The head of the institution is responsible for the state of safe working conditions in his enterprise. Therefore, his responsibility is to operate the labor protection compliance system. One of the elements of this system includes the determination of the person responsible for electrical equipment in the institution. The person responsible for a given production area is designated by an order from management.

Why is this document needed?

The person responsible for the electrical facilities (EE) of an institution is formalized by order of management and is one of the first mandatory documents of an institution that consumes electricity. When inspecting an institution, Energonadzor employees first check this order.

There are circumstances when an institution may not issue an order to appoint a person responsible for electrical safety (ES), for example, when the institution does not have permanent electrical equipment. In such cases, the manager may impose these responsibilities on himself. A copy of this order is presented when visiting Energonadzor.

However, such circumstances are very rare, because even an ordinary office is equipped with a refrigerator, copying equipment, etc., and these devices are related to stationary electrical installations (ES), so it is better to issue an order on the person responsible for the safe maintenance of electrical equipment.

Who can become responsible

OE can be a specialist who has the 4th group of approval for electrical equipment operating under voltages up to 1000 V, and the 5th group - under voltages over 1000 V. He can be appointed part-time, and he must be on the staffing list of the administrative and technical department institution services.

If the enterprise is small and there is no power engineer on staff, then the boss can assign responsibility to himself or his deputy, provided that a 220-volt power supply is installed. In this case, written consent of the local Energonadzor structure is required to complete the necessary application-obligation without passing exams. (Appendix No. 1 to the Rules).

When inputting 380 V, it is required to either hire a professional or invite a specialist from a third-party agency who has the appropriate permit for electrical service.

The appointment of a person responsible for electrical installations is carried out after passing exams to assign the required admission group to electrical installations:

  • Group IV – for power plants with voltage up to 1000 V.
  • Group V – for power plants with voltages over 1000 V.

To obtain group 4 access to electrical services, training courses have been organized at Energonadzor. In this case, you must first pass exams for assignment to the 2nd and 3rd groups.

The appointed person responsible for the electrical facilities of the institution is required to maintain the following documents:

  1. Order from the management of the institution on his appointment.
  2. A record book for testing knowledge of standards and Rules for operating electrical installations.
  3. Book for issuing protective equipment against electric shock.
  4. A photocopy of the document from the meeting of the examination commission.
  5. Certificate for the right to operate the power plant.

Energonadzor employees, when visiting an enterprise, first of all check the availability of the listed documents.

On the recommendation of the designated person responsible for electrical safety in the institution, the manager assigns responsibility for electrical safety to persons working in structural departments.

To coordinate responsibilities between employees responsible for electrical safety, appropriate instructions must be drawn up.

If the founder’s staffing table provides for the position of chief power engineer, then responsibility for the power plant is usually assigned to him.

Why determine who is responsible?

The rules for the technical operation of electrical installations were approved by Order of the Ministry of Energy of the Russian Federation dated January 13, 2003 No. 6 and oblige organizations of any form of ownership, individual entrepreneurs, individuals who own installations with voltages of more than 1000 V, to appoint workers who must ensure that there are no risks during the operation of electrical installations and their rational use.
Those consumers whose electrical installations are below 10 kVA may not appoint such an employee.

How to assign

According to the rules (Order of the Ministry of Energy No. 6), the employer approves by local act from among the managers or specialists the persons who are required to perform functions related to the organization of the use of installations. The staffing structure may include the position of chief power engineer. In this case, this employee will become responsible.

The employer needs to remember that the person in charge must be trained and successfully pass a test of acquired knowledge with subsequent assignment to a specific electrical safety group:

  • V - for working with voltage in electrical installations more than 1000 V;
  • IV - for working with voltage in electrical installations less than 1000 V.

If there is no full-time job

In cases where we are talking about a small organization that does not have the opportunity to hire a full-time specialist, they resort to attracting third-party qualified workers. Moreover, at the main place of work, the responsibility should be the same or exceed that assigned. That is, a specialist who has been certified in electrical safety group 4 and is currently (at his main job) responsible for equipment with a power of up to 1000 V cannot take a part-time job in a company whose equipment has a higher power.

Therefore, ideally, the combination should involve workers certified for the third group in electrical safety.

What to write in the order

In 2021, the main documents regulating activities in this area remain the technical operation rules according to Order of the Ministry of Energy No. 6, as well as the rules for occupational safety during the operation of electrical installations, established by Order of the Ministry of Labor of the Russian Federation dated July 24, 2013 No. 328n. Accordingly, the content and sample of the order appointing someone responsible for electrical safety in 2020 at electrical installations is similar to the previous period. The order must indicate the main employee responsible for electrical equipment and the person replacing him.

What is the order for?

The appointment of a responsible person for electrical equipment is the fulfillment of the requirements set out in the Rules for the Technical Operation of Electrical Installations. They were approved by Order of the Ministry of Energy dated January 13, 2003 No. 6 . The provisions of the Rules apply to all organizations, regardless of their form of ownership, individual entrepreneurs, as well as individuals who own and use electrical installations with voltages over 1000 V.

Workers designated as responsible must ensure the safe use of high-voltage installations and minimize risks to the life and health of employees during their operation.

Responsibilities of the person responsible for electrical equipment

The responsible person performs a wide range of functions. The person responsible for electrical facilities (the requirements for the new 2020 rules are similar to the previous ones) must organize:

  • development and maintenance of documentation required in electrical equipment in accordance with the rules;
  • training, instruction, testing of acquired knowledge, permission to work independently for electrical technical personnel - at least once every 5 years;
  • carrying out work according to the rules in a safe manner, including with the participation of seconded employees;
  • maintenance and repairs in a timely manner;
  • calculation of electricity demand, consumption control;
  • control of PPE and fire extinguishing equipment available in electrical equipment;
  • execution of the established algorithm for access to installations;
  • compliance with the procedure for permitting installations to operate;
  • maintenance and emergency response in electrical facilities;
  • checking the relevance of supply schemes - once every 2 years;
  • updating instructions during operation - at least once every 3 years;
  • control of electrical quality measurements energy during operation - at least once every 2 years;
  • control of employee access to work at installations.

What is he responsible for?

The responsible person, according to the job description, performs the following functions:

  • Maintains and develops documentation that regulates the operation of electrical installations.
  • Conducts training, instruction, and testing of knowledge of technical personnel who are authorized to work with electrical equipment.
  • Conducts all types of work related to electrical installations.
  • Supervise the maintenance of all electrical networks and electrically powered installations.
  • Monitors consumption and calculates the required energy consumption.
  • Participates in emergency response.
  • Monitors instructions and approves new ones every three years.
  • Monitors the advanced training of electrical personnel at least once every 5 years.
  • Once every 2 years, measures indicators that affect the quality of supplied electricity.

Appointment procedure

The appointment is carried out exclusively by order of the head (CEO).

The order is formalized by an order, which must contain information about the appointed employee, and must also include the signature of the person being appointed.

At the very beginning of the order, the name of the organization is indicated in full. The order must also contain a date.

What qualification group for electrical safety should there be?

As for education, for the person appointed responsible in terms of control over electrical installations, it should not be special and relate to an electrical focus.

All necessary training is carried out within 72 hours at Energonadzor courses.

After this, an exam is passed, and the official receives 4 or 5 groups in electrical safety.

It is important that all groups are obtained in sequence from 1 to 4.

This group can be assigned by a special commission of the organization that will take exams from the candidate.

The larger the enterprise, the more responsible persons there should be for electrical equipment.

Each structural unit must have its own employee responsible for the operation of electrical installations.

What are the job responsibilities?

All responsibilities for electrical equipment of the person in charge are specified in the job description. These include:

  • Organize and develop documentation on the operation of all electrical installations in the controlled territory.
  • Responsible for safety during all electrical work.
  • Monitor the level of qualifications of personnel who are allowed to work with electrical installations or emergency work with electricity.

Officials bear personal responsibility in case of emergency situations that occur at work and result in casualties.

Everything related to the safe and correct operation of electrical installations is controlled by responsible persons, and they are also obliged to organize training and courses for personnel working with electrical installations.

List of documents

Of course, the complete list of technical documentation of the person responsible for electrical equipment will vary depending on the specifics of the enterprise, as well as the specific organization.

But there is an approximate list. According to this list, the documentation is as follows:

  • General order for electrical equipment.

  • List of positions that, according to their responsibilities, need to receive an electrical safety group.

What types of magazines should there be?

Any enterprise must have special logs for control, accounting and other details related to dangerous work, malfunctions, various instructions and training.

As for the person in charge, he is responsible for maintaining and storing the following logs:

  • Operational journal.
  • Document about defects and malfunctions of electrical equipment.
  • Journal of work on electrical installations according to the permit.
  • Accounting assignment of 1st electrical safety group to non-electrical personnel.
  • Journal for accounting of protective equipment.
  • Document on recording safety training sessions.
  • Cable magazine.

The responsible employee must comply with the rules for maintaining logs, as well as ensure their storage and integrity.

General order for electrical equipment

Any organization, regardless of whether it is engaged in production or non-production activities, uses electrical equipment in its activities. Accordingly, it is necessary to draw up and publish a general administrative document regulating this area (we will provide a sample of a general order on electrical equipment below).

By issuing such an order, the employer has the opportunity to solve a number of problems:

  • identify persons responsible for the proper operation of the equipment and all electrical equipment;
  • establish the composition of the commission that checks knowledge of standards when working with equipment;
  • appoint an organizer of briefings;
  • give rights to some specialists to issue work orders;
  • establish a list of persons who are required to have a certain electrical safety group;
  • establish an algorithm for storing and providing installation keys, etc.

How to create an order

The form of the order has certain standards, but there are no strict regulated requirements for it, since each specific case may have its own characteristics.

This is due to differences in the activities of different enterprises, therefore, deviation from the standard form is not a strict violation and the document is considered valid if the main points are observed:

  1. Accurate and complete indication of personal data of responsible persons and indication of their positions;
  2. List of duties and rights of responsible persons;
  3. Received electrical safety group;
  4. Date of certification.

The last paragraph of the order usually states that the manager retains control over the execution of the current order, but this responsibility can be entrusted to another person from the management team, for example, a deputy.

Features for manufacturing organizations

At a large enterprise carrying out production activities, it makes sense to draw up a number of local acts (sample order “responsible for electrical equipment” - below) regarding those responsible for a specific area of ​​the area, that is, for example, issue such an order for the boiler room (sample order appointing a person responsible for Electrical equipment for 2021 is given below), if electric boilers are in use.

This approach makes it possible to determine the scope of responsibilities, increase the employee’s responsibility for electrical equipment and performance results.

The institution must have:

  • occupational safety instructions for each workplace where electrical equipment (including PCs) is operated;
  • general plan of the territory with underground electrical communications;
  • technical data sheets of the main equipment.

The legislative framework

In accordance with paragraph 1.2.1 of Order of the Ministry of Energy No. 6 of January 13, 2003, only electrical personnel who have undergone appropriate training can work with electrical installations.

Clause 1.2.3 instructs the head of an organization that is an electricity consumer to issue an order regarding the person responsible for electrical facilities and his deputy. If the state has a chief power engineer, these responsibilities can be transferred to him.

It is allowed to do without a responsible person in enterprises where electrical equipment is limited to:

  • input distribution devices;
  • lighting installations;
  • portable equipment;
  • consumed voltage up to 380 volts.

Then the authority to ensure security in this area falls on the manager. However, he needs to submit an application-obligation in the form from Appendix 1 to the Order in question to the territorial department of Gosenergonadzor (the form can be downloaded at the end of the article).

Sample order for a boiler room

A separate order is approved regarding the procedure for storing technical documentation, since the list of the minimum required consists of 51 items, including, for example:

  • lists of works during current operation;
  • accounting journals;
  • inspection documents, etc.

The procedure for storing these documents is approved by each enterprise separately, but the list of necessary documents must be available and ready to be provided upon request of regulatory organizations.

Manufacturing companies

If an organization is engaged in production activities and has a significant staff, it is advisable to prepare several orders about those responsible for the electrical facilities in each specific area of ​​the production area, for example, issue an order about the person responsible for the electrical facilities of the boiler room (in the case of operating electric boilers). This will make it possible to specify the scope of responsibilities and increase the employee’s responsibility for the results of their activities; in addition, labor protection when performing work on electric boilers is regulated by the Rules approved by Order of the Ministry of Labor dated July 24, 2013 No. 328n.

An order on the procedure for storing technical documentation on electrical equipment is issued, as a rule, separately, since the minimum required list of documentation at an enterprise includes 51 items, which, for example, includes:

  • lists of work performed according to orders, orders, in the order of current operation;
  • production instructions for the operation of electrical equipment and installations;
  • various types of accounting, assignment and registration logs;
  • acts, forms, certificates and protocols;
  • verification documentation, etc.

The procedure for storing this documentation is developed by each employer independently, however, the entire set of documentation must be ready for presentation to inspectors upon their first request.

In addition, each enterprise must have:

  • job descriptions on labor protection for each workplace related to the operation of electrical equipment (including for personal computers, clause 1.8.1. Rules approved by Order of the Ministry of Energy dated January 13, 2003 No. 6);
  • master plan of the territory, which includes underground electrical communications;
  • technical passports of the main electrical equipment.

Features for non-production organizations

The rules associated with the appointment depend on the format of the institution's activities. Thus, an organization can:

  • not engage in production;
  • have electrical equipment that includes only an input (input-distribution) device, lighting installations with a voltage of less than 380 V.

In this option, the employer has the right not to appoint a special employee. However, at the same time, he places all responsibility regarding the safe operation of electrical equipment on himself, having agreed in writing with the local government energy supervision authorities. This can be done by filling out a commitment application without a knowledge test.

The range of organizations that are not involved in production is established by Letter of the Ministry of Energy of the Russian Federation dated February 24, 2004 No. 32-01-05. The document explains that production services include those that are performed using means of labor with a change as a result of the quality of already created products (not the creation of new ones).

Fines for violations

In case of violation of legal requirements regarding the technical operation of electrical installations, including the absence of specially designated persons, the employer may be held liable under Art. 9.11. Code of Administrative Offenses - up to 40,000 rubles, or its activities may be suspended for up to 90 days.

If these violations caused the death of the employee, in accordance with Art. 5.27.1 of the Administrative Code, the manager may be liable in an amount of up to 200,000 rubles or, in accordance with Article 143 of the Criminal Code of the Russian Federation, imprisonment for up to 5 years

Responsibility and penalties for the absence of this person in the organization

According to the Code of Administrative Offences, as well as the Labor Code of the Russian Federation, if the enterprise does not have a responsible person for electrical equipment, then a fine of 110-130 thousand rubles is imposed on the legal entity.

If an emergency or accident occurs at an enterprise that leads to the death of people, then, in addition to administrative liability, there is also criminal liability, up to imprisonment for up to two years.

Controlling organizations must check documents that confirm the presence of a responsible person not only during scheduled inspections, but also in the event of an emergency at work.
