The procedure for filling out an application form for changing a passport after marriage

The procedure for filling out an application form for changing a passport after marriage

Every citizen is guaranteed by law the right to change personal data (name, surname or patronymic). This can be done either of your own free will or after marriage.

After changing personal data, the passport of a citizen of the Russian Federation and some other documents (birth certificate, driver's license, international passport, etc.) must be replaced. If a citizen does not replace his passport within the established time frame, he will face penalties.

Each girl can decide independently whether or not to change her last name after marriage. It's her right, but not her responsibility.

.
At the time of marriage, the woman's will is recorded in writing
. But a woman has the right to decide to change her last name even after the wedding (even after a few years).

To change or not to change?

Whether or not to change a surname upon marriage is a personal matter for each girl.

When getting married, a young wife can choose one of three options:

If you want to find out how to solve your particular problem in 2021, please contact us through the online consultant form or call :

  • Moscow .
  • Saint Petersburg .
  1. Take your husband's last name;
  2. Take a double surname;
  3. Keep the last name given to her at birth (maiden name).

When registering a marriage, the corresponding expression of will is recorded in documents. The most common is the first scenario. Meanwhile, the wife may decide to change her last name a few days or even years after the wedding. This period is not regulated in any way by law.

What you need to know

Article 32 of the Family Code of the Russian Federation allows you to take your spouse’s surname after marriage.

After registering a marriage at the registry office, newlyweds have the right to:

  • changing your surname to the surname of your husband or wife;
  • the possibility of adding your last name to your husband’s last name (this is prohibited if the husband already has a double last name);
  • leaving your last name unchanged.

The first two cases imply a mandatory replacement of the passport. In this case, the procedure for obtaining a new passport is no different from the usual one.

To replace an identity card, a citizen must contact a department of the Ministry of Internal Affairs or the MFC with all the necessary documents. In addition to the list of required papers, you will also need to submit a completed application form. This is one of the main documents on the basis of which a passport is replaced

. It should indicate all the citizen’s personal data.

Passport replacement is not free. The state duty in 2021 is 300 rubles

. Without a receipt for payment, government service employees will not even accept the application for consideration.

After changing their last name, a citizen must apply for a new passport within 1 month. The old document becomes invalid immediately after receiving the certificate of change of surname

. A citizen can use it for 30 days with impunity.

After this period, he will be subject to a fine in the amount of:

From 3 to 5 thousand rublesIf a person lives in a city of federal significance (Moscow or St. Petersburg).
From 2 to 3 thousandFor all other citizens of the Russian Federation.

The amount of the fine does not depend on the number of days of delay. For a passport expired by more than 1 year, another fine of 3 thousand rubles or more may be issued.

○ Features of replacing a passport in connection with marriage.

Every citizen of the Russian Federation is required to have a passport as an identity document and change it in cases provided for by law. Among the grounds for replacement is a change of surname after marriage registration.

At the time of marriage, spouses, at their own discretion, choose the surname of one of them as a common surname, or each spouse retains their premarital surname, or, unless otherwise provided by the laws of the constituent entities of the Russian Federation, adds the surname of the other spouse to their surname. (Clause 1 of Article 32 of the Family Code of the Russian Federation).

Based on this law, changing a surname is not the responsibility of a citizen, but his right. But if he still decides to change his personal data, then he will have to update all personal documents, including his passport.

Procedure

To change your surname, you initially need to do several steps: pay a state fee in the amount established by law and contact the registry office with a corresponding application. The last document is drawn up according to form No. 15.

The following documents should be attached to it:

  • passport;
  • certificate of marriage;
  • a document confirming that the state duty has been paid.

If one of the spouses has expressed a desire to change his last name to another, this does not oblige the second spouse to do the same.

If a citizen does not have the opportunity or desire to visit an institution such as a registry office, then he can send documents to the MFC. In this case, the time frame for consideration of the case does not change.

Review of documents takes place within 1 month. If employees of a government agency encounter any difficulties, this period can be extended by another 30 days.

If during this time the wife changes her mind about changing her last name, then she can cancel her decision by sending a corresponding application to the registry office.

After receiving a certificate of change of surname, the spouse is required to change a number of other documents.

Among them:

  • international passport;
  • driver's license;
  • health insurance;
  • SNILS, etc.

No need to change:

  • TIN;
  • educational documents;
  • work book;
  • ownership documents.

You can submit documents to change your last name to such institutions as: MFC, Civil Registry Office, as well as online through the State Services portal.

Article 32. The right of spouses to choose a surname

The procedure for obtaining a passport with a new surname also involves providing a certain package of documents and filling out a special application form. An application form for changing a passport after marriage can be downloaded on the website of the FMS or the Ministry of Internal Affairs or obtained by personally contacting one of these institutions.

Article 59. Changing the child’s first and last name

If a woman has a signed employment contract, then she must inform her employer about the change of surname. This procedure includes writing an application to the HR department

.
This application is made in free form
. It can be either written by hand or printed on a computer.

  • the name of the institution where she works;
  • your position and last name, first name, patronymic;
  • in the middle you should write the word “Statement”;

Required documents

To obtain a new passport after marriage, you must submit the following documents:

  • application (special form 1P is used);
  • an old passport with a note from the registry office about marriage registration;
  • receipt of payment of state duty;
  • marriage certificate;
  • 2 photographs of adequate quality (size 35x45 millimeters).

Photos should be taken in such a way as not to cover the oval of the face. Headgear is not allowed

.
The only exceptions are those hats that are worn due to religious prejudices. In this case, it is important that the citizen's face is clearly visible
. If a person wears glasses in life, then he should also be wearing glasses in the photo.

If this is required, an employee of the government agency to which the documents are being submitted may ask for additional papers. This could be a child’s birth certificate (if the citizen has children), a military serviceman’s ticket (if available), a registration document (for putting a mark in the passport).

One of the most important documents when changing your passport is the application. Particular attention should be paid to filling it out, since any errors will lead to the fact that the issuance of a new passport will be refused.

Sample receipt for payment of state duty for issuing a passport

○ Temporary identity document.

Before issuing a new passport, a citizen, at his request, is issued a temporary identity card by the territorial body of the Ministry of Internal Affairs of the Russian Federation, the form of which is established by the Ministry of Internal Affairs of the Russian Federation. (Clause 17 of the Decree of the Government of the Russian Federation of 07/08/1997 No. 828 “On approval of the Regulations on the passport of a citizen of the Russian Federation”).

While your passport is being prepared, you can apply for a temporary identity card (TIC). This document is not mandatory and is issued only at the request of the citizen. Its validity period depends on the time required to issue a permanent passport: 10 days if the replacement is made at the place of residence and a month if at the place of stay.

The document indicates information about the citizen, the basis for issuing the VUL and its validity period. To obtain one, you need to submit an application to the authority that changes your passport along with a 35x45 mm photograph.

Passport replacement is carried out on the basis of the package of documents provided by the woman:

  • Marriage certificates (or certificates of name change);
  • A valid passport with a marriage stamp;
  • Receipts for payment of the state fee and photographs for the new document.

Sample application to change surname after marriage

.
The person himself decides to take a different surname
. This opportunity is provided by law - Article 58 of Federal Law No. 143 “On Acts of Civil Status”, as well as by the norms of the Insurance Code and the Civil Code of the Russian Federation.

The laws of our state allow anyone to change their last name. Adult citizens act independently

For children, this process is carried out by parents, adoptive parents and trustees. The most common situation is marriage, when the wife takes her husband's surname after the wedding
. However, there are other circumstances that become the basis for such a decision.

An adult citizen can decide to change his surname on his own due to its dissonance, difficulty of pronunciation, for religious reasons and for many other reasons. In any case, updating of personal data is subject to the relevant rules provided by law.
