General concepts

The Law “On Military Duty and Military Service” is in force in the Russian Federation. Men between 18 and 27 years old are subject to urgent conscription. The normative act obliges every young man fit for service to bear responsibility for the territorial integrity of the state. This function is realized through military service.

  • Women without a military specialty;
  • Persons in prison;
  • Citizens temporarily residing in the territory of the Russian Federation;
  • Boys and men who received a deferment from conscription.

What are the consequences of hiring without a military ID?

If an applicant for a position does not have a military ID, the head of the enterprise may refuse him, since the law requires the mandatory provision of this document. On the other hand, you can get a job without a military ID. According to Art. 64 of the Labor Code of the Russian Federation, unjustified refusal (infringement on social, national, property grounds) when applying for a job is prohibited.

An enterprise has the right to hire an employee liable for military service to a position without such a document, but it must notify the commissariat about this within 2 weeks (Clause 1, Article 4 of Federal Law No. 53-FZ of March 28, 1998). Otherwise, the organization will be brought to administrative responsibility (Part 3 of Article 21.4 of the Code of Administrative Offenses of the Russian Federation) - a fine of 300 to 1,000 rubles. Information is sent in the form established by the General Staff of the Armed Forces of the Russian Federation and approved in the Methodological Recommendations.

A detailed list is presented in Article 65 of the Labor Code. This list is requested by the employer. Based on them, an agreement or contract is drawn up. Required documents include:

  • Passport of a citizen of the Russian Federation;
  • SNILS;
  • Labor book;
  • Diploma confirming qualifications and special knowledge;
  • Military registration documents (registration certificate or military ID);
  • Certificate confirming no criminal record.

After what age is a military member not needed?

The current legislation specifies the age at which a man ceases to be liable for military service. Today it is 50 years for the civilian population, and 55 - 65 for the military contingent. This age range is determined by the rank and general health of the serviceman.

Until the age of fifty, official work requires the presence of a military man.

Government Decree No. 719 provides for the following documents, which every citizen subject to military service must have:

  • ID or registration certificate (issued to conscripts upon military registration);
  • military officer or temporary certificate in case of its loss (issued to persons who have undergone army training).

Without a military ID, you will not be able to obtain an official position.

Conscript status refers to male citizens from 18 to 27 years of age who are not in the reserves due to health reasons or who have already completed military service. The rest must visit the military commissariat at their place of residence at least once a year to undergo events related to conscription.

If a citizen is not subject to conscription due to health reasons, based on the results of a medical examination, he will be assigned fitness category “B”, and he will be enlisted in the reserves. This circumstance does not relieve him of the obligation to present a military ID at the request of a potential employer during official employment.

Each organization is required to annually provide information to the military registration and enlistment office about employees whose age ranges from 18 to 50 years. Otherwise, administrative liability will be imposed on the organization in accordance with the seventh article of the Civil Code of the Russian Federation.

You can get a job without a military ID if the citizen received a deferment on legal grounds. The law provides for many situations when it is possible to obtain an exemption from duty.

Deferment is possible for the following categories of citizens:

  • Have not passed the medical commission;
  • Students of universities, secondary vocational schools, colleges;
  • Men with two or more children at the time of enlistment;
  • Citizens with a pregnant wife (from 26 weeks);
  • Those involved in caring for sick relatives;
  • Work in the police, Ministry of Emergency Situations, fire service in case of graduation from specialized educational institutions.

In addition, it is necessary to take into account the age characteristics of employment. Men over 50 years of age are not required to provide a ticket. This requirement does not fully comply with the legal framework. Only citizens under 27 years of age are subject to conscription.

It is also not necessary to provide a military ID if the placement is carried out under a civil contract. This design option differs from the one described in the Labor Code of the Russian Federation. When accepting under such a contract, you do not need to provide a military ID. The agreement is drawn up on the basis of the passport and other documents.

If this information is needed exclusively when applying for a job, then the information in the T-2 personal card will be sufficient.

What is required to obtain a military ID?

This document can be issued to a citizen under the following conditions:

  • military service;
  • enlistment into the reserves without military service (if there are medical contraindications or unfavorable family circumstances, in their absence they will definitely be accepted into the army);
  • if a citizen has a higher education, and there was a military department at the university, then upon graduation from the educational institution he receives a military ID and the rank of lieutenant. In this case, they may not be accepted into the army.
