A certificate of absence or availability of real estate is an extract from the Unified State Register of Real Estate, EGRN. Previously, this register was called the Unified State Register, so in some sources you can find a different name for the document: “certificate from the Unified State Register on the absence (presence) of real estate ownership.”
The certificate indicates whether you own real estate. Information about this is taken from the regional register, if information about a specific city (town, village, region) is needed, or from the all-Russian register, when information is needed within the Russian Federation.
What is a certificate of ownership
Real estate transactions that involve the transfer of rights from one person to another are subject to mandatory state registration. Information about the transfer of ownership and the current owner of the property is contained in the Unified State Register of Real Estate. This is necessary for many purposes: control and accounting of citizens’ real estate, resolving issues about the legality of transactions, certification of property rights, and so on.
A certificate of ownership of real estate is an extract from the Unified State Register of Real Estate on the rights of an individual to the real estate he or she owns. This is a document containing information about the presence/absence of real estate owned by a citizen.
The provision of extracts to citizens is regulated by Federal Law FZ-218 of July 13, 2015. Data is provided by Rosreestr (Federal Service for State Registration, Cadastre and Cartography) at the citizen’s own request.
What is included in the certificate and what does it look like?
If information about real estate is found in the registry, then ownership is registered with you. In this case, the certificate will look like an extract from the Unified State Register: the applicant’s data and information about the property will be indicated there. This is what it looks like:
If there is no real estate, then they will write in the certificate: “there is no information in the register” or simply put a dash in it. This will be a certificate confirming the absence of real estate ownership.
A certificate of absence and an extract from the Unified State Register of Real Estate are very similar to each other. Actually, this is logical, because we are talking about the same registry and the subject of the request is also the same. The main difference will only be in the information that is indicated there. Thus, the EGRN extract will indicate the form of ownership, type of real estate, information about encumbrances if there are any and a note about their absence if there are none. But the certificate will only indicate the applicant’s full name and a note indicating whether he has something or not.
What is a certificate?
Although a certificate is often supposed to prove that the applicant does not have property, it would be more correct to call this paper a certificate of ownership. If a person does have some real estate, it will be displayed in the contents of the document.
If a certificate or extract indicates specific owners of the property in question, then the certificate shows records of persons who own various forms of property or do not have it at all.
Previously, it was necessary to personally visit government agencies and submit a request in person. The service is now available remotely. Only the person himself has the right to apply for his certificate of absence of property, or to send his attorney, for whom a notarized power of attorney was previously issued.
A certificate of property is issued with the signature and seal of the organization certified, and the form is assigned a number and the date of preparation is recorded.
The contents of the document include information about the person in question, the address and name of the objects, their cadastral numbers and possible registration prohibitions.
Why might a certificate be needed?
This document may be needed in the following cases:
- When you are on the waiting list to get an apartment.
- When applying for a housing certificate.
- During the privatization of the apartment.
- To obtain a housing subsidy or mortgage with government support.
- In legal disputes over debts, if the case has already been transferred to the FSSP.

- Personal data of the citizen (full name, passport details, date of birth, place of residence and place of stay).

- cadastral number;
- purpose of the object;
- types of permitted use of the facility (applies to land plots);

- information about state registration (date, grounds, etc.).

Attention! A certificate of the presence or absence of real estate ownership and a regular extract from the Unified State Register of Real Estate (an extract on the main characteristics of the property or an extract on the transfer of rights to the property) are different documents!
A certificate of the presence/absence of real estate ownership is requested based on the citizen’s personal data and can only be requested by the citizen himself. Extracts about the main characteristics of a real estate property can also be requested by other persons (for example, before filing a lawsuit against a rights violator); they are also requested for a specific property (house, apartment, plot, etc.). Extracts on the transfer of rights to a property can also be requested not only by the owner.
Where can I get a certificate of absence of real estate?
Only two organizations issue such documents: the MFC at the place of registration of the applicant’s place of residence and Rosreestr.
To obtain a certificate through the MFC, you need to apply for.
The document can be issued in electronic or paper form. If you need it to apply for assistance from the state, a mortgage, to queue for an apartment, to go to court or to bailiffs, then apply for a paper version. If only for obtaining information, then electronic is also suitable.
Why is the electronic version not suitable for submission to the court or other department? Because there will be no wet stamp or signature of the registrar on it.

A certificate from Rosreestr on the presence or absence of real estate can be obtained either electronically, with an electronic digital signature (EDS), or in paper form, certified by the official seal. - for one region in paper form 650 rubles, in electronic form 400;
- for 2-28 regions – paper 1250, electronic 500;

You can receive a ready-made certificate from the BTI about the presence or absence of real estate in your property either by personal appearance, hand-to-hand, or by mail, having notified the employee responsible for receiving documents in advance. Cost and timing of certificate issuance
Obtaining a certificate of real estate availability is subject to a state fee. The amount of the amount differs depending on the number of regions for which the housing availability check is carried out.
If the document is requested for the region of the citizen’s current residence, its cost will be 650 rubles. Obtaining information from the federal database costs 1,800 rubles. When a range of specific regions is determined and their number is more than one, the duty is 1250 rubles.
The deadline for issuing paper depends on the request parameters. If it is necessary to use the federal database (all of Russia), then the period of data analysis can increase to 30 days. In other cases, the certificate is issued within one week.
Its effect applies to those real estate objects that are indicated in it. When new data appears, it loses its legal force.
