What is a BTI certificate?

A BTI certificate is an official document issued at the request of the owner of a property or other interested party. The content of the certificates will depend on the purpose and subject of the request - from the inventory value of the object to a copy of the floor plan of the building.

Initially, BTI bodies were created to carry out inventory and accounting of capital construction projects. At different periods of time, the powers of BTI institutions included the following functions:

  • primary and subsequent inventory of objects, with determination of inventory value;
  • registration and issuance of technical documentation for real estate (technical passport, floor plan of the building, etc.);
  • registration of ownership of real estate;
  • maintaining an archive of technical documentation for surveyed and recorded objects.

These powers were gradually limited, and with the introduction of the cadastral registration system, BTI institutions generally lost most of their previous functions. The preparation of technical and boundary documentation for real estate is carried out by cadastral engineers, who use BTI information on previously surveyed objects.

To carry out work on objects (redevelopment, reconstruction, reconstruction, etc.) it is necessary to prepare a project. When preparing project documentation, the entire volume of information on the facility is used, including data from technical inventories and assessments. According to the rules of Federal Law No. 218-FZ, all information about the characteristics of a real estate property is reflected in technical terms, and then transferred to the state register of the Unified State Register of Real Estate. However, in the Housing Code of the Russian Federation. when defining the concepts of redevelopment and reconstruction, reference is still given to the technical passport, which was previously produced by the BTI bodies. The validity period of such passports was 5 years, i.e. in 2021, all such documents have lost their validity. Therefore, even if there is a valid Art. 25 of the Housing Code of the Russian Federation, changes based on the results of redevelopment will be recorded in technical terms, however, information from BTI passports can be used for the work of a cadastral engineer.

  • decide on the BTI institution to which the request will be submitted - the BTI information is not included in the unified federal database, therefore, to receive information on objects from other regions, you need to send a request there in writing by mail or contact through the local BTI department (naturally, you need to take into account the deadline to receive written correspondence when requesting certificates from another region);
  • fill out the form requesting a certificate - this form will be provided at the BTI institution at the place of application;
  • pay the cost of producing the certificate in accordance with the approved tariffs;
  • the certificate will be issued within the period specified when receiving the request, or sent by mail.

You can receive a certificate not only in person, but also through a representative. To do this, issue a power of attorney through a notary office and indicate as part of the authority the possibility of obtaining any certificates from the BTI.

Why is this certificate needed?

It is required when performing many operations, these include:

  • acquisition or sale;
  • exchange;
  • donation;
  • inheritance;
  • housing redevelopment;
  • transition of non-residential premises to residential premises.

Types of certificates

Most often, the BTI prepares a certificate - a housing plan with a detailed description of the parameters and characteristics of the premises.

We often receive requests for real estate valuations. An appraisal certificate is required when selling an apartment, opening an inheritance, or registering a house as a gift. The cost of such an assessment does not correspond to the market price since it is established only on the basis of the area of ​​the housing, without taking into account the location of the property, as well as the repairs made.

Good to know! For transactions involving the assignment of rights, an act confirming the address of the property is required. The mandatory nature of such paper is based on the fact that streets are often subject to renaming, and this can lead to confusion.

An alternative to the BTI certificate is an extract from the Unified State Register of Real Estate

With the introduction of the cadastral registration system, all information about real estate is recorded in a single federal database - the Unified State Register of Real Estate. It is the USRN extract that is the only proper title document. Cadastral registration information is taken from technical and boundary plans prepared by a cadastral engineer.

If the object has undergone the cadastral registration procedure, information about it is included in the Unified State Register of Real Estate. This means that current and reliable data on the object of interest can be obtained not through the BTI authorities, but by requesting an extract from the Unified State Register of Real Estate. You can do this in the following ways:

Registration procedure

To register you need:

  1. Fill out an application.
  2. Attach a certain package of documents.
  3. Pay the state fee.

A specialist from a government agency will issue a certificate indicating the date when you need to come.

List of documents

The list of documents for registration of an extract is small. You only need to provide your passport and application.

If an extract is required by a representative of an organization, then the state fee will be higher, and the company’s statutory documents must be provided.

Statement

The application indicates for which property the extract must be obtained, and, specifically, the address at which it is located.

The application is submitted in a specially established form.

How legal is a BTI certificate in 2021?

In most cases, BTI certificates in 2018-1019 will be of an informational nature and cannot indicate the presence or absence of rights to real estate. Information from inventory files has legal force only when determining the value of an object for inheritance purposes; in other cases it is of an auxiliary nature.

Here are examples when obtaining certificates from the BTI will be important for legal relations:

  • if the courts are considering disputes about the rights to real estate registered before 01/01/2000;
  • if the enterprise conducts a technical inventory of objects for its own purposes;
  • if it is necessary to prepare design documentation to change the characteristics of an object that has not undergone cadastral registration.

Technically, there is no need to update your old apartment passport. This document has no legal force. If you need to obtain up-to-date and reliable information about the characteristics of your property, you need to contact a cadastral engineer.

Technical plan

To register a property, you need to have a technical one. This document includes important information and characteristics of the premises.

The plan consists of a graphic and text part and is issued in full:

  • the graphic part contains an image of the object and on which floor it is located;
  • the text part contains information about commissioning, and also provides information about data from the project documentation.

The form of the technical plan itself, as well as the requirements for its preparation, are contained in order of the Ministry of Economic Development of the Russian Federation number 693 dated November 23, 2011.

Technical certificate

- This is a very important document for the property. Without it, it is impossible to carry out any transaction with the premises.

The bureau specialist records the following data in the technical passport:

  • cadastral and inventory number;
  • when the building was built;
  • wear percentage;

This document contains information about whether the applicant has or had residential premises. The personal information of the owner is also entered.

How to get an up-to-date floor plan

Floor plans are used in project preparation and approval of redevelopment. Upon request to the BTI, you will receive a floor plan at the time of the last technical inventory (most likely, this period will exceed 10 years). In order to have an up-to-date floor plan in hand, it is necessary to carry out cadastral work if the object has not previously been registered with the cadastral register.

The production of an up-to-date floor plan is carried out by a cadastral engineer. To do this, measurements are taken in kind, and current USRN information on the object being surveyed or on neighboring objects is also used. If there is no information about the building in the Unified State Register of Real Estate, the cadastral engineer can use the technical documentation of the BTI, including the floor plan. All measurement results are recorded in text and graphic form of a technical plan.

Expert commentary . The current floor plan drawn up by a cadastral engineer may differ significantly from a similar BTI document. The fact is that the engineer uses high-precision inspection methods, while BTI institutions had measuring instruments and techniques with significant errors. Information about the characteristics of a building or premises, prepared as a result of cadastral work, is accompanied by a note from the engineer about the measuring instruments used and the permissible error.

Receiving data

The applicant sometimes needs to obtain a lot of information. You definitely need to know how to get it from the BTI register books and technical passports of objects. First of all, in order to order certificates of real estate in the unified Rosregister, you must visit the regional office of the BTI nearest MFC and write an application, which must indicate the purpose of obtaining the information.

A unified form has been developed for the application. It contains the following information:

  • Personal Information;
  • Series, number, when and by whom the civil passport was issued;
  • Name and legal address of the property;
  • Type of requested data;
  • Date of;
  • Signature.

When submitting an application, the BTI employee must present a civil passport as a document confirming the identity of the applicant. Certificates and extracts from the BTI can be provided to the following categories of citizens if they have documents confirming their status:
