Why might a car be impounded?
An arrest involves the imposition of a ban on the disposal or use of property belonging to the debtor (defendant, suspect, accused), and in some cases the seizure of such property.
A car, like any other property, can be subject to seizure. Accordingly, registration of transactions with it (for example, purchase and sale) while under arrest is impossible.
The court or bailiffs can impose an arrest. It should be understood that the seizure of property is not a punitive measure. The main purpose of the arrest is to ensure the execution of a court decision to collect the amount of debt from the debtor, confiscate property, etc.
The car will be released from seizure if the grounds for its imposition are removed. For example, there is no need to apply arrest if the debtor has fully repaid the amount of debt.
As for the reasons for the seizure, there may be several of them. The most common:
- the owner of the car has a debt on a loan, for utilities, etc., the collection of which is carried out by bailiffs according to a writ of execution;
- initiation of a criminal case against the owner for crimes, as an additional punishment, for which confiscation of property is provided;
- filing a civil claim against the owner for debt collection, damages, or if the subject of the dispute is the car itself.
How to check if property has been seized
Finding out about a car seizure is very easy. But it is almost impossible to make sure whether it is in the bank as collateral or not. There is no single State Traffic Safety Inspectorate database for this case, and banks will never agree to reveal the secrets of their clients.
You can check the seizure of property on the bailiffs website using the link. Employees of the Federal Service on their website posted data on the arrests of those cars whose data have not yet been sent to the traffic police. On this site you can also find out everything about the debts of the property owner .
It is important to know that if the purchased car is seized, the buyer will not be able to re-register it in his name. He can only hope that the former owner of the car will pay all debts and the arrest will be lifted.
The bailiffs' resource contains information not about the seized property, but specifically about the debts of its owner. Therefore, if the trial has not yet been completed, data on the property of interest will not yet be there.
In order to find the necessary information on this site, you need to know the name of the owner and the place where the car was registered.
Ways to check a car for arrest and restrictions
There are many services that allow you to obtain information about a car, fines, and transactions with it. Such information can be provided by both public authorities and private organizations. The most famous state information resources are:
- service of the State Traffic Safety Inspectorate of the Russian Federation;
- service of the FSSP of the Russian Federation.
In addition to these resources, information about the car can be obtained on the portal of the Moscow government (for residents of Moscow and the Moscow region), on the website of the Russian Union of Auto Insurers, etc.
By VIN code
A VIN code is a unique vehicle identifier that is known to a limited number of people. Therefore, most services use it to check seizures, restrictions and obtain other information.
For example, to check using the traffic police database, you need the VIN code.
By license plate
With only the license plate information available, checking to seize the car is impossible.
However, by entering the car number on the traffic police website in the request field, you can find out, for example, about the presence of fines imposed on the owner for traffic violations. At the same time, knowing the car number, you can use the database of the Union of Auto Insurers to find out the VIN code:
- On the website of the Union of Auto Insurers, enter the car number in the request form. The service will indicate the MTPL policy number.
- Open the “Information about insured vehicles” tab and enter the policy number in the request form. The service will indicate the vehicle's VIN code.
Ways to check a car for arrest
To find out about the availability of arrest sanctions, you should send official inquiries to the State Traffic Safety Inspectorate and the Federal Border Guard Service. In addition, you can check the seizure of a car, receiving information about the vehicle’s encumbrances, online. This verification method involves obtaining information about the vehicle contained in electronic databases posted on the websites of the State Traffic Inspectorate and the enforcement service.
Check on the traffic police portal
The status of the vehicle can be checked on the official website of the State Traffic Inspectorate of the State Traffic Safety Inspectorate.rf. To do this, you need to open the “Services” section, and then select the “Vehicle Check” subsection. Next, the service user should indicate the VIN code of the car in a special column, and then select the desired type of check (checking for restrictions). After processing the request, the system will inform the user about the absence of restrictions or provide information about their presence. The information about the restrictions provided assumes the following information:
- Car model;
- year of issue;
- date of imposition of the restriction;
- region of restriction;
- name of the authority that imposed the restriction;
- type of restriction.
In addition to restrictions, the traffic police database allows you to check whether the car was reported stolen and find out the history of fines.
Check with bailiffs
Most often, a car is seized by the FSSP. This restriction implies a prohibition of registration actions. To check a vehicle for restrictions imposed by bailiffs, you should go to the official website of the FSSP and select the “Services” section, and then go to the “Data Bank of Enforcement Proceedings” subsection. In the search form, the service user must indicate the details of the persons who are or were the owners of the car.
Based on the results of processing search queries, the system will generate lists of enforcement proceedings initiated against car owners.
We offer you to read an article that will tell you about buying a car seized by bailiffs.
How to check a car for arrest on the traffic police website
All data on prohibitions on registration actions, as well as the arrest of vehicles, is accumulated in the State Traffic Safety Inspectorate of the Russian Federation, because it is this government body that is authorized to carry out registration actions with cars. For the convenience of citizens, the State Traffic Safety Inspectorate website has a service for checking cars based on restrictions on registration actions.
After opening the service, in the “Vehicle Check” window, enter the VIN code. Checking is also possible using the body or chassis number. From the four check types below, select the last one: “Check for restrictions” and request a check.
If the data entered by the user matches the number (VIN code) in the database of the State Traffic Safety Inspectorate of the Russian Federation, the service will indicate that restrictions have been imposed on the registration of this vehicle or that it is under arrest. If there is no such data in the database, then the user will receive information that there are no matches, therefore, the car is free from arrest and restrictions.
How to check a car arrest
There are several ways to check a car for arrest. And the easiest way is to check with the traffic police. You don't even need to go to the nearest branch to do this. You just need to visit the inspection website www.gibdd.ru. In the right corner there is a Vehicle Check function. Here you just need to enter the minimum data on the vehicle (chassis number or VIN code) and the data on the car will be opened.
There you can see whether an arrest was made and what fines were applied to the owner of the car.
But here you can only find data about those cars, information about which has already been received by the traffic police. If the trial has not yet ended, this vehicle will not be found there.
Check on the bailiffs website
Unlike the traffic police, the bailiff service does not take into account cars, but debtors. When opening the FSSP debtor verification service, you need to enter the following data:
- citizen's full initials;
- date of birth;
- region of residence.
If enforcement proceedings are being carried out against the debtor, the FSSP RF service will provide information about the amount of debt and the restrictions imposed.
We recommend checking the car using both services, since only together they can provide comprehensive information regarding the arrest or restrictions on a specific car.
What information can be obtained during verification?
In addition to data on the presence of arrest or restrictions, the information services of the State Traffic Safety Inspectorate of the Russian Federation and the Federal Bailiff Service of the Russian Federation provide other useful information.
So, for example, by finding the owner of a car in the list of debtors, you can find out some information about the collectors and the amount of the debt. This will determine the seriousness of the claims against the debtor. If the debt is significant, then the likelihood of seizure of the car is high. It is also possible that the owner has a debt, restrictions on the property have already been imposed, but the information on the traffic police website has not yet been updated.
As for the traffic police service, using it, you can find out about the number and amount of unpaid fines, previous transactions with the car, its participation in an accident, as well as whether the car you are looking for is wanted or not. All this information is also available by specifying the vehicle's VIN code in the request field.
The procedure for seizing a car
A car is seized if some persons (or legal organizations) have monetary claims against the owner of the car. This could be either non-payment of a loan debt or arrears of alimony .
There can be quite a few reasons for this. Russian legislation regulates this situation.
So, a car can be seized in the following cases:
- if it was imported across the border illegally, or all necessary fees and duties have not been paid;
- if the debtor’s property (including movable) was seized by bailiffs;
- if the owner has been sued in a civil case;
- property may also be seized for tax evasion;
- the vehicle may be detained if the owner does not comply with traffic rules.
The Federal Law “On Enforcement Proceedings” contains articles that regulate the rules for seizing a car that is pledged to a bank.
It is important to know that many banks avoid going to court. There are several reasons for this. One of them is very banal - it is much more profitable for lenders to extract as many fines and other sanctions from the borrower as possible . In addition, banks do not want to spend extra money on legal fees.
A case is brought to court only as a last resort, if the borrower does not cooperate and does not want to repay the debt. In most cases, the court decides to seize the car.
But the seizure of property (including a car) does not mean that it will be immediately taken to the parking lot. The car may simply be sealed or prohibited from using it.
Also, in such cases, an inventory of the vehicle is always carried out. It is carried out in several stages:
- drawing up an inventory report, which should indicate technical data about it;
- drawing up an additional application;
- The supplement indicates the condition of the vehicle, as well as the presence of defects.
But the law says that the vehicle can be sent to the impound lot. This ensures its more reliable safety.
There are cases when such a seized car is bought by a person who does not suspect anything. He honestly paid a lot of money for it, but now he can neither register it nor use it.
How much does a check cost?
On the websites of the State Traffic Safety Inspectorate of the Russian Federation, the FSSP of the Russian Federation and the Union of Auto Insurers, you can check your car for free.
No registration is required to use these resources. On other services you will have to register or pay for the information provided.
