Retirement due to harmfulness under the new law

In connection with the pension reform in Russia from 2021, no changes will be made to the conditions for applying for an early retirement pension in 2021. According to the new law No. 350-FZ of October 3, 2018, all requirements for special length of service, general insurance experience, as well as retirement age standards for the provided preferential lists will remain the same.

Thus, in order to apply for an early old-age pension under the new law in 2021 in connection with work in difficult and hazardous working conditions (the so-called preferential pension for hazardous work), several conditions must be met:

  • 1. Reach the retirement age established for a specific category of professions.
  • 2. Work the required number of years in hazardous production - i.e. have the required quantity:
  • • special work experience in harmful (difficult) working conditions;
  • • general insurance experience.
  • 3. Have the required number of generated pension coefficients (IPC).

According to the law, the following industries are considered potentially unreliable:

  • Metallurgical (non-ferrous and ferrous metal).
  • Metalworking.
  • Mining (including ore preparation, agglomeration, roasting and beneficiation).
  • Chemical enterprises of various directions.
  • Manufacturing of silica products.
  • Production of generator gas, explosives and ammunition.
  • Coke and chemical production plant producing thermoanthracite components.
  • Electrical engineering, including servicing of electrical installations.
  • Refining and production of petroleum products.
  • Factories focused on the production of glass and porcelain products, building materials.
  • Pharmaceutical companies producing biological materials and medicines.
  • Pulp and paper workshops.
  • Health care institutions.
  • Energy and nuclear.
  • Transport and technical units.
  • Printing enterprises.
  • Electric and gas welders performing welding in enclosed spaces.
  • Divers.
  • Employees of production workshops engaged in sandblasting work.
  • People involved in the food industry.
  • Workers of mercury substations, energy trains, thermal power plants.
  • Organizations of the agrochemical and construction complex.
  • Providing film copying and communications services.
  • Teachers who work in the field of training for chemical plants.

The list of harmful and dangerous production professions includes even those specialists whose activities are related to the performance of official and administrative duties in potentially “heavy” enterprises.

In addition, current legislation strictly regulates the possibility of employing female labor and the admission of persons under 18 years of age.

How many years do you need to work in hazardous work?

For Russians working in hot shops, in hazardous, difficult working conditions, in underground work, including for citizens of certain professions (the so-called “small lists”), an old-age pension is assigned early - i.e. before reaching the generally established retirement age. This possibility is provided for in Part 1 of Art. 30 of Law No. 400-FZ “On Insurance Pensions”. However, in order to become a pensioner early, it is necessary to have the duration of harmful work experience prescribed by law - time spent working according to the lists of hazardous professions established by Decree of the Government of the Russian Federation No. 665 of July 16, 2014.

Let's consider the features that are encountered when calculating a preferential pension based on special conditions of work that have not reached the agreed length of service. “Harmful” work experience, which has reached the limit of more than 50% of the allotted time, for employees of the second list gives the right to a year of benefits for 2.5 hours worked in harmful conditions. This is the norm for men. For women, there is a recalculation “in two years” according to the specialty they have worked out.

Pension benefits are calculated on a general basis. Insurance deductions are taken as the basis, and the following cases provided for by law are also taken into account:

  • incurable disease;
  • disability for various reasons;
  • chronic disease.

Important! Pension Fund employees make calculations based on time based on total length of service and length of service based on harmfulness. Then the length of service is reduced taking into account a number of points that accompany the work activity of any employee.

Exemption from labor is not taken into account for the following reasons:

  • vacations;
  • days of temporary disability;
  • maternity leave;
  • periods of downtime of the organization;
  • periods of training to improve qualifications;
  • business trips;
  • maternity leave.

Thus, there are quite a lot of nuances in calculating the time when a specialist from list 1 or 2 becomes eligible for early retirement. Given the new regulations, it is wise to entrust the calculations to specialists.

If the harmful experience indicated in the table was not completed in full, then you can count on a reduction in the generally established retirement age in proportion to the accumulated special experience.

It should also be noted that from January 1, 2013, the period of work in hazardous (heavy) production is included in the special length of service only if the employer pays additional insurance contributions to the Pension Fund at a special rate. Its value is determined depending on the results of a special assessment of working conditions, which the employer is obliged to conduct.

If a citizen was unable to accumulate the required amount of work experience in hazardous or difficult work, then in accordance with paragraph 1 and paragraph 2 of Part 1 of Art. 30 of Law No. 400-FZ, he has the right to reduce the general retirement age - i.e. reduction relative to 55 and 60 years for women and men (despite the general increase in the retirement age from 2021, this condition for workers in hazardous industries will not change).

Reducing the retirement age with incomplete harmful service is possible only if two conditions are met:

  • • having at least half of the established special experience (see table above);
  • • availability in full of the required amount of general insurance experience and IPC.

In this case, the retirement age is reduced proportionally according to the following rule: the standard is reduced by 1 year:

  • • when working according to List 1 - for every 1 full year of work for women and men;
  • • when working according to List 2 hazardous professions - for each:
  • • 2.5 years of hazardous work for men;
  • • 2 years of special experience - for women.

Additional contributions to the Pension Fund for hazardous working conditions

Starting from January 1, 2013, time spent working in harmful, dangerous or difficult production is counted towards special length of service, which allows for early retirement only if the employer accrues and pays additional insurance contributions to the Pension Fund of the Russian Federation. The tariff for these additional contributions is established by Art. 428 of the Tax Code of the Russian Federation, depending on the class of working conditions, which are determined as a result of a special assessment of working conditions in the workplace.

Until December 31, 2021, the rate of additional insurance premiums can be determined based on the results of certification of workplaces, if a special assessment of working conditions has not yet been carried out (Part 8, Article 35 of Law No. 400-FZ). Starting from 2021, a differentiated additional tariff will be introduced only for professions that have undergone a special assessment.

How to apply for a pension for harm

To apply for a pension for harm, you need to collect the necessary documents and send them to the Pension Fund in any of the available ways.

If a pensioner is dissatisfied with the decisions made regarding the size of the pension, insurance points and recorded length of service, then he can file a claim with the court to review the case.

List of documents

To receive a pension for harmful activities, you will need to collect the necessary package of papers. It includes the following documents for registration:

  • military personnel need a military ID;
  • the applicant’s passport (copies of pages containing any information);
  • income certificate;
  • work book, which must indicate that the citizen works in dangerous conditions.

If the transferred work book does not indicate the full period of work in hazardous production, then the citizen can send a request to the place of work to obtain certificates from the archives about the fact of acceptance and dismissal. Employers are required to retain such documentation for the entire duration of the enterprise.

Since 2003, the entire length of service began to be taken into account by the pension fund. If any information is missing, then you must contact the Pension Fund with documentary evidence of actual work experience.

The received data is verified within 3 months. The result is a notification of acceptance of information or refusal to take into account the length of service.

Registration procedure

When the above list of documents has been collected, you must contact the Pension Fund. You can transfer papers in several ways:

  1. Send by mail (only with a list of attachments). If you do not make an inventory, the documentation will not be allowed for consideration.
  2. Complete the registration procedure on the Pension Fund website. The citizen will need to make scans of all documents and upload them to his profile.
  3. Visit the Multifunctional Center. You need to take a coupon and give the documents to a specialist.
  4. Contact the Pension Fund office in person. This method is considered the best, since the institution’s employees will immediately tell the citizen what documents he needs to convey.

Reference! If it turns out that the applicant has not attached any documents, then he has three days to submit the missing papers. Pension Fund employees are given 10 days to consider the submitted application.

List of 1 preferential professions for early retirement

List 1 of professions that give the right to early retirement includes positions related to underground work, hot shops, and hazardous working conditions. To determine the right to a preferential pension, a list of works and positions approved by legislative acts is used:

  • • for periods of work before 01/01/1992, the list approved by Resolution of the USSR Council of Ministers No. 1173 of 08/22/1956 is applied;
  • • for work after 01/01/1992, the list provided by Decree No. 10 of 01/26/1991 is used.

Experience in such types of work after 01/01/2013 is counted as preferential (special) if the employer makes additional insurance contributions to the Pension Fund in accordance with the results of a special assessment of working conditions (in accordance with Part 6 of Article 30 of Law No. 400-FZ).

A complete list of all envisaged industries, positions, works falling under list No. 1 of hazardous professions can be found in the list approved by Resolution No. 10 of January 26, 1991. The right to a preferential pension is granted provided that the entry in the work book corresponds to the name of the position in the prescribed list.

Signs of “harmfulness”: the employee is regularly sick, his immune system is weakened, and there are disruptions in the reproductive, cardiovascular, nervous and other vital systems of the body. Most diseases are directly related to the characteristics of performing specific tasks within the work process - high dust emissions, cold or heat, high humidity, exposure to chemical reagents, radiation, etc.

In order for the surrounding operating conditions to be recognized as difficult, a special commission of members of authorized government agencies must issue a corresponding resolution. The audit identifies all factors of the negative impact of production processes on human life, assesses the risks, on the basis of which it draws conclusions about the level of potential threats at the enterprise. Then a list of harmful and dangerous professions is created for a specific organization. Based on the latter, employees included in the list are provided with state benefits.

If the procedure is not fully followed, state support for such a company is not provided. However, no one limits the employer’s right to individual payments or other types of compensation (health improvement in sanatoriums, etc.) within the framework of the current legislation.

Social pension for small nationalities

For citizens who belong to small nationalities, not exceeding 50,000 people in number, who have not had time to complete the required length of service, advance pension provision is expected. Such people are vested with the powers enshrined in Federal Law No. 166, 11th Art. But there are conditions on the basis of which a citizen can count on receiving the due payments, regardless of whether they are included in the list of preferential professions No. 1 and No. 2. It is necessary to document membership of these nationalities and confirm the fact of residence in certain territories.

The fact that a person belongs to a certain nation must strictly have official confirmation. To do this, you must provide a certificate from the indigenous people, as well as a photocopy of your passport and birth certificate.
