- Gross defects in the pressing of the laminating film, its peeling and breakthroughs;
- Lagging endpapers from the block along the entire gluing strip or partially, endpapers tearing along the fold;
- Mechanical damage: torn and/or dirty pages, cover, binding cover;
- Contamination of the edged surface of a book block with an area of more than 1 cm² on the top, bottom and/or side surfaces;
- Mechanical tears of the cover at the fold corners of more than 3 mm;
- Scratches leading to damage to the integrity of the varnish coating / laminating film of the cover (if there is no damage to the integrity of the varnish coating / laminating film, the book is not considered defective);
- Jammed cover corners with a fold line of more than 1 cm;
- Incompleteness of complex product items (missing CDs, maps, posters, etc.);
- Violation of the geometry of the book block due to contact with water (swelling);
- Missing, torn/crumpled dust jacket;
- Unevenly adjacent pages, their folds near the spine, bent corners of the pages.
What to do if the receipt has not been saved?
A cash receipt or sales receipt for a purchased printed publication is one of the necessary things to carry out the procedure for returning or exchanging a book. However, the absence of a receipt is not grounds for refusing a refund .
In your complaint to the seller, you must fully describe the circumstances of the purchase, indicate any defects identified, and note that the receipt was lost.
In this case, the store does not have the right to refuse to return the printed publication. If necessary, the buyer can bring witnesses to confirm the fact of acquisition.
How to defend your rights in court?
Cases of returning books of inadequate quality are rarely encountered in judicial practice , since usually the price of the goods is small and is not worth the time and effort expended.
However, if the price of a printed publication is high or the parties, as they say, follow the principle, the case can be resolved in court.
In this case, you must go through all the pre-trial steps :
- contacting the store with a complaint;
- passing an independent examination with a positive decision;
- receiving a refusal to satisfy a claim.
After the final refusal, the buyer can apply to the judicial authorities with a claim against the store management, the basis of which will be a violation of the “Consumer Rights Protection Law” by the seller.
The statement of claim must be accompanied by an independent expert opinion obtained earlier.
Textbooks and other printed publications belong to the category of goods, the return or exchange of which is limited and is possible only if there are defects .
