To become officially unemployed, you need to bring the following documents to the employment center:

  • passport;
  • work book;
  • certificate of earnings for the last 3 months, issued by the last official employer;

So, if the offered salary is lower than the average salary in the previous place (a certificate of average salary for three months must be submitted when applying to the Labor Center), then the job is considered unsuitable. True, there is one “but”: if your average salary at your previous job was above the subsistence level, then a job with a salary even equal to it will be considered suitable, today it is 10,286 rubles.

Thirdly, your health status, limitations and indications for work, if any, are taken into account. However, they must be confirmed by official medical certificates.

And finally, fourthly, the transport accessibility of the workplace is taken into account. This criterion is determined directly by the employment service, taking into account the development of the transport system of a particular area.

What happens if you accept a vacancy offered by the Employment Center?

If you are hired, then within five days the employer must return a letter to the Employment Center indicating the date you were hired.

If there are no vacancies suitable for your professional training on the labor market, then, with your consent, you may be offered work in a related profession, participation in community service, or invited to a job fair or career guidance.

If, after 10 days from the date of registration, the Employment Center was unable to offer you a suitable option, then starting from the day you submit your documents, you will be officially recognized as unemployed.

Can they not be recognized as unemployed?

They can. This happens in the following cases:

  • if you refused two proposed options for suitable work (including temporary ones) within 10 days from the date of registration;

An offer of employment is unsuitable in one of the following cases:

  • working conditions, which include new vacancies, do not comply with Russian labor legislation (all working conditions must also be specified in the work contract);
  • the salary that the employee is offered at the new place is less than the average monthly salary at his previous job.

Regarding the last point, the salary at a new job also cannot be less than the minimum wage established at the regional level or at the place of residence.

How to formalize a refusal for an objective reason

If an applicant comes for an interview and does not like the position offered, he can refuse it and not lose the right to benefits - but only if he does everything in accordance with the procedure. The refusal will be recorded by the potential employer in the direction issued by the employment center, and then certified by the signature and seal of the organization.

The interview follows a certain procedure:

  1. Ask the service inspector for a referral for an interview with a specific employer and agree on the exact time of the interview.
  2. During a meeting with a potential employer (3 working days are given), find out all the nuances regarding job responsibilities.
  3. If the vacancy is not suitable, voice your decision to the manager. The direction will indicate the reason for refusing the vacancy, the signatures of the unemployed and the employer, and the seal of the organization. Also, the director may refuse to employ an unemployed person if he does not meet the criteria established for the applicant.   4. The form is submitted to the employment center.

How can you refuse a job that you simply don’t like?

  • a position with a salary below the subsistence level;

Law No. 1032-1 provides for punishment for refusing a suitable vacancy - deprivation of payments for a period of 3 months
