According to the Federal Law “On Insurance Pensions” No. 400 F3, the period of caring for a pensioner over 80 years of age is counted in the insurance period if the carer worked previously or went to work immediately after that. The caregiver can be a relative, acquaintance, or neighbor of the pensioner—there are no restrictions in the law on this issue. The main thing is that he resides on the territory of the Russian Federation. Also, cohabitation is not required - even registration can be in different areas or cities.

At the same time, they cannot arrange care for an elderly person:

  • pensioners - pension is equal to income;
  • persons who are undergoing military service in the army;
  • individual entrepreneurs, even if they temporarily have no income.

Who can care for an elderly person

The legislation does not establish restrictions based on family or social status for those who want to provide care for older people. Such a person could be:

  • relative of the ward;
  • his neighbor;

Requirements for a caregiver

A person applying for appointment as a trustee must:

  • Be a citizen of Russia. An additional condition is permanent residence in our country.
  • Have an age of at least 14 years and no more than the general civil retirement period (in 2021 this is 55.5 years for female candidates and 60.5 for men).
  • Do not have a job or other sources of income. The obligations of a trustee to his ward include:

  • Purchasing groceries and other necessary goods (in this and other items on the list, costs come from the pensioner’s funds).

How to arrange care for an elderly person over 80 years old?

The pension fund considers the application within 10 days, but the payment is assigned from the month in which the applications were submitted, but not earlier than the day the right to compensation arises. That is, if an application was submitted to provide care for a pensioner over 80 years of age on April 29, compensation will be received for April in full (1,200 rubles). Current legislation does not introduce a definition of the concept of “guardianship over an elderly person with the right to inherit his property.” This means that automatic inheritance of the ward’s housing by the person caring for him is not expected. If an elderly pensioner independently decides to leave his property (part of it) to an able-bodied assistant as an inheritance, then it is necessary to write a will.

For caring for elderly people over 80 years of age, compensation of 1200 rubles is paid. The amount is established by the President by Decree No. 175 of February 26, 2013. The age limit for citizens caring for the elderly is legally limited. This opportunity is available to Russians who are already fourteen years old. For such a group of young people, it will be necessary to confirm the consent of the parents and the guardianship and trusteeship authority for the provision of such a service.

Caring for a grandparent over 80 years of age involves a simple registration procedure. Helping the elderly and disabled requires a certain psychological endurance and skills, representing self-sacrifice to the detriment of one’s interests. When appointing an assistant, preference is usually given to relatives and friends. To begin the procedure, the ward gives the person caring for him written consent to receive and pay for such assistance.

By the way, there are no legal restrictions on the number of people you can care for. It could just be your grandma or 3 elderly neighbors. In this case, payments for each are made separately, and length of service and pension points are awarded as for one.

Example. Sirotina arranged care for her grandmother. A year later, 2 more elderly neighbors were included in the number of people under care. How will this affect pay and length of service? The remuneration will increase 3 times, i.e. instead of 1,200 they will pay 3,600 rubles. per month, but the experience and points will be the same as when caring for 1 grandmother (1 year of care = 1 year of experience, for each year - 1.8 points).

To accrue length of service, there is one important condition - before or after registration of leave, a person must work at least for some time. The lack of official work deprives you of such a preference.

There are payments for care, albeit not large ones. They are made monthly. Some are interested in who exactly will receive the money. Financial assistance is transferred to the pensioner along with the pension. And only then he himself gives all or part of the money to the caregiver - depending on your agreement (a pensioner can keep the entire payment for himself, for example, if a student grandson takes care of his grandmother and leaves her money as additional financial assistance).

By the way, if desired, a pensioner can pay extra for care from his own money - it’s up to him to agree.

The legislation strictly defines the requirements for a caregiver, a list of categories of persons whose care allows them to receive additional remuneration. But the list of responsibilities in each specific case is determined individually. Moreover, no one will conduct an inspection.

Difficulties usually arise if the care agreement assumes that the pensioner will actually be cared for. When entering into such a relationship, remember that the older person may require more services than previously determined. For example, if additional funds are needed to recover after surgery. If you don’t want to spend even more money, terminate the previously concluded care agreement by contacting the Pension Fund (the consent of the other party is not required).

The assignment of payments is within the competence of the Pension Fund. Therefore, registration takes place through its territorial office (contact the department where the pensioner receives his pension). How to apply for care benefits for a pensioner over 80 years of age?

Absolutely anyone can provide care for the elderly and disabled. As a rule, in most cases, assistance to the elderly is provided by a relative. However, if relatives are absent, for certain reasons they cannot or do not want to care for elderly people, such responsibilities can be assumed by any citizen who agrees to this and with whom the elderly person has reached an agreement.

A citizen caring for a pensioner over 80 years of age receives an insurance period. This rule is established by clause 6 of part 1 of article 12 of the Federal Law “On Insurance Pensions”. However, it is observed under one condition - before taking on caregiving duties, the citizen had to work. At the same time, the employer had to pay the insurance premiums provided for by the current Russian legislation for the worker during periods of his work. In other words, if a person has not worked a day and has no insurance experience at all, then he will also not be accrued experience for care. Whether the citizen had a break in his service does not matter; the very fact of its existence is important.

Citizens helping the elderly are entitled to compensation for caring for an 80-year-old pensioner, a disabled person or a disabled person who has reached retirement age. It is established at the federal level, so its size is the same throughout the country and amounts to 1,200 rubles as of 2021.

The care allowance is paid to the pensioner for whom it is provided in the form of a pension supplement. What part of the money received as compensation the pensioner decides to transfer to the caregiver is determined by agreement of the parties. So, all the funds may be transferred to him, or nothing may be transferred at all. The law does not regulate relations directly related to this.

So, the benefit is really “merely”. But if you provide care for several grandmothers at once, you can receive several thousand rubles a month - the number of grandmothers is unlimited. Plus, the assistant receives insurance experience and pension points. And if you provide care in good faith, you’ll see that your grandmother will throw something else on top of the allowance. An additional payment for housing and communal services is assigned to pensioners whose monthly income is less than the established minimum in the region of residence. To apply for a benefit, you must contact the social security authority and submit a corresponding application. You can also use (MFC) or the government services portal.

The amount of compensation is calculated individually and is determined depending on the total family income, as well as the amount of payment for the use of services. This benefit is issued only if the following conditions are met:

  • the residential premises (house or apartment) are owned by the pensioner or rented by him in accordance with the rental agreement;
  • the amount of rent exceeds 22% of the total income of all family members registered in this living space, or from the pension benefit;
  • absence of debts on utility bills and their timely payment.

According to the legislation of the Russian Federation, any able-bodied citizen who does not have an official place of work can care for an elderly person. The type of payment in question is not subject to indexation, so its size remains the same - 1,200 rubles.

The amount of the additional payment is included in the pension benefit and can only be disposed of by the pensioner himself, according to an agreement between the parties. Compensation is assigned based on an application, which must be submitted through the territorial department of the Pension Fund. In regions where there is an increasing coefficient, the amount of compensation may be greater.

In accordance with the law, all residents of apartment buildings are required to make monthly payments to a special account, the funds of which will subsequently be used for major repairs.

Elderly citizens who have reached the age of 80 are completely exempt from this obligation. But in addition to age criteria, an applicant for benefits must meet the following conditions:

  • be the sole owner of the property;
  • live alone or together with non-working spouses (other relatives) of retirement age;
  • have no arrears in paying for housing and communal services.

This type of benefit is established automatically and is accrued from the month following the date of birth. When a pensioner reaches the age of 80, the size of the fixed payment to the insurance pension doubles and in 2021 will amount to 12,088.96 rubles (6,044.48 × 2). If there are dependents, the amount of the supplement increases. Only recipients of insurance payments can count on an increase in pension after 80 years of age.

The legislation of the Russian Federation provides for the following types of medical benefits when a person reaches the age of 80:

  • free medical examination;
  • preferential prosthetics;
  • social allowance for paying for additional care services, purchasing medications, treatment in sanatoriums and travel to their location.

Territorial authorities also provide assistance to elderly residents of the regions, in accordance with the legislation of the subject of the Federation. It can be:

  • additional monthly payments;
  • compensation for landline telephone payments;
  • discounts on housing and communal services (garbage removal, for example);
  • other privileges established on the basis of regulations of a particular region.

To receive benefits, a citizen must not only reach the specified age, but also be the owner of a certain status - a rehabilitated person, a participant or disabled person of the Second World War, a home front worker, a labor veteran.

Federal legislation states that cash payments in the form of compensation for caring for elderly people over 80 years of age are entitled to receive citizens of the Russian Federation who are in working condition and who, at the time of registration of compensation and while caring for disabled and elderly people, will not be able to work. During care and cash payments, the caregiver will not receive unemployment benefits, as well as a pension, if there are grounds for the appointment.

When applying for benefits for the care of 80-year-old citizens of the Russian Federation, the guardian is not required to be related to the ward, and can also live at a different address. If a guardian takes care of several disabled citizens, then the benefit is accrued for each ward. Federal law does not prohibit the presence of several guardians per guardian.

To qualify for elderly care benefits, the person must be over 80 years old. But it also applies to people who need to care for:

2. Students. The scholarship is paid in full and is designed to cover expenses associated with study - transportation, food, purchase of notebooks and other materials. There are no contributions to the tax or pension fund. Therefore, even if you have a scholarship, you can still receive benefits.

3. Minors. In accordance with the law of the Russian Federation, minors are prohibited from working. But they can take care of their elderly relative. To do this, they need to obtain permission from their parents, as well as from the guardianship authorities.

  • Statement from the person who will be caring;

Patronage services are provided on a first-come, first-served basis:

  • victims of the Chernobyl nuclear power plant;
  • spouses of people who died in the Second World War;
  • victims of political repression and rehabilitated citizens.

If they have the necessary documents, the above citizens can count on medical and social support and care free of charge. The decision to provide such a service as home care for the elderly is made by a special commission that checks the availability and accuracy of documents and assesses the actual condition of the person.

However, social services have the right to refuse to provide services to people who have indications for inpatient treatment - in this case, hospitalization is indicated, and care for the elderly person is provided in a specialized institution.

Such indications include:

  • mental illnesses and disabilities that may affect a social worker caring for the elderly;
  • alcoholism and drug addiction;
  • severe infectious diseases that must be treated in closed medical institutions;
  • the presence of sexually transmitted diseases and quarantine-type diseases.

Important! Elderly people who have been denied services at home can apply for patronage in a private institution. But it should be remembered that such assistance will be provided for an additional fee.
