How to pay the state fee for divorce through Sberbank online divorce?

Payment for marriage registration

When submitting an application to the registry office, you also need to pay a state fee, it is 350 rubles.
For convenience, you can pay in advance and bring a receipt for payment upon your first visit. Otherwise, you will have to return with confirmation of payment, and only after that the application will be considered completed. To pay the state fee through Sberbank Online, you need to know the registry office details and have the required amount on your bank card.

The sequence of actions is the same as when paying the state fee for obtaining a foreign passport:

Log in to your Sberbank Online Personal Account. Find the subgroup of payments to the budget through the “Payments and Transfers” tab and select “Federal Tax Service” in it. We select payment through the details and carefully enter them, do not forget to check the amount and indicate your personal data or the person for whom the fee is paid - full name, address and passport data (for such payments this is important). We confirm the information using the code from SMS and can print a receipt. For reference: you are not required to provide a payment receipt or a copy thereof; employees of the Federal Tax Service and other organizations are required to track your payment themselves if necessary

Most often, a receipt is still required, so it is in your best interest to print it out and make your life easier.

By the way, not everyone is required to pay state fees in full. Some categories of citizens are provided with benefits:

Typical payer mistakes

  • Entering incorrect data is the most common mistake. An application with such a receipt will not be accepted; you will have to pay again, and then it will take a long time to return the money. Payer details must be entered correctly and carefully checked.
  • Errors in recipient details. The money will go to the wrong address and the receipt will not be accepted. You need to pay again. The money can be returned upon application to the bank. This will take some time.
  • If a relative or acquaintance pays the fee, he must indicate not his own data, but yours. You can indicate the details of another person on the basis of a certified power of attorney to receive a certain government service.
  • The type of payment or its amount is incorrectly specified. An application with such a check will not be accepted. You must correctly write the type of payment, its purpose and amount.
  • The receipt or check has not been preserved. Without a receipt it is impossible to receive the service. If you threw away a check, contact the bank; information on transactions is saved. The bank will issue a copy of the check.

Be very careful when filling out the details and data when paying state fees through terminals.

Who pays the state fee in case of divorce?

The question of who pays the state fee in a divorce does not lose its relevance.

Except for those cases when an application to the registry office is submitted by one of the spouses who wishes to dissolve the marriage with an absent spouse, incompetent, deprived of liberty for more than 3 years. Then only this spouse pays the state fee.

If the divorce is carried out through the court, then the situation with the collection of fees is different.

A receipt for payment of the fee will be required when filing for divorce. Therefore, it is the spouse who submits the application, the plaintiff, who pays for it.

Further, he can pay the full 1,300 rubles - for himself and the other party. The plaintiff also has the right to indicate in his application that half of the fee he paid must be recovered from the defendant.

If the court satisfies this requirement, then the defendant will pay half.

State duty amount

State duty is a monetary collection by the civil service for the corresponding request of citizens or organizations to provide a service. With regards to the divorce process, the legislation establishes the following amounts of state fees:

  1. If the divorce is carried out through the registry office, then both spouses are issued receipts for payment in the amount of 650 rubles, that is, the total is 1,300 rubles for both.
  2. If the divorce process goes through the judicial authorities, for example, one of the spouses is against it or there are various kinds of disagreements, claims or minor children, in this case 650 rubles are also paid from each. In such a situation, the defendant may refuse to pay, then 1,300 rubles for both falls on the shoulders of the plaintiff.
  3. In case of unilateral procedure, when the second spouse is declared incompetent, missing, or in prison, the state duty is 350 rubles only for the plaintiff.
  4. If during a divorce the issue of division of property is raised, then the state duty will consist of several payments: fixed - 3,200 rubles and 2% of the valuation of the property. As practice shows, the total tax usually does not exceed 5,200 rubles.

The presence of children does not affect the final amount of the state duty; it is 650 rubles.

As for court proceedings, here the plaintiff may demand reimbursement of the state duty of 650 rubles (if he paid for the defendant) or the entire amount of 1,300 rubles if the court made a positive decision. Thus, the amount of state duty for a divorce may vary, it all depends on the specific case, but in a standard situation, each spouse pays a receipt of 650 rubles.

Validity period of the state duty

After the state fee is paid and the application is filed with the court, 30 days pass before the divorce is registered.

Former spouses will be given a divorce certificate and have their passports stamped.

If the parties to the process do not appear to register the divorce, then the application is canceled.

Validity of the state fee when applying to court for a divorce:

  1. If you have a receipt for payment of the state fee for divorce, the question arises of how much the state fee is valid. You can file a lawsuit for this service within 1 year. This validity period is explained by the fact that over a longer period of time, bank details and the amount of the fee may change.
  2. If the statement of claim is returned to the plaintiff, all existing deficiencies must be eliminated within the specified time frame. After this, the claim will be accepted, and the paid fee will remain in effect.
  3. If the court refused to accept the claim, then the same claim cannot be filed a second time. The paid state fee for filing a claim is non-refundable.

Where can I get the details?

Each government agency that provides any services requires payment for them of the state duty established by law.

Reference! For each spouse it is 650 rubles, but can be reduced or increased depending on the conditions of the divorce proceedings: the spouse is deprived of liberty - 350 rubles, with the division of property - 3200 rubles and 2% of the assessment. However, it does not depend on the presence or absence of children.

Before filing an application for divorce, you should take the details of the institution where this process will be carried out - the registry office or the judicial authority. Typically, employees themselves issue a receipt with details, which will also indicate the amount of government contribution required for payment for the service.

If this did not happen or this document was lost, you can clarify the necessary data on the official websites of these government agencies or call by phone.

Once all the data is known, you can start paying the state fee. This can be done in several ways: by visiting a bank in person, a post office, through a terminal or through a banking application.

State duty for divorce: amount of state duty in 2021

According to Art. 333.36 disabled people of the first group are exempt from the obligation to pay state duty. Representatives of the other two disability groups are not exempt from this obligation. In order to realize the opportunity provided, the citizen submits a corresponding petition simultaneously with the statement of claim. It is accompanied by a medical certificate of disability.

Despite the fact that the amount of state duty for a divorce is not so large, some are still interested in the question of deferring it or installing it in installments. Let us say right away that when applying to the registry office you will have to pay immediately; there are no ways to “push back” the payment during an administrative divorce.

This can only be done if the spouses are divorcing through court. The presiding judge, at the request of an interested party, may decide on:

  • deferment - payment of state duty after the occurrence of an event or after a certain time has passed;
  • installment plan – making payments in installments.

The judge makes a decision based on the financial situation of the party. Therefore, the application must be accompanied by documents confirming the validity of the request. This could be a dismissal order, a medical report about the presence of a serious illness that prevents employment, etc. If a citizen with a normal income asks for a deferment or installment payment, the judge will not grant his request.

The application is submitted simultaneously with the statement of claim. It will not be possible to apply for a deferment or installment plan during the process, since a claim received without payment of the state fee will not be accepted for consideration.

In addition to the main state fee for divorce in court, spouses must pay for state registration of civil status and the issuance of a divorce certificate. In this case, 650 rubles are collected from each side.

If, simultaneously with the claim for divorce, demands for division of property are filed, the plaintiff pays for them, based on the provisions of Art. 333.19. Often, divorce is accompanied by claims for the collection of alimony, establishing the place of residence of children and the time of communication with them.

Disputes related to the interests of minor citizens are not subject to state duty.

In the generally accepted sense, a cash payment is evidenced by a receipt issued by the bank teller.

In addition to the receipt, the following documents can be used:

  • payment order with a note from a bank or other financial organization confirming the non-cash payment;
  • extract from the State Information System on state and municipal payments - GIS NMP (see clause 2, part 1, article 7 of the Federal Law of July 27, 2010 No. 210-FZ “On the organization of the provision of state and municipal services”).

State bodies, including courts and registry offices, do not have the right to demand from applicants documents confirming the fact of payment of the state fee. Their presentation is a right, not an obligation, of applicants. If a payment document is not attached to the application, the authorized body is obliged to establish the fact of payment using a certificate from the GIS GMP. The creation and administration of GIS is the responsibility of the Federal Treasury.

The amount of the state duty is determined by Art. 333.26 clause 1 clause 2 Tax Code of the Russian Federation. In 2021 it will be 650 rubles. from each spouse. The total cost of a divorce through the registry office will be 1,300 rubles.

The state fee is paid by the spouse filing the application if the other is missing, serving a prison sentence or incapacitated. Its size will be 350 rubles.

To pay, you must fill out a receipt issued by the registry office, and when paying using the electronic payment system, find out the details of the government agency.

Details change periodically. To ensure that the amount is not mistakenly transferred to the wrong address, the details for filling out the receipt must be clarified.

The price includes obtaining a divorce certificate. No additional expenses will be required.

The “cheapest” option is suitable for couples who do not have disputes over the place of residence of children and property disputes.

The filing fee is paid by the plaintiff, the person most interested in the divorce. The claim is filed at the place of residence of the defendant.

Divorces in the presence of children, carried out by mutual consent, are carried out by a magistrate. Divorce through court, accompanied by a dispute, requires appeal to a city or district court. In both cases, the claim must be accompanied by a receipt (check) for payment of the state duty. Its size, according to Art. 333.19 of the Tax Code of the Russian Federation, clause 1, clause 5 will be 600 rubles.

After the end of the trial, the spouses, based on the decision on divorce, receive a Certificate of Divorce from the registry office. To do this, each of them must contact the relevant government agency with an application drawn up in Form 10.

Everyone pays a state fee, the amount of which is 650 rubles. Thus, the total amount of divorce for them will be 600+650*2=1900 rubles.

Legal costs (expenses) are an integral part of the consideration of civil claims. They may be mandatory or depend on the will of the parties to the divorce process.

The previously discussed amount of the state duty (600 rubles) for filing a written appeal to the court is a mandatory payment determined by the current tax legislation. It does not change depending on who is considering the case. Without proof of payment, the claim will remain without progress.

Depending on the progress of the case, the plaintiff may incur other costs, for example:

  • when attracting witnesses - payment for their accommodation, food, moving expenses;
  • payments to experts for carrying out appraisal activities (when filing property claims);
  • expenses associated with searching for the defendant in his absence at the place of registration;
  • postage;
  • compensation for actually lost time (Article 99 of the Code of Civil Procedure of the Russian Federation);
  • other expenses related to the divorce process.

In practice, compensation for lost time and travel can be paid to witnesses provided they live in another city.

There is no article of law that lists all possible legal costs. The plaintiff’s task is to justify that the funds spent directly related to this process and provide evidence in the form of checks and receipts.

Another expense item is hospitality. The costs of a representative's services are awarded at the request of the winning party to the other party in accordance with Art. 100 Code of Civil Procedure of the Russian Federation. If the services were provided free of charge, the amount is transferred to the law firm that provided the lawyer. As a rule, the cost of such services is 1/2 - 1/3 of the cost of a property claim, so before you start opening a case, it is worth calculating whether the benefit from this is great.

Involving a notary in divorce cases is necessary in cases where spouses enter into agreements: on the amount and procedure for paying alimony, on children, on the division of property. The document significantly brings the moment of issuing a divorce certificate closer.

Only a notarized agreement acquires legal significance. For failure to comply with the terms of the agreement, the parties may be held accountable in court, and the agreement serves as evidence of violations.

The cost of registration will depend on which notary is involved in the registration: public or private.

Tax legislation sets the amount of 250 rubles for drawing up an agreement on the payment of alimony. (Article 333.24 clause 1 clause 9). Additionally, payment is made for technical and legal services. For example, certification of copies - 10 rubles / sheet, storage of documents - 20 rubles / day (Article 22.1 of the Fundamentals of Legislation on Notaries).

In property matters, the maximum amount that a civil servant can receive is 20,000 rubles. , minimum - 200 rub. The cost is calculated as 0.5% of the amount specified in the agreement.

It is recommended to use the services of a lawyer to competently draw up a statement of claim and determine the package of documents when going to court. Preparing for the process, taking into account all legal requirements, will speed up the divorce procedure. Law firms provide individual services or a package of them for a certain fee, which is not fixed. On average, the cost of individual services in Moscow and St. Petersburg in 2021 is:

ServiceAverage cost,
Consultation on the procedure for divorce, given orally1-1.5 thousand rubles.
Consultation with written explanation of issues of interest regarding divorce2-2.5 thousand rubles.
Preparing a claim for divorce3-3.5 thousand rubles.
Representation of interests before a magistrate20-25 thousand rubles.
Representation of interests in courtFrom 30 thousand rubles. depending on the complexity of the case.

In addition to consultations, most law firms offer turnkey divorce document packages. The cost of the service varies from 10 thousand rubles. in cases where everything is resolved peacefully and there are no disputes, up to 50 thousand rubles. and higher in case of disagreement.

How to pay the state fee for divorce payment receipt

A receipt for payment of the state fee for divorce is required when performing legal procedures that diverging spouses have to go through.

Like many other actions, the initiation of divorce proceedings is subject to a state fee, which can be considered one of the tax payments.

Duties have always existed: they were paid to kings, emperors, feudal lords and other high-ranking owners.

Today, a duty is a monetary payment collected by government agencies for performing certain work: for example, customs duties, judicial duties. The latter is charged for any appeal to the court and goes to pay for the work of bailiffs and judges.

It follows that it is impossible to avoid paying it, and each spouse is required to pay the fee before starting the process. Depending on where the divorce takes place, the size of the payment varies:

  1. If a divorce is done through the registry office, both spouses must pay 650 rubles each and attach the receipts to other documents. In case of a unilateral divorce (for example, when the other party is considered missing), only the filing party pays the state fee. The amount will be 350 rubles.
  2. When dissolving a marriage through the court, the cost of the fee remains the same - 650 rubles for the husband and wife. However, it should be taken into account that since the statement of claim is usually filed by one spouse - the plaintiff, the payment of the fee falls entirely on his shoulders.

In other words, he must pay 1,300 rubles for two at once. Further, he may demand in a lawsuit that half the cost be withheld from the defendant or reimbursed in full.

There are two ways to pay the fee:

  1. In cash in banks, at the post office or directly at the court cash desk.
  2. In non-cash form in terminals with a bank card or using the State Services portal.

To pay the fee and fill out a receipt for payment, you will need to find out all the details of the judicial authority. To do this, just contact the court directly or look on the notice board. Specifically, you need to know some details:

  1. Full name of the court.
  2. TIN, checkpoint and OKTMO code.
  3. Full account number of the payee, BIC and KBK.

The receipt must also indicate:

  1. Full name of the payer, his address.
  2. What is the payment for?
  3. Amount, number and signature of the payer.

This is the most popular and trusted method: you must give the completed receipt to the cashier at a branch of Sberbank or any other bank and wait for the check.

Payment can also be made through the post office, but before doing this it is better to check whether it accepts payment. The same applies when paying through the terminal: to do this, you need to click Payment of state fees and enter the number of the court or registry office where the documents will be sent.

It is important to remember that the receipt received is valid until the details of the registry office or court are changed. To do this, you can use an online bank, the card of which the payer has.

Many banks provide this service

Where to pay the duty, popular methods

In order to complete the procedure, you can use three methods: visit a Sberbank branch, deposit money through a terminal or Sberbank online. In the first case, the commission will be 3%; when paying through a terminal, it varies from 5 to 10% depending on the city. Transfer to a bank account is not available to individuals. Each current method of paying duties is worth considering in more detail.

Through Sberbank online

This method is the fastest and easiest; any card holder of this bank or account holder can use it. You can pay the fee in your personal account, spending no more than 5 minutes; before that you need to register in the service. Detailed instructions:

  1. To get a login and password, you need to use the Sberbank terminal by selecting the “Mobile Bank” item in the menu and connecting the service. The details will be printed on the receipt.
  2. Then you can log into your personal account from your computer or phone (for the latter you will need to download the application from the AppStore or GooglePlay). You will need to confirm your login using the code from the message that will be sent to your linked mobile number.
  3. On the page that opens, you need to click on the “Payments and transfers” item, then find the desired branch of the registry office or judicial authority. To do this, you can enter the name of the organization in the search bar and select by area. The search is also possible by entering the Taxpayer Identification Number (TIN): this number is on the receipt. Basic details will be indicated in the payment order automatically; it is advisable to check the numbers to eliminate the risk of error.
  4. After this, you need to fill out the transfer destination column and indicate the amount. You need to write the purpose of the payment (payment of duty), your full name, registration, series and number of the Russian passport.
  5. After checking the data, you need to confirm the operation by clicking on the “Continue” button and entering the code from the received message.

Transferring funds through your Sberbank personal account is convenient because it allows you to save time and pay the state fee for divorce when it is convenient. Thanks to the use of templates, you need to specify a minimum of information; the details are entered automatically.

Payment via Sberbank Online
Sberbank Online is one of the priority methods of paying state fees

Through a bank cash desk

If a citizen is not a client of Sberbank, he can pay the state fee through the cash desk: he will need to take a receipt issued by a court or registry office employee, indicate there the payer’s full name and individual number. The document is given to the cashier, and he enters the data into the database, making the payment.

This option is convenient for those who prefer to pay taxes and state duties in cash. You can find the nearest bank branch on the official website.

Via terminal

To avoid standing in line at the bank, you can use a terminal: such machines are available in all large and small cities of the Russian Federation. After receiving the receipt, you need to select the “Payments” item in the menu, then go to the “Payment of duties” subsection. The required type of payment is “Termination of marriage”; after pressing the button, an electronic form is displayed on the screen. You need to indicate there the details and purpose of the money transfer, check the numbers and select a payment method.

The terminals support both accepting cash and debiting from a card or account, but not all of them have a bill acceptor. It is important to make sure that a particular device is equipped with this: some can only be used for non-cash payments. In addition, modern bank terminals have a barcode reader, in which case it is enough to hold the receipt to it. After reading, all data will be entered in the payment document automatically.

Methods of paying off state duties and fines

It is much easier to organize communications with banks than to maintain your own financial accounting. Sberbank, as the largest and most famous bank in Russia, is the main acceptor of payments for all kinds of state duties, private duties and fines. However, in order to use the services of Sberbank in this area, it is not at all necessary to visit a branch of the bank itself. You can transfer payment of the duty to Sberbank in three ways:

  • online, i.e. via the Internet. You can pay any private duty or state duty online on the Sberbank website by visiting your personal account and using a special function. You can also type in Google the institution to which the payment is intended (today any authority has its own online representation);
  • the fee can be paid through Sberbank payment terminals and ATMs using a Sberbank plastic card (in this option payment will be non-cash);
  • terminals and ATMs also accept cash.

Details of using Sberbank Online

It is worth considering each method in more detail, separately. If the client has an online payment service connected, there should be no problems on the Sberbank website. Sberbank does not have the right to charge a commission when debiting money from your own card. However, if the “plastic” belongs to another bank, then commissions are possible. Their size depends on the bank, the duty (fine) and the amount of payment. The court, traffic police, registry office and other government bodies have recently introduced a function on their online resources through which you can pay a fee or state fee directly on these resources.

Only if, when depositing money on the Sberbank website, you will have to indicate the addressee’s details, then on the website of some court you will need to indicate the card number (sometimes bank details may be required). Details can be found at any branch of a financial institution or in a call center (for Sberbank this is number 8 800 555 550), or in the corresponding section of the bank’s website. It is best to take complete details printed on separate paper when visiting a bank branch (you need the card itself and a passport).

In general, to use, you will need a password and a client ID. It is much easier to pay those who have an active Sberbank card. Then, through any Sberbank terminal, by inserting a card and typing the PIN code, you can easily obtain this information (section “Internet service”, footnote “Identifier and password”). A call center can also help here. Finally, when connected, send an SMS “Parol NNNN” to number 900. A password and ID will be sent with the return SMS. And do not forget to receive a list of one-time passwords through the same terminal, each of which will be needed to pay for one transaction (in the terminal, section “Internet service”, footnote “Print of one-time passwords”).

Advantages of payment terminals

Why is it better to pay through ATMs and terminals? Answers:

  • there is no need to connect any additional functions of a bank card - each client can pay a fine or fee through the terminal, even regardless of whether he is a bank card holder or not (cash is accepted for this purpose);
  • there is no unnecessary fuss with documents (a passport, for example, is not required);
  • terminals and ATMs are present in almost all public places - the same government agencies, banks, shopping centers, supermarkets, etc., which makes access to them as easy as possible, because there are also queues due to the prevalence of terminals and ATMs, as well as due to the unification there are almost no terminals between different banks;
  • terminals and ATMs support a wide range of services that they provide in mobile mode;
  • commissions in terminals and ATMs are either absent or their size is minimal;
  • usually work around the clock;
  • terminals and ATMs guarantee the reliability of all transactions, since payment acts are registered in an electronic database, plus a check (receipt) for payment is issued to the client.

Payment of state duty through Sberbank-online

After registration, an online payment service will be available on the site. Here you can pay fees for the following government services:

  • registration and divorce;
  • issuance of a visa and foreign passport;
  • registration of a Russian passport;
  • traffic police fines, obtaining or restoring a driver’s license;
  • services of Rosreestr and BTI.

To transfer money you must follow the following procedure:

  1. Log in to Sberbank online by entering your user ID, permanent and SMS passwords.

  2. Select the “Transfers and Payments” tab.

  3. Find the appropriate agency with which you need to make a settlement.
  4. In the case when the client does not know where exactly to look for the recipient of the tranche, you can use the selection function: enter the payment data in the search bar of the system - name, category of service, tax identification number or current account of a government agency.

  5. In the payment form that appears, you must enter all the necessary details. To do this, you should obtain this data in advance from employees of the relevant state-owned enterprise.

  6. You should double-check the entered data carefully and more than once, otherwise the money may go to a completely different place. Then the bank, of course, will return them, but for this you will need to perform some actions and spend time.
  7. After making sure that the payment order is filled out correctly, click the “Confirm” button and enter a one-time or SMS password in the window that appears. That's it, the money transfer has been completed.

  8. If you still have any questions about making a payment, you can call a single phone number at any time of the day, and a specialist will definitely advise you on the further course of action.
  9. After making the payment, you can print the receipt by clicking the appropriate button (“Print”). This document will need to be presented to the relevant department as proof of payment of the state fee.

And don’t be afraid to do something wrong - you just need to carefully enter the details, and the payment will definitely reach its addressee. Having completed such an operation once, you will gain experience, and in the future, paying through Sberbank’s online system will be as easy as calling by phone.

What to pay attention to

When funds are debited from a bank card or cash is deposited, the ATM/terminal issues a check or payment receipt indicating the amount, type of payment and recipient. This piece of paper is a document confirming that a person has actually paid the state duty or fine. The check/receipt must be attached to the general list of documents. For example, when filing an application in court. Problems that arise when a person is about to pay a state fee, a private fee or a fine are almost always associated with the inattention of the client himself:

  • simple error when entering data. The check will be invalid - you will have to pay for a new one, since the money from the first transaction will take a long time to be returned;
  • The recipient's details are incorrect or incomplete. The check is also invalid, and money can only be returned through the bank upon presentation of a passport and writing a return application;
  • It happens that a third party pays for a client and incorrectly indicates their data. The consequences are the same. A third party has the right to pay for a client only if a notarized power of attorney has been issued for this same person;
  • Errors in indicating the type of payment, i.e. to whom, where and for what, and in indicating the amount are unacceptable;
  • Since the check/receipt is a piece of paper, it can be lost. But the client has the right to receive a supporting document at a bank branch upon presentation of a passport.
