prohibited is determined by Article 265 of the Labor Code);
- there is consent of one of the parents;
- there is consent from the guardianship authority if the child is under 16 years of age.
Therefore, in addition to the documents previously specified for applying for a job, a minor citizen will have to provide:
- consent of the parent (as well as the guardianship authority for a person under 16 years of age);
- educational document or certificate of receipt;
- conclusion of a medical commission confirming the completed medical examination.
The rest of the registration procedure does not differ from the usual one. But the contract establishes a reduced working week, which is due to the characteristics of teenagers’ work, and this is also reflected in the order.
How to prepare a document?
Unified forms of personnel orders have not been in effect for a long time, so employment orders can be issued according to the rules adopted by the company. However, you can use the T-1 form developed by Goskomstat in 2004.

The order contains some conditions listed in the employment contract and there should be no differences.
Meanwhile, if the T-1 form is not used, the structure of the order must comply with the rules of office work and contain the necessary data.
Mandatory inclusions:
- name of the employer: company or full name of an individual;
- number and date of compilation (the registration number must correspond to the number of the journal for registering employment orders);
- start date of work (and end date if the contract is fixed-term);
- Full name of the employee (and department, if specified in the contract);
- his position, profession, rank, category;
- type of employment (temporary or permanent);
- salary amount (salary, bonus and allowances);
- probationary condition (or absence of probationary period);
- details of the employment contract;
- director visa;
- line for the employee to familiarize himself with the order.

Where and how much to store?
Employment orders must be kept in the employer's files for 75 years. When
the case with the orders is closed, it is transferred to storage in the company’s archives. If a company is reorganized (merged with another or divided), the archive comes under the jurisdiction of the legal successor.
When a company is liquidated, the entire archive is transferred to the jurisdiction of the city or district.

Instructions for filling and sample
There are several general provisions in accordance with which this paper is filled out.
- If the employment agreement is concluded for an indefinite period, then in the “date” line of this document the second column remains blank.
- In the form, if you study the conditions of admission to the workplace, and also take into account the nature of the upcoming position, you need to indicate one of the forms in accordance with which the work process will be organized. For example, you can select the items “part-time”, “regularly”, “permanently”, “in the form of transfer”.
- Tariff rates, salaries and allowances, as well as deductions and compensations are indicated in accordance with the staffing schedule. This aspect must also comply with the terms of remuneration that are specified in the employment contract.

The advantage of unified forms is their simplicity and fewer formalities compared to the text version, expressed in free form. Within the framework of unified forms, there is no need to create notes indicating that the employee agrees with the working conditions.
According to the provisions of this order, the employee is obligated to begin professional duties from the specified day. If the employee does not return to work within this period, the order is subject to cancellation.
This order is filled out as follows:
- The first line on the right indicates the form for filling out the paper and the date of its approval.
- Just below on the right there is information about some codes - OKPO, OKUD, which must be registered in accordance with the rules.
- The following lines indicate the name of the document and the essence of “Order (instruction) on...”. This paragraph takes up three lines.
- If we are talking about a group document, then the next line says “Hire”, and then a table is drawn up that contains information for each employee.
- The table has several columns. This is the full name of the newly hired employee, personnel number, structural unit in which he is hired, profession, wage rate, basis, duration of the contract, probationary period, personal signatures. It turns out that the total number of columns is about 10. The number of rows includes one line with the names of the columns, and then several columns depending on the number of employees hired.
