Functions of the Moscow Housing Inspectorate during the redevelopment of apartments
A significant part of the activities of the housing inspection of the city of Moscow is the coordination of work on the redevelopment and reconstruction of apartments.
As part of this activity, the Moscow Housing Inspectorate performs the following functions:
- Reviews documents submitted for approval of repair work.
- Makes decisions on the possibility/impossibility of performing work based on the submitted documentation.
- Issues documents permitting redevelopment or reasoned refusals to approve it.
- Monitors the work performed and issues certificates of completion of redevelopment/reconstruction.

The Moscow Housing Inspectorate often receives applications and letters from city citizens. The reasons for complaints from the population can be very different.
Most often, residents turn to the state housing inspection for the following reasons:
- the entrances of the houses have not been repaired for more than five years;
- the management company does not properly fulfill its obligations;
- the fact of illegal redevelopment of the premises was revealed;
- Incorrect calculations were found in receipts for utility bills, including for heating;
- the fact of illegal transfer of residential premises to non-residential premises was revealed.
Owners of premises in an apartment building have the right to safe and favorable living conditions. Article No. 161 of the Housing Code of Russia establishes general requirements for the activities of organizations managing a house (MC and HOA). If these companies do not take measures to ensure the safety of residents and eliminate violations, then citizens have the right to complain to the Housing Inspectorate.
This is stated in Federal Law No. 59 “On the procedure for considering appeals from citizens of the Russian Federation” dated May 2, 2006. What redevelopment will be approved by the Moscow Housing Inspectorate?
In order to understand what kind of redevelopment can be agreed upon, at the initial stage, it will be necessary to determine the compliance of the upcoming/completed work with current standards. Documents for approval of redevelopment in MZHI
If the selected or already implemented redevelopment option can be agreed upon, the possibility of obtaining permission for the upcoming redevelopment or legalizing the work performed, a set of documents must be collected, which can be found in detail on the official website of the Moscow Housing Inspectorate or in the redevelopment section on the city government services website.
The set of documents required to obtain permission from the housing inspectorate for reconstruction (redevelopment) may differ depending on the scope of work. In addition, the composition of the documentation required to coordinate planned and completed redevelopments also varies.
- In the case of a fairly simple redevelopment, in most cases, you can do without developing design documentation and coordinate the work according to the sketch.

Redevelopment can be considered finally agreed upon (legalized) only if a commission including specialists from the Moscow Housing Inspectorate accepts the object and provides the applicant with a certificate of completion of the redevelopment of the premises.

What does the Moscow Housing Inspectorate check after redevelopment?
Representatives of the housing inspectorate check the actual compliance of the object and the agreed project documentation. If inconsistencies are detected, the Moscow Housing Inspectorate will issue an order to eliminate the violations or require approval of the repair work again, taking into account all changes
To accept hidden work, the commission is provided with inspection certificates for hydro- and sound insulation and, if necessary, for strengthening the opening, signed by a contractor who has the appropriate SRO permit for construction work and by a design organization that carries out supervision over the execution of the project.

In addition to coordinating repair work, the responsibilities of the Moscow Housing Inspectorate include considering complaints about illegal redevelopment. Based on citizens' requests, the housing inspectorate checks the legality of the repair work being carried out. If redevelopment is discovered without the appropriate permission, the violator will be issued a fine and an order to eliminate the violations.
The work will have to be stopped until it is approved or the apartment (or non-residential premises) must be returned to its original condition at your own expense.
State housing supervision body - legislative framework
What is state housing supervision?
To understand what a state housing inspection (GHI) is, you should turn to the law on the basis of which it was created.
- The first law aimed at creating such a structure was the federal law “On the State Housing Inspectorate of the Russian Federation.” It was adopted in September 1994 and was periodically changed and supplemented.
- The document acquired its final form in June 2013, when the previous edition was abolished.
According to this law:
- a new name was assigned to the structure - “state housing supervision authority”;
- the inspection began to act as a separate unit of OGZHN, carrying out work on the territory of the constituent entities of the Russian Federation;
- the responsibilities and tasks of the structure, as well as the procedure for their implementation, were spelled out.
- The concept is also reflected in the Housing Code.
Regulations on the State Housing Inspectorate
Article 20 explains the term OGZHN as a structure of the executive power that must prevent, identify and suppress violations by “state authorities, local governments, as well as legal entities, individual entrepreneurs and citizens” of the legislation of the Russian Federation related to housing and communal services issues.

What issues are not within the powers of the State Property Committee?
The chairman of the executive committee of the State Property Committee can order inspections for all types of violations, except economic ones. Thus, the inspection does not have jurisdiction over issues related to the use of residents’ funds by management companies or homeowners’ associations. Everything related to the financial activities of the management company falls under the powers of law enforcement agencies and the Federal Tax Service.
As noted above, public housing estates are also responsible for their actions. The illegal actions of the departments of the Civil Housing Inspectorate are indicated in the departmental Regulations on the Service.
