Registration of a patent for work

How to renew a work patent for foreign citizens in 2021

The permit allows a foreigner:

  • legally located in the country;
  • carry out work activities in the specialty and receive a salary for it.

If a foreigner has not issued a patent or work permit for more than 90 days upon arrival, then he will be prohibited from visiting the Russian Federation for 10 years.

To register a patent, you must do the following:

  • Register with migration authorities.
  • Comply with legal requirements (not convicted, no entry bans).
  • Provide a package of documentation.
  • Pass commissions - medical, language, fingerprinting.
  • Have a profession, specialty.
  • Have an invitation from an employer.

The procedure for obtaining a patent is as follows:

  1. Arrival in the country and the foreigner filling out a migration card upon entry.
  2. The procedure for registering as a arriving citizen of another country.
  3. Collection of the established list of documents.
  4. Appeal to the regional body of the Ministry of Internal Affairs of the Russian Federation located at the place of registration of the stateless labor person.
  5. Submitting an application.
  6. Payment for services.
  7. Fingerprinting.
  8. Get a medical certificate.
  9. Waiting for the form to be ready.

The following places have been identified on the territory of the Russian Federation where patents will be issued to foreign citizens:

  • UVM departments (formerly FMS);
  • Ministry of Internal Affairs

The form is provided by the stateless person in person at the department of work with foreign residents. A government employee will help you fill it out. You are allowed to contact special companies that work with foreign citizens and their documents. Papers must be sent to the department personally or by registered mail with acknowledgment of receipt.

Issuance is carried out on the basis of payment for the following services:

  • drawing up a patent - 3,500 rubles;
  • monthly advance payment - from 2,000 to 5,500 rubles;
  • registration of a medical policy - from 3,000 to 4,500 rubles;
  • certificate of knowledge of the state language - up to 5,500 rubles;
  • medical certificate confirming the absence of dangerous diseases - 3,000 rubles.

You can find out how much the entire range of services costs in a private case on the website of the Ministry of Internal Affairs or the Federal Migration Service.

REFERENCE. You will not need to obtain a certificate of proficiency in Russian if you have provided the original document confirming your graduation from school (college, technical school, university) in the USSR or Russia.

The absence of a permit to work in Russia looks like a written notification with a mandatory reference to the norm of the law of the Russian Federation.

The reasons for this are:

  • threat to the security of Russian residents;
  • violation of the rules for staying in the country or deadlines;
  • planning or identification of involvement in terrorist activities;
  • the foreigner has been deported from the country within 5 years or transferred to his country in accordance with an international readmission agreement;
  • provided false information in the submitted documents;
  • committing an administrative offense, deportation or expulsion from Russia;
  • was convicted of especially serious crimes.

Also, government officials can revoke a patent if:

  • it is operated by a third party;
  • at the request of a migrant or employer;
  • when the legal entity has not registered in the register;
  • in case of a change of place of residence of a migrant;
  • if the foreigner was transferred under a readmission agreement;
  • according to the owner's request.

A refusal to issue a permit can be appealed to the Directorate for Migration Issues of the Main Directorate of the Ministry of Internal Affairs of Russia or to the Magistrate's Court.

Responsibility for working without a patent lies with both the foreign worker and the employer who employs a foreign citizen without a work patent. Next, we will look in more detail at the responsibility for working without a labor patent and the penalties for this for both parties.

According to Article 18.10. of the Administrative Code for work without a patent, as well as for work outside the subject of the Russian Federation for which a patent was issued, a foreign citizen faces an administrative fine in the amount of 2 to 5 thousand rubles with possible deportation from the Russian Federation.

Important!

For working without a patent in the federal city of Moscow or St. Petersburg or in the Moscow or Leningrad region, a foreign citizen receives a fine of 5 to 7 thousand rubles with administrative expulsion from the Russian Federation.

In what cases can a patent be revoked?

Russian legislation provides for a fairly large list of reasons due to which a work patent may be subject to revocation.

Among the grounds for revocation of a patent are those cases in which a foreign citizen:

  • officially refused further work in the Russian Federation;
  • registered as an individual entrepreneur;
  • carries out its activities with the involvement of third parties;
  • creates a threat to the state system, life and health of Russian citizens;
  • finances (promotes) the activities of terrorist organizations;
  • provided knowingly false information when preparing documents;
  • convicted of a crime;
  • repeatedly brought to administrative responsibility within 12 months;
  • left the Russian Federation for permanent residence;
  • did not pay the fixed advance payment on time (to avoid ending up in a similar situation, it is enough to check the terms of payment for a patent to a foreign citizen using the TIN);
  • did not provide copies of the employment contract, etc., within 2 months from the date of receipt of the patent.

In case of cancellation of a patent, within 3 working days, a corresponding notification is sent directly to the employee, as well as to his employer / customer of the work. A foreign citizen is obliged to leave the country within 15 days (counting starts from the moment the patent is revoked), except in cases where legal proceedings have been opened against him.

What documents are required to obtain a work patent for a foreigner?

If a foreign citizen’s work patent has expired, the employer must terminate the employment contract and send notice of the foreign employee’s dismissal to the Main Department of Migration Affairs of the Ministry of Internal Affairs.

When a foreign citizen receives a new patent, the employer re-enters into an employment contract with him and again submits a notice of hiring a foreign citizen to the Federal Migration Service.

In this section, we tried to provide answers to the most frequently asked questions about work patents for foreign citizens.

If you haven't found the answer to your question, please leave it in a comment.

  • What is the difference between a patent and a work permit: what is the difference between a patent and a work permit for foreign citizens?

The only similarity is that both a patent and a work permit give a foreign citizen the right to legally work in the territory of the Russian Federation. Otherwise, these are completely different documents.

A work patent is issued only to foreign citizens staying on the territory of the Russian Federation on a visa-free basis. That is, only visa-free foreign citizens can obtain a work patent and work under it in Russia.

Foreigners with a visa to work in Russia must obtain a work permit.

  • Who needs to apply for a work patent? Which foreigners need a work patent?

Every foreigner who comes to Russia to earn money on a visa-free basis needs to apply for a work patent, including a work patent for citizens of the CIS, in particular for citizens of Abkhazia, Azerbaijan, Moldova, Tajikistan, Uzbekistan, and Ukraine.

The exception is citizens of member countries of the Customs Union; these foreign citizens do not need to apply for a work patent to work in Russia.

Thus, citizens of Belarus, Kazakhstan, Armenia and Kyrgyzstan do not need to apply for a patent to work in Russia, since these countries are members of the Customs Union.

  • Do Belarusian citizens need a work patent?

Citizens of Belarus do not need a work patent, since Belarus is part of the customs union and, according to current agreements, citizens of Belarus do not need a work patent to work in Russia.

  • Does an Armenian citizen need a work patent?

Citizens of Armenia do not need a work patent, since Armenia is part of the customs union and, according to current agreements, Armenian citizens do not need a work patent to legally work in Russia.

  • Do Kyrgyz people need a patent to work?

Citizens of Kyrgyzstan do not need a work patent, since Kyrgyzstan is one of the countries of the customs union, and, according to current agreements, Kyrgyz people can work in Russia without a work patent.

  • Do Ukrainians need a patent to work?

Yes, citizens of Ukraine need a patent to work in Russia to carry out legal work activities.

  • Do Tajiks need a patent to work?

Yes, citizens of Tajikistan need a patent to work in Russia to legally carry out labor activities.

  • Do Moldovan citizens need a work patent?

Yes, to legally work in Russia, a citizen of Moldova needs to obtain a work patent.

  • Is work experience required when working under a patent?

Yes, a foreign citizen who legally works in Russia under a labor patent is credited with work experience.

  • Is it possible to buy a work patent for foreign citizens?

No! You cannot buy a patent for a work!

This migration document is officially issued by government agencies and their representatives, and the issuance of patents to foreign citizens is carried out personally in the hands of the foreign citizen.

Therefore, even if you need help in obtaining a patent for your work and you contact a law firm specializing in migration services to collect, prepare and submit a package of documents for registration of a patent, do not forget that the patent will be issued to you personally.

Remember, information about the document and its owner is entered into the FMS database (GUVM MIA) only when a migrant’s work patent is officially issued.

Important!

If you are offered to buy a ready-made patent for a job without passing testing and a medical examination for the patent, then rest assured, they are trying to deceive you, since a migrant will not be issued a patent without this.

  • Is it possible to extend a work patent after 12 months?

Renewing a work patent after a year is not a completely correct definition.

This concept means replacing a patent with a work. That is, a foreigner has the opportunity to obtain a new patent for the next period without leaving Russia.

In other words, the patent is re-registered: a foreign citizen receives a new migration patent for work without leaving the territory of the Russian Federation. The document number remains the same, the same as in the old patent. The region of operation and profession also remain unchanged.

Important!

A foreign citizen must take care of the renewal of a patent in advance and begin to act in this direction before its expiration date, since it will take several weeks to collect a package of documents for renewal and obtain a new patent without leaving the country.

The detailed procedure for “patent renewal” without leaving Russia is described on this page.

  • I lost my work patent - what to do?

You will find a detailed answer to the question of what to do and how to restore a lost patent on this page.

  • Can a foreigner work without a patent?

The legislation of the Russian Federation does not prohibit foreigners from working in Russia, but it is worth considering that there are some restrictions for working in areas that ensure the national security of the country. Foreign citizens, like Russian citizens, have certain rights at work and also pay taxes.

Employment of a foreigner in Russia is associated with the preparation of a certain list of documents. The documents will depend on the country from which the foreigner arrived. If he is a citizen of a country with which Russia has a visa-free regime, then such a document will be a labor patent. The exception is citizens of those countries that are members of the Customs Union.

Important! Citizens of Belarus, Armenia, Kazakhstan and Kyrgyzstan can work without a patent in 2021 and stay in the Russian Federation legally.

How to apply for a work patent for foreign citizens in 2021

It is worth starting the patent renewal procedure in advance, and not after the expiration of the term. The entire renewal process will take approximately 10 days, so you should apply for an extension no later than 10 days before the patent expires. In this case, you should already have prepared documents on hand. Thus, it turns out that it is worth starting preparations for patent renewal a month before the end of the term. Preparation will include the following:

  • Collection of necessary documents;
  • Payment of the last month of tax;
  • Passing a medical examination;
  • Preparation of related documents, for example, an application for patent renewal from the employer.

The application submitted by the employer must indicate the following:

  • Name of the company in which the foreign citizen works;
  • The position that the foreigner holds in this company;
  • Patent distribution region.

Important! If the application contains false information, the foreigner may be held accountable.

For those citizens who have issued a patent for 12 months, the extension of the patent is allowed for another 12 months. In this case, traveling outside the Russian Federation will not be required. After the second one-year period, the foreigner will need to cross the Russian border and receive a new migration card. Such a card is necessary to confirm the legal stay of a foreigner on the territory of the Russian Federation, as well as to obtain a new patent.

To renew a patent, you will also need to collect a certain list of documents. A complete list of documents can be found on the website of the Main Department of Migration Affairs of the Ministry of Internal Affairs (UFMS), it includes the following list:

  • A document proving the identity of a foreigner, allowing him to cross the border of the Russian Federation, as well as stay on the territory of another state (foreign passport);
  • Migration card, which confirms that the foreigner has legally crossed the border and is staying in our country;
  • A note that the foreigner has registered for migration;
  • Petition from the employer;
  • Employment contract (copy of the document);
  • Previous patent (copy);
  • Receipts confirming payment of tax for the previous patent and for the renewal period.

If a foreigner has not renewed his work patent, he will need to leave Russia and then re-enter. This is required in order to again receive a migration card, which will allow you to legally stay in the Russian Federation. It is worth finding out the date of entry into the country in advance, as it will depend on the rules for crossing the border. For example, some citizens have the right to travel abroad and return to the Russian Federation on the same day, while other citizens will need to wait 3 months to enter. After receiving a new migration card, the foreigner will need to apply for a new patent within 30 days.

If a foreign citizen continues to work without a patent, he will be held accountable. He will be fined from 2,000 to 5,000 rubles. At the same time, for foreign citizens working in Moscow or St. Petersburg, the amount of the fine will be higher. It will amount from 5,000 to 7,000 rubles.

For many, the maximum validity of an identification certificate for a migrant worker in the Russian Federation is limited to 12 months. Extension for the next period has changed today.

You can get another paper without visiting your country at the Main Migration Department of the Ministry of Internal Affairs (formerly the FMS) in the Russian Federation. All necessary documents can be collected a month before the expiration of the previous document program and the entire package can be immediately submitted to government agencies.

If the permit is no longer valid, then you will have to move outside the Russian Federation and go through the entire procedure for obtaining it in your country.

What to do when a patent expires

On April 18, 2021, Presidential Decree No. 274 was issued. The head of the Russian Federation extended the deadlines for visas, migration cards and other papers, including work permits. Automatic extension applies to papers issued from March 15 to June 15 of the current year. Thus, working foreign nationals can continue their activities until the end of this period and there is no need to fill out any papers during this period.

Important!

Reaffirmation of your right to work is allowed after this period, and a later payment of personal income tax is also possible.

To renew your certificate, you do not need to move from the Russian Federation. During a pandemic, this action is fraught with global consequences, so the country has taken global restrictive measures.

Important!

Renewal of the certificate is possible only for the second year and in the case of submission of crusts before the expiration of the current period of the original paper.

List of documents for patent renewal

If the validity period of a labor patent expires (is coming to an end), a foreigner can obtain a new work patent without leaving Russia. To do this, it is very important to collect documents for patent renewal and submit the finished package to the Main Department of Migration Affairs of the Ministry of Internal Affairs no later than 30 days before the expiration of the old work patent. Do everything in advance, because... It's very easy to exceed deadlines.

List of documents for patent renewal in 2021:

  1. A completed application for patent renewal in the prescribed form;
  2. International passport;
  3. Migration card;
  4. Migration registration (initial temporary registration);

How can a foreign citizen obtain a work patent in 2021?

Calculations for Moscow look like this: 1200 (base rate) x 1.864 (deflator coefficient) x 2.3878 (regional coefficient established by the Moscow government) = 5341 rubles . This is exactly the amount that labor migrants from Moscow must pay for the document every month.

Patent price in the Moscow region for 2021

In the Moscow region, the cost of a labor document is not much different from Moscow. Foreigners working here will save only a few hundred rubles per month on the document. Every month, migrants from the Moscow region will pay 5,092 rubles .

Foreigners from the following countries will have to obtain permission:

  • Abkhazia;
  • Ukraine;
  • Moldova;
  • Tajikistan;
  • Azerbaijan;
  • Uzbekistan;

Arrivals from member countries of the Customs Union do not require registration. There is no need for employees to receive it from:

  • Armenia;
  • Belarus;
  • Kyrgyzstan;
  • Kazakhstan.

This document fulfills the territorial restriction. A migrant can work legally only in the specified territory.

For example, it is impossible to work under a single patent both in the Moscow region and directly in the capital. For these two territories, different patents are required - this is the rule introduced in 2021.

A patent permit is drawn up at the Main Directorate for Migration Affairs of the Ministry of Internal Affairs and issued there. In addition, you can get it at State Services centers.

The third option is to contact intermediaries who provide similar services to migrants. But even when the company accepts documents, receipt always occurs only in person by the applicant.

To begin the receiving process, upon entering the Russian Federation, a foreigner must know and comply with the legislation that concerns migrants:

  • He enters Russian territory without a visa and issues a migration card;
  • In the column about the purpose of arrival, he indicates “work”;
  • Insurance must be taken out immediately upon entry;
  • Within a seven-day period after entry, you need to register for migration;
  • After this, issue a work permit within thirty days.

To become a patent owner, you need the following:

  1. Undergo a special medical examination;
  2. Pass the language and legal test;
  3. Apply for voluntary health insurance;
  4. Do fingerprinting;
  5. Translate into Russian and notarize the passport;
  6. Pay the monthly personal income tax rate (in advance);
  7. Take a photo of the required parameters;
  8. Fill out an application.

The state examination and certificate of completion are a mandatory procedure. It consists of three modules:

  1. Language of the Russian Federation;
  2. Russian history;
  3. Current legislation of the Russian Federation.

The examinee must be proficient in vocabulary and grammar, listening and oral communication (speaking), reading and writing. These skills make up the language module.

The historical and legislative modules include 10 points each.

The knowledge test will not be biased, but the language part must be passed 60% correctly, and in the remaining sections you must answer 50% of the questions correctly.

According to the law, any foreigner, including those arriving for work, must purchase a health insurance policy on the first day of arrival. It is issued by the insurance company. The insured amount must be at least 100,000 rubles. The coverage period is the entire period of stay in the territory of the federation.

For registration you will need a passport and a copy of the migration card.

Before submitting, all documents in the package, including your passport, are translated into Russian. Translations are certified. Photocopies of identity documents and migration cards are made.

The procedure is not mandatory for foreigners, but those who apply for a labor patent are required to undergo it. Fingerprints are taken when all documents are submitted for registration and the application for a patent is approved at the territorial office of the Ministry of Internal Affairs. To pass, you need to write an application for the procedure.

In 2021, all visa-free foreigners will receive a migration patent in Russia. An exception to this requirement are citizens of countries that are members of the Customs Union:

  • Belarus;
  • Kazakhstan;
  • Armenia;
  • Kyrgyzstan.

They do not need a work permit. And what kind of citizens need a patent? All others (those who come from Abkhazia, Uzbekistan, Ukraine, etc.) require it without fail.

Two key points about a work patent:

  1. It has a strictly defined territory of action. It is indicated in the document and determined based on the application of the working guest. IMPORTANT! To determine the territory of employment, remember: Moscow and the Moscow region, St. Petersburg and the Leningrad region are not one place of work. To work both in the city and in the region, you must have two paid permits.
  2. The work permit indicates the specialty in accordance with which the profession for employment is selected.

Responsibility for working in an unapproved region and not in the specialty:

  • a fine of up to 7,000 rubles;
  • expulsion;
  • entry ban from 3 to 10 years.

The mandatory list of documents for obtaining a patent includes medical certificates. Conduct medical examinations of foreign citizens in authorized medical institutions. Find out the list from the migration service.

Take with you to the medical examination:

  • passport;
  • migration card.

During the examination, doctors will examine you to identify diseases that are dangerous to others. This will include a therapist, a phthisiatrician, a dermatovenerologist, and a psychiatrist-narcologist.

Based on the results, the migration service will issue the necessary documents:

1. Certificate of medical examination.

Examples of tests and assignments

The cost of testing is 4000 rubles. For citizens of Donetsk or Lugansk regions - 2500 rubles.

After successful completion, a certificate of the established state standard is issued.

Foreign citizens need a TIN since March 2021. Without it, it is impossible to obtain a work permit and make an advance personal income tax payment. And although starting from 2021, a foreign citizen’s TIN is not included in the mandatory list of documents for a patent, they will have to obtain one. It's simple - go to the Federal Tax Service at your place of registration and fill out an application for tax registration.

Advance payments of foreigners under a work patent are calculated based on the general deflator coefficient and the regional deflator coefficient. For each subject of the Russian Federation, the amount of a fixed advance payment has been established. Tables with regional values are approved once a year by the Ministry of Economic Development.

Find out the amount of payment to be transferred to the tax office. Transfer the money and be sure to keep the receipt.

Fingerprinting is an examination. They will take your fingerprints, check whether they are already registered, which person they belong to, and whether there are “dubious points” in his biography. After verification, the results will be entered into the database.

Fingerprinting is mandatory and recommended for migrants who want to apply for a patent or work permit in Russia. It is performed at the territorial department of the Ministry of Internal Affairs, when all documents have been submitted and the application has been approved. The procedure is free.

As a result of fingerprinting, a certificate is issued containing the following information:

  • gender and full name migrant;
  • prints of each finger and individual palm;
  • place and date of birth;
  • signature of a foreign citizen;
  • signature of the person who performed the procedure;
  • the date of the;
  • why does a specific person need fingerprinting;
  • place of fingerprinting.

How much will a patent cost foreign citizens in 2021?

There are two concepts: “patent for foreign citizens” and “work permit”. They are close in meaning, but are issued for different categories of foreigners. Obtaining a particular document in 2021 depends on the citizenship of the person entering work and the visa regime with the country of departure.

Foreign citizens coming for work from countries with a visa regime apply for a work permit. Citizens entering visa-free receive a work permit for foreigners.

In 2021, citizens of Belarus, Armenia, Kyrgyzstan and Kazakhstan are exempt from receiving this paper, but this does not deprive them of the obligation to register for migration at their place of residence. They enter into an employment contract with the employer and work according to it.

There are rules that a foreign worker must follow after receiving a patent. When applying for a position after concluding an employment contract, a copy of it is sent to the migration service or you bring it yourself. This procedure takes 2 months.

After employment, the employer issues a notice of hiring a foreign worker. This notification is sent by mail or brought in person to the migration authority within 3 days.

If registration rules are violated, not only the foreigner, but also the employer is liable.

For a foreign worker, fines are provided in a number of cases:

  • Labor activity outside the region in which the patent was received.
  • Expiration of the document.
  • Work not in the profession indicated on the paper.

The amount of fines in such cases in 2021 reaches 7 thousand rubles. In case of repeated violations, a foreign citizen may be expelled from the Russian Federation and barred from entering the country for 10 years.

Immigrants who have formalized their stay in the country officially through the migration department can earn money in Russia without problems with the law. For foreign citizens entering our country with a foreign or national passport without a visa, there is a separate scheme for obtaining a work permit.

The laws of our country require such groups of people to obtain a patent for work in order to carry out labor activities without violations. States members of the Eurasian Economic Union are not subject to this rule.

The remaining immigrants from states that have visa-free relations with Russia apply for a patent. These include the following national groups:

The immigrant must submit all necessary certificates, papers, and certificates to the migration department to obtain a patent no later than 30 days after entering the Russian Federation. To obtain a work patent, a foreign citizen must submit the following documents:

  • An application completed in clear handwriting or using technical means.
  • Identity document.
  • A policy issued by an insurance company with which the migrant has voluntarily entered into a health insurance agreement, or an agreement between the migrant and a medical institution for the provision of medical services. The duration of the agreements depends on how long the migrant plans to live and work in the Russian Federation. But it should not be less than the period of residence of the migrant in our country
  • Migration card, the items of which were filled out by the immigrant at the border post. If the purpose of visiting Russia is work, then this should be reflected when filling out. If you indicate a different reason for the visit, this may result in a refusal to issue a patent. When this document is lost, the migration department has the right to find out the required information through its own channels.
  • A document proving that the foreigner is not a drug addict or a carrier of dangerous viral or bacterial diseases, including HIV.
  • An official certificate confirming the migrant’s ability to speak, write, read in the official language of Russia, knowledge of the history and legal foundations of the Russian state, necessary to work under a patent.
  • An official document proving that the immigrant has registered in the territory of the Subject of the Federation where he plans to work.

In order for the process of integration of foreigners into Russian society to be as successful as possible, a visiting citizen of another state must be able to speak the official language of Russia. Additionally, the immigrant must have general knowledge of Russian history and be able to navigate the legislative sphere. To do this, foreign citizens undergo special testing to determine the level of information proficiency on all the points listed above.

Migrants can only undergo testing at educational institutions that have received a license for this type of activity. A list of educational institutions conducting testing is available in all migration departments.

To avoid any questions from inspectors of the migration division of the Ministry of Internal Affairs, it is better to fill out the form in block letters or using technical means. The information entered must be reliable. If during the check it turns out that the immigrant provided false information in the fields, the application will be returned and the issuance of a permit will be denied.

Every month, a foreigner working under a patent sends a fixed amount to the Russian treasury. Some people refer to these monetary contributions as patent fees. But this name is a little incorrect. After all, in fact, a foreigner pays personal income tax. The first payment is an advance payment and is made upon execution of the document. Next, the migrant must pay the required amount every month. The amount of the tax contribution depends on the region where the foreign citizen works and on the size of the regional coefficient.

Migrants and managers of companies and organizations who practice illegal employment deliberately violate the law of the Russian Federation. Such behavior is punished by deprivation not only of money, but also of certain opportunities.

The following monetary penalties are provided for violators:

  • Foreigners working without a patent - up to seven thousand rubles;
  • Organizations using foreign labor – up to a million rubles;

It happens that for some reason a foreign citizen does not extend the term of a patent. What should a law-abiding company manager do? It is known that it is impossible for an immigrant to work in Russia without permission. The only right decision is to terminate the employment relationship with the migrant. This will save the company and the migrant from unnecessary headaches associated with penalties. After the renewal or receipt of a new work patent, the company management again includes the immigrant in the organization’s staffing table.

Migrants from neighboring countries, coming to the Russian Federation to work, are required to obtain a patent. To avoid emotional and additional financial costs, a migrant must prepare for registration in advance and carefully.

To get a prompt and qualified answer to your question, try to describe your situation and the reasons for it as accurately as possible.

Visa-free foreign citizens who work in the Russian Federation under a work patent must make a fixed advance payment on the patent every month - personal income tax, in order to extend the validity of the patent and be able to continue to legally work in the territory of the Russian Federation. That is, by paying for a patent a month in advance, a foreign citizen pays personal income tax on his work on the patent in the next month.

Thus, payment for a work patent by a foreign citizen must be made every month or several months in advance.

Important!

Today, the system for recording the payment of fixed advance payments for a patent by foreign citizens is fully automated, so the absence of an advance payment on a specific date leads to the automatic cancellation of a patent for work in the database of the Main Directorate for Migration of the Ministry of Internal Affairs. Thus, if a fixed advance payment for a work patent in 2021 is made later than the date of receipt of the patent, even by one day, the document will be automatically canceled for late payment of the patent.

Many foreign citizens have already heard about changes in the cost of a patent for 2021, and therefore they are very interested in the question of whether it will change much and how much they need to pay for a patent in 2021. We answer: the amount of payment for a patent in 2021 will change compared to 2021, since the deflator coefficient for 2021 for a patent has been changed, on the basis of which the monthly patent tax for a foreign citizen is calculated.

Thus, by order of the Ministry of Economic Development, the personal income tax deflator coefficient for 2021 was approved, which amounted to 1,864

.

Let us remind you that in 2021 the personal income tax deflator coefficient was 1.810.

Accordingly, in 2021 the patent amount for foreign citizens has changed, and now the monthly payment for a patent in 2021 will be paid taking into account these changes.

The table below shows the monthly fixed cost of a patent for foreign citizens in 2021 for each region of the Russian Federation, which will need to be paid from January 1, 2021.

Private practice, specialization - migration and civil law. For many foreign citizens, the answers to these questions remain a mystery, and often due to the fact that a foreign citizen living in Russia does not know what to do in a given situation, he unintentionally violates the law and gets into a bunch of problems, including expulsion from the territory of the Russian Federation. To prevent you from having similar problems with the Federal Migration Service, in this article we will consider in detail the issue of paying for a patent.

The procedure for hiring an employee with a patent

The general procedure for the employer as a whole may look like this:

  1. Receiving a response from an applicant to a vacancy or inviting him based on the results of a resume. In any case, the applicant is required to demonstrate his national passport before concluding an employment contract. In addition, the employer has the right to request educational documents, including with a notarized translation, if they are not in Russian.
  2. Patent verification. It includes checking the information specified in it with the passport. In addition, you should check the place of territorial validity of the patent. It is also worth paying attention to the actual location of the workplace - if an enterprise operates in several constituent entities of the federation, then the actual place where the employee performs his work duties is important - it must comply with the patent. It is also necessary to check the profession indicated in the document.
  3. Presentation by the employee of SNILS and work book. If they are absent, then after formalizing the employment relationship, their registration is the responsibility of the employer. It is prohibited to refuse employment due to the lack of these documents.
  4. Requiring a medical certificate or a certificate of no criminal record. These documents can be required from the employee only if this need is established by the standards of the current legislation. In this case, the employee pays for the initial medical examination independently, and subsequent medical examinations are arranged at the expense of the employer. If the nature of the work activity requires a certificate of good conduct, it is provided both from the Russian Ministry of Internal Affairs and from the authorities of the country of origin.
  5. Conclusion of an employment contract. The registration of an employment contract occurs in the same way as when employing citizens of the Russian Federation. The only additional requirement is to indicate in the contract information about the patent under which the foreign citizen is hired.
  6. Notification of the Migration Service of the Ministry of Internal Affairs. Such a notification is sent to all foreigners without exception. It is drawn up on a form approved by federal legislation and sent to the Department of Internal Affairs of the Ministry of Internal Affairs, geographically located in the same place where the employee’s actual workplace is located.

How much does a patent for work in Russia cost: violation of payment deadlines, making a fixed advance payment

Refusal to employ a foreigner solely because of his non-resident status is considered illegal and is punishable by Russian law as discrimination.

What should the head of a company whose employee’s patent to work in Russia has expired?
