Purpose of stamping

The fact of the emergence of a new “family” is confirmed by a marriage registration certificate, as well as a corresponding note in the passport. Despite the fact that the seal does not replace the original certificate, it has a number of important functions:

Confirms marital status in the absence of a certificate.
Determines paternity when registering a child.
Certifies the official status of a citizen.

A man and a woman in a free “civil marriage” are cohabitants. Such a union has no legal force and excludes liability. There are no marks in the personal documents of such citizens.

Where can I include a child in the passport of a citizen of the Russian Federation?

Mandatory or not?

Many believe that in Russian legislation there is no mention anywhere of the obligation to affix a marriage stamp in the passport.
However, this is not the case. In accordance with paragraph 5 of the Regulations on the passport of a citizen of the Russian Federation, marks on registration and divorce must be affixed to the passport by the civil registry office and territorial divisions of the Main Department of Migration Affairs of the Ministry of Internal Affairs. The need for a mark is also mentioned in the decrees of the Government of the Russian Federation.

In this regard, it is impossible to refuse to affix a seal on legal grounds. Despite the fact that no liability has been established for the lack of a stamp, the existing regulations for registering marriage relations cannot be ignored.

However, there are also objective reasons for which it is impossible to stamp:

Despite such situations, registry office employees must accept the application for marriage registration. The decision not to affix a stamp is made by the head of a particular department. In practice, there are refusals to accept applications, which are then appealed by future spouses in court.

The law provides for the use of special inserts sewn into the passport, as well as affixing a stamp on the cover of the document. Some citizens try to hide the fact of marriage by not affixing a stamp. But the absence of a mark in the passport does not give the unscrupulous spouse the right to remarry, since this violates Article 14 of the RF IC.

What does the stamp look like and what page is it on?

It is placed using a special rectangular print, with sides 40 by 70 mm. Is it possible not to put a stamp?

Thus, at the legislative level, there is administrative responsibility for persons who officially declare that they are single, although in reality this is not true. What to do if there is not enough space in your passport?
