You have already passed the interview stage, and the head of the organization asked you to prepare documents for hiring, including a job application. This document does not have an approved form and can be written by hand on a standard A4 sheet. Roughly speaking, the writing of such a document is not regulated by any set of rules. In it, you contact the employer with a request for employment, indicating your full name, contact information and the position that was offered to you.

The need to conclude a fixed-term employment contract arises in various situations. For example, during the maternity leave of the main employee, the employer will receive a temporary replacement.

Fixed-term employment relationships can be ended either after a certain time or upon the occurrence of an event.

Labor legislation does not establish an employee’s obligation to draw up an application for employment on a fixed-term basis.

Due to the fact that the application is not a mandatory document, each organization may have its own form for its preparation. There is no unified model approved by legislative acts.

The application must reflect the most important points regarding the employment process. It is necessary to indicate the reason why the employment relationship is formalized for a certain period. For example, due to the seasonality of the work performed or during the absence of the main employee.

The document structure is identical in most cases. It consists of the following points:

  • name of the employing company;
  • position and initials of the manager in whose name the application is written;
  • applicant's initials;
  • full name;
  • main part. This includes a direct request for employment on an urgent basis;
  • desired date of the first working day;
  • the position the applicant wants to occupy;
  • date of writing;
  • signature of the citizen who issued the document.

Depending on the specifics of document management at the enterprise, the application may be prepared in a different way. To compile it, the organization’s letterhead is often used.

Once completed, the document is sent to the employer for review. After receiving a positive response from management, the paper is transferred to the human resources department, where the information contained in it is used in the future.

The manager in whose name the application was drawn up must put his resolution on it. It includes the employer's response, instructions for HR specialists, date and signature.

Do I need a job application?

You should be aware that such a statement is not the basis for enrolling an employee in the organization’s regular group. The basis for the emergence of official labor relations, according to the Labor Code of the Russian Federation, is an employment contract concluded between the employer and the employee.

However, in most organizations, HR employees insistently ask you to fill out this application, so that they can then keep it pointlessly in your personal file. This application is not included in the list of basic documents submitted when applying for a job.

Firstly, the application becomes valuable if the circumstances of your employment required approval from the manager or other official of the structural unit where you intend to get a job.

Secondly, the date of application, under certain predetermined circumstances, may ensure that you fill an interesting vacant position through competition.
A timely submitted and registered application, supported exclusively by the objective opinion of management, is the key to your success.

Features of hiring a temporary employee


It doesn’t matter that a candidate for a temporary position will stay at the company for only a short time - he must be formalized in accordance with all the rules of labor legislation.
And he, in turn, must submit the same package of documents as when entering permanent service.

A fixed-term employment contract is concluded in accordance with paragraph. 2 hours 1 tbsp. 59 of the Labor Code of the Russian Federation for the period of absence of the main specialist. Such an agreement ceases to be valid from the moment the absent employee returns to work, as specified in Part 3 of Art. 79 Labor Code of the Russian Federation.

If the absent employee is a financially responsible person, then an agreement on financial responsibility must be concluded with the new employee. Otherwise, the employer does not have the right to recover damages caused by the loss of material assets.

A probationary period is not provided for temporary employees if they come in their specialization or will be involved in the company for less than 2 months. At the same time, they are assigned the same benefits and rights as permanent specialists on staff.

Civil servants

In accordance with the law, recruitment can be carried out either in a general manner or on the basis of a competition. As part of the general procedure, employees are accepted into all organizations; upon hiring, an employment contract is concluded with them. On the basis of a competition, only civil servants are hired, who no longer enter into an agreement, but a service contract.

In addition to the general package of documents, a civil servant is required to fill out a questionnaire in accordance with Part 2 of Art. 26 No. 79-FZ, the contents of which are set out in the order of the Government of the Russian Federation dated May 26, 2005 No. 667-r. The form must be filled out by the civil servant personally by hand; it is not permissible to fill out such a form by computer.

How to properly arrange a transfer to remote work?

If there is a desire or need to transfer to remote work an employee with whom an agreement has already been concluded on a general basis, then you must adhere to the following algorithm:

  1. Receive a personal statement from the employee that he wants to change working conditions, indicate the date on which the transition will take place, register the document, and impose a resolution.
  2. Prepare an additional agreement to the employment contract from this date.
  3. Additional provisions agreements are discussed and signed with the employee. He is given his copy of the document. If the organization has a trade union or other collective body, then the changes are agreed upon with it.
  4. Issue an order to change working conditions.
  5. The employee is given a new instruction on health and safety, which is recorded in the instruction book.
  6. The employee is given safety instructions when using equipment to perform his or her job functions.
  7. If the position has not changed, there is no need to display the transition to remote work in the work book.
  8. When transferring any equipment to an employee to perform work functions, an individual liability agreement may be concluded with him. But you can limit yourself to the act of acceptance and transfer.
  9. If necessary, the employee is given signed instructions on the use of information security tools and the preservation of confidential information.
  10. Time sheets and schedules for employees continue to be filled out without changes.

How to write a job application

In the application, you address the head of the organization with a request to hire you.

Let's figure out exactly what data and information needs to be indicated in the application:

  1. The header of the document indicates the position of the immediate supervisor and the name of the organization in the appropriate (dative) case. If you know the full name of the employer, it would be useful to indicate them as well. Check the correct spelling of the organization name. Pay attention to abbreviations and quotation marks. You must know the correct name of the organization you want to become an employee of, otherwise an awkward and awkward situation may arise that could affect your career in this company.
  2. Next, you indicate your information - from whom the application is being submitted. Please disclose your full name, without abbreviations, again in the appropriate (genitive) case.
  3. The registration address must match the passport data. Be careful.
  4. The name of the document you are submitting is “Application”. Write this word without any punctuation marks.
  5. The text of the application must contain a request to enroll you from a certain date to a specific position with the name of the structural unit - department, workshop, etc.

For example:

“I ask you to hire me at Yasnaya Polyana OJSC as a specialist in the software department from June 29, 2015”

Be sure to indicate the date of writing and submitting the application, certify the document with your signature and its transcript (here it is enough to write down your last name and initials).

Note: adhere to the same style of document design. If the text is handwritten, fill it all with one paste. If you print on a computer, format the finished text to fit one type of font. The date format should not be ignored; if you start writing the month in numbers, then throughout the text do not use the names of the months in the dates you enter.

How to prepare documents for transfer to remote work?

The document flow associated with remote work has its own nuances. They must be taken into account when preparing the translation.

How is an employee’s application for transfer to remote work completed?

The application is written in person and addressed to the head of the organization. Below is a sample wording that you can use:

“I ask you to allow me to perform my job duties (employment contract No. 18 dated September 14, 2009) remotely outside the location of Parus LLC with interaction through public information and communication networks from May 21, 2021.”

The following is indicated - permanently or for a limited period of time.

What changes need to be made to the employment contract?

An additional agreement is concluded to the current employment contract.

The place of conclusion of the document will be the address of the company, but it is indicated that further labor functions will be performed without presence on the territory of the employer. It is not specified where the employee will work. There is no need to write, for example, the employee’s home address as the place of performance of work functions. It is important to clarify that the obligation to be present at a stationary workplace on the employer’s premises is completely lifted or partially (for example, appearing 2 times a month on Fridays).

The work schedule can be left as it was. If remote workers and their employer live in different time zones, then it is specified what time the start and end of the working day are indicated at.

The additional agreement notes that the employer now bears responsibility for the labor protection of a remote employee only in terms of paragraphs 17, 20 and 21 of Part 2 of Art. 212 Labor Code of the Russian Federation.

The most important thing is to describe in detail the methods of interaction:

  • Types of communication (with numbers and addresses).
  • The method of issuing a task and obtaining work results.
  • Contact time.
  • Response times.
  • Forms of participation in team work (for example, a conference on Skype or a chat in the messenger).

Important!

If an employer insists on using any paid program for communication or work, then he pays for it. There are judicial precedents for decisions in favor of workers. Otherwise, paragraph 3 of Article 312 of the Labor Code of the Russian Federation refers to the provision of material and technical means to the sphere of voluntary agreements between the employee and the employer.

The additional agreement on the transition to remote work must indicate how documents on the organization of work will be exchanged (applications, orders, sick leave, notifications). The law allows you to do this both electronically and by Russian Post in paper form. Including starting from 2021, you can keep a work record book electronically.

How to issue an order to transfer to remote work?

There is no single form of order. But since Rostrud in its explanations refers specifically to the additional agreement to the TD, we can recommend the following wording as an example:

“... on the basis of a personal application and agreement reached (additional agreement No. 1 of March 12, 2021 to employment contract No. 158 of September 16, 2021) transfer to remote work permanently from March 12, 2021” (or indicate a period).

Required documents for employment

So, the job application has been completed. What else is included in the standard package of documents for employment:

  1. Passport or other document proving your identity.
  2. It is obligatory to provide a work record book. The exception is primary employment or part-time employment. In the case of initial employment, the employer usually issues a work book independently.
  3. Insurance Certificate of State Pension Personal Insurance. If you are applying for a job for the first time, it is advisable to inform the HR department that you do not have this document. The employer will handle the registration of SNILS on his own.
  4. Document on military registration. Such a document must be provided to the organization by persons subject to conscription into the army or persons liable for military service.
  5. Diplomas and certificates. Personal education documents will help the employer determine your level of training and select a suitable position.

If you want to apply for a specific position, please provide the employer with documents confirming that you have the appropriate level of qualifications.

Is it necessary to register if the employee is employed temporarily?

In fact, the employment order is drawn up on the basis of an employment agreement. Therefore, the application is only of an auxiliary nature and is written only if the employer, for some reason, needs to receive a written document stating the request of a person confirming his personal desire to find a job in this organization.

The application usually serves as a convenient tool for collecting the necessary visa approvals.

The Labor Code does not require writing an application for a job, so the requirement to write can only be justified by internal reasons in a particular organization.

Fixed-term employment relationships are concluded in the following cases:

  • when a specific amount of work or service is required (in this case it is also possible to conclude a civil contract);
  • for seasonal work;
  • to replace an employee who constantly works in an organization, but for some reason temporarily does not perform labor functions, a typical example of this process is when a permanent employee goes on maternity leave and child care; this period of absence is long, and therefore the person in on maternity leave, they are looking for a replacement with the conclusion of a fixed-term employment contract.
