Is it possible to find out who is registered in the house?

Check through Rosreestr

Check

The realities of today are such that, having access to the Internet, it is easy to obtain the necessary information, especially if you know where to focus your searches. The effectiveness of this method is debatable. After all, with its help it is impossible to find out how many people are registered in the living space.

The first step is to find the Rosreestr website ( https://rosreestr.ru/ ). This is a very convenient information resource that allows you to find out about encumbrances at your place of residence. In addition, there is no charge for searching and obtaining information. The method can easily be considered free. It allows you to find out how many people are registered in an apartment or house.

For example, if for a citizen seeking information the speed of obtaining information is important, then you need to contact organizations that provide this kind of information for a small fee.

Firms dealing with housing issues can freely obtain information from those databases that the average person has no access to. When contacting such organizations, it is worth considering important points:

  1. There are a large number of information resources that do not provide truthful information. They are created by scammers who take money for information, but provide incorrect data.
  2. The very existence of these resources is contrary to the law. According to the document, personal data must be protected, and if access to it is free, this is a direct violation of the rights of citizens. Receiving information should be limited, that is, either the apartment owner or an authorized representative has the right to do so. In the latter case, a document certified by a notary is required, stating that the citizen is acting on behalf of the owner.

How to Find Out Who is Temporarily Registered in My Apartment

What is temporary registration?

The law interprets the concept of temporary registration as one of the types of registration of citizens at their actual location. Such registration is mandatory if a person leaves his place of residence and is in the following circumstances:

  • stays in a sanatorium for recovery or treatment;
  • serving time in prison;
  • if this is a student and lives in a dormitory;
  • went on a business trip for an extended period of time;
  • moved to another region.

Who can it be provided to?

The owner of a residential premises has the right to provide temporary registration to any person, regardless of the degree of relationship.

Moreover, the law directly obliges citizens who temporarily reside at the address of the owner of an apartment or house to register.

If housing is rented out and the tenants have not received temporary registration from the owner, then they face a fine of 2,000–5,000 rubles. In addition, there will definitely be problems with the tax authorities.

Carrying out registration activities for the owner is completely free. Registration of temporary registration at the place of residence is most often associated with the following factors:

  • placement of young children in a preschool institution or school;
  • receiving medical care;
  • registration of children's social benefits, pensions;
  • employment.

Upon receipt of temporary registration, a person receives all the rights of a permanent resident, with the exception of the right to dispose of real estate.

Why temporary registration of foreign citizens is dangerous for the owner - 2021, registration, registration, registration

In accordance with the current legislation of Russia, foreign citizens have separate rules for staying on the territory of the state.

Any citizen of another country, regardless of whether he comes to the country under a visa-free regime or with a visa, must register with the migration authorities, and he must do this within the first three days after arrival. After this, the citizen is given a week to obtain temporary registration.

In this regard, most foreign citizens try to register in the apartments of people living in Russia, but at the same time, many apartment owners often wonder why temporary registration of foreign citizens is dangerous for the owner and how registration is carried out in 2021.

How to find out who is registered in an apartment by address

In some cases you have to act radically. How to find out who is registered in the apartment? It has already been said that the FMS can help resolve this issue. Or rather, the migration department of the Ministry of Internal Affairs. It is he who deals with issues related to population registration.

Typically, a request must be submitted in writing, indicating the address of the apartment. The passport office employee will issue an extract that will indicate how many people are registered in the house. In some cases, the certificate has an expanded form - it will also contain accurate information about the residents.

How to check who is registered in an apartment - exploring the possibilities of the Internet and government agencies

Many buyers of secondary real estate want to check who is registered in the apartment online. There are paid reference resources on the Internet that have access to various databases.

But we will not recommend them to our visitors, since due to the ban on providing information about registered persons without the presence or notarized consent of the owner, such information cannot be considered reliable and obtained legally.

  1. Those sentenced to actual imprisonment who were temporarily discharged. They have the right to register again after their release.
  2. Persons discharged due to military service . They also have the right to re-register upon return.
  3. Citizens who were previously registered in the apartment, but were subsequently recognized as missing . If they appear, they regain all rights to the area.
  4. Minors who are temporarily in educational institutions.
  5. Senior citizens who have been placed in specialized homes.
  6. Persons undergoing treatment in a psychoneurological institution.

What is this?

Temporary registration, which is often called temporary registration according to Soviet habit, is registration at the place of stay . This is a way for the state to track the movements of citizens. Obligation to notify appropriate authorities about their current place of residence is prescribed by law. The basis for this may be living in a new place for more than 90 days.

Important : registration of a temporary one does not deprive a citizen of his permanent registration, but only informs the state about his current location.

What are the risks - can tenants apply for an apartment?

Temporary registration does not give any rights other than the use of residential premises within the prescribed period.

Registration at the place of residence does not confer ownership of real estate.

How common is it today?

Until recently, this practice was minimal, but the trend has now changed. The willingness to formalize everything according to the law may indicate the general adequacy of the landlord and the desire to conduct business in a civilized manner.

At the same time, employers today know their rights much better, insisting on official registration.

Can a temporarily registered person claim your apartment?

This is impossible, since temporary registration (as well as permanent registration) does not give him the right of ownership of real estate. Of all the powers that make up the right of ownership, a person with non-permanent registration has only one - the right to use. That is, he can be and live in an apartment, but nothing more.

He has no right to sell, use as collateral for obtaining a loan or otherwise dispose of the housing in which he is registered. Even if we imagine (purely theoretically) that the new tenant came up with such an idea, it will not be possible to implement it for the following reasons:

  • he does not have documents for the apartment confirming ownership;
  • even if his counterparty agreed to conclude a deal without these documents, it will still be considered invalid from the moment of its conclusion and will not create any legal consequences.

Because of this, the owner does not bear any property risks if he decides to temporarily register someone in his living space.

Is it possible to sell an apartment with a temporary registration?

Theoretically, it is possible to sell an apartment with temporary residents registered in it (since an extract from the house register is now not required when registering a transaction), and the consent of the latter is not required for this

.

But in practice it is unlikely, since few people will want to buy such an apartment, because it is burdened with the registration of strangers

.
This means that after purchasing housing, the new owners will have to share it with strangers,
i.e. To.

they have the right to use.

For the seller

Although there is still one guaranteed way that will help sell an apartment with an encumbrance in the form of a non-permanent registration.

This is an application to a real estate agency that specializes in the sale of “problem” housing.

Such agencies buy apartments at almost half the price of their market value, or undertake to find a suitable client, charging 40-50% of the transaction cost for their services.

For the buyer

Before purchasing, the buyer should carefully study the contract and request from the seller an extract from the house register, where all registered persons are indicated (i.e., so that there are no registered persons)

.

Since there are often cases when a transaction has already been completed, and later it turns out that someone else is registered in the purchased property

.

But even if you happen to buy encumbered real estate, there is always a way out.

  • Option 1. Forcibly evict temporarily registered persons from their apartment by filing a lawsuit in court.
  • Option 2. Again - through the court - but using a different procedure. You need to ask that the transaction be declared void if the contract did not say anything about temporary residents registered at your address
    . If the demands are satisfied, it means that the apartment is returned to the seller, and the money is returned to the buyer.

What is permanent registration

Permanent registration means a certificate certifying a person’s registration in his place of residence. Based on the evidence, property claims may arise.

Such paperwork is referred to as registration with the right of ownership. For example, if a person has registered his own child, who has not reached the age of majority, in a municipally owned apartment, then during privatization a certain part of the property will be transferred to him.

The fact of permanent registration without rights to living space is confirmation of a person’s civil status, a way of transferring to him the opportunity to use social services and benefits provided by the state.

Bodies dealing with the deregistration procedure

Removal from temporary registration is free, a list of organizations where temporary registration is issued and canceled:

Documents for deregistration

Before canceling temporary registration, a citizen must write an application. You also need to present a civil passport and a certificate of temporary registration. When canceling the registration of a child under 14 years of age, it is necessary, in addition to the above documents, to provide a birth certificate.

What information can you get about living citizens?

After completing the application, the owner of the apartment will after some time become the owner of the following information:

  1. Documented address where the apartment is located.
  2. The total number of citizens who have a residence permit in the apartment.
  3. Are there people with temporary registration? The date until which this registration is valid must be indicated.
  4. How many people have permanent registration and how many have temporary registration?
  5. Existence of debts to utility services.

For example, if the certificate is ordered not by the owner, but by a person with registration, then he can additionally find out the following information:

  • telephone number of the property owner;
  • email address;
  • location.

Where can I find out the number of registered citizens?

Such information is provided by government organizations:

  1. MFC is a multifunctional center for the provision of state and municipal services. When contacting this institution, you need to leave a request. After a certain number of days (about a week) it will be completed. That is, the citizen will have an extract from an official document indicating how many residents are registered in the apartment. The extract contains personal information about registered citizens. Therefore, some prefer to contact the MFC and receive complete information not only about currently registered people, but also earlier information. This way you can understand whether the apartment was resold several times and who the owners were.
  2. Similar information can be easily obtained by contacting the compulsory medical insurance or passport office .
  3. The management company also has access to the house register . Therefore, you can contact her.
  4. If you contact Rosreestr, you can receive a document with expanded information. In addition to registration, there will also be information about who the living space is registered to, whether it is privatized or not.

What are the dangers of temporary registration for a homeowner? How to protect yourself from problems legally?

The site operates with the financial support of the Federal Agency for Press and Mass Communications. Registered by the Federal Service for Supervision of Communications, Information Technologies and Mass Communications.

In the Moscow district of Lyublino, where wholesalers from the Cherkizovsky market have moved en masse to the local shopping center, there is another panic. Muscovites found citizens of China and Vietnam illegally registered in their apartments.

Local activists, who have been fighting the Cherkizon clone for several months now, are most afraid of the transformation of a quiet residential area into a Chinatown.

It looks like the gloomy predictions are starting to come true. Illegal Chinese were discovered at home by a pensioner from Marshal Bagramyan Street, building 2. The man received another payment from the EIRC “municipal accounting department” for his apartment.

At first glance, there was nothing unusual in the document. However, at the very bottom of the page in the column “number of residents,” instead of the usual number 3, the pensioner is registered with his wife and daughter, the number four appears.

But we pay for the most expensive service - water - according to the meter. But I thought they had the wrong number. Having received the payment, I immediately ran to the passport office of the Lyublino police department.

There, the employee pulled out a list of foreigners who were temporarily registered in our area. And a Chinese citizen actually turned out to be registered in my apartment.

The angry owner immediately wrote a statement demanding that the situation be sorted out. The answer from the police should come this week.

But when I looked through the list, I saw that my neighbor, who lives alone with his daughter, had three foreigners “assigned”. To my surprise, the passport officer shrugged.

Say, suddenly your neighbor is an underground rentier. Now we wait to see how the matter ends. I think the police will cite a glitch in the computer program.

District divisions of this particular department register visitors. Passport offices are subordinate to “migration officers”. This rarely happens in Moscow.

Therefore, we urge citizens to be vigilant and carefully review their apartment receipts.

In order, according to the rules, to obtain temporary registration in his living space, the owner of the apartment must personally draw up an application and provide a whole list of documents certified by his signature. Now it’s too early to say which rank in the office of which department and for what kind of money registers foreigners in other people’s apartments without temporary registration; it is impossible to work legally.

But anyone can be convinced that there are many intermediaries grazing on the Internet who solve non-standard issues, and “registration wholesalers” who serve enterprises where many foreigners work.

Like, for example, in the market. Obviously, these people do not take money for their work in vain. At the district forum of lublizon residents. Residents of Lublin noticed even earlier that when it comes to temporary rental housing, their area is very different from the rest of Moscow. On some pieces of paper there is also a note - the presence of furniture is not necessary.

And so that no one has any doubts about who will move in there, the advertisements are decorated with hieroglyphs.

In some high-rise buildings, the senior residents held general meetings of residents, where they threatened: if anything happens, we will send the tax office and the local police officer.

The Lyublino City Council says that if everything is done according to the law - the landlord pays taxes and has an agreement that clearly states the number of tenants - it will not be possible to evict foreign neighbors.

How can you find out who is registered in an apartment?

Another option is to contact the FMS . In both cases, information is provided only to the owner of the property.

Only at the passport office the documents are checked immediately, and at the FMS, upon receipt of an application of this kind, the owner is sent a request whether he agrees to the disclosure of such data.

The second difference is in the response time: the Federal Migration Service provides information on the number of registered applications within no more than thirty days from the date of application.

When buying a secondary home, it is especially important to know about the presence of registration in the apartment. The easiest way to do this is through the seller himself - after all, it is in his own interests. If for some reason the owner did not provide such information, you can independently make a request to the Unified State Register.

How do I find out if the temporary registration of a person in my apartment has been terminated?

The fact is that it is not a citizen of Russia who is obliged to register for migration, but the person renting out housing to him must report this to the migration authorities (previously to the FMS, now to the relevant department of the Ministry of Internal Affairs). And if the owner of the apartment has not notified that he is hosting refugees, guest workers or other foreigners, he will face the responsibility provided for:

But if the house is in joint or shared ownership, then you will need to obtain permission to register from each owner. An important point is that when registering, all owners must be present or notarized powers of attorney from them must be available.

When submitting an application, you need to pay a state fee of 300 rubles for individuals and 600 rubles for legal entities and individual entrepreneurs. The information will be ready within 3 days from the date of your request.

You can receive it in the form of a simple certificate indicating the minimum information about the living space (address), owner and registered persons (full name).

You can also order an extended certificate, which will indicate the entire list of information about the living space: all transactions, owners, restrictions on rights (if any), arrests, both active and already lifted.

Find out who is registered at the address

Before you find out a person’s registration through one or another body, even if he does not live in this living space, you need to understand that such information can be obtained by the owner of the property and the tenant of the property if he has entered into a rental agreement with the owner. Information is free when contacting the migration service or management company.

Issues of population registration are handled by the Federal Migration Service, through the passport office, available in every locality in every district where citizens live.

Each department of this body has a house book, which displays all the information about who, when and where was registered.

However, when setting the goal of finding out who is registered in an apartment or other residential premises, you need to take into account that this can be done through several authorities:

Registration in the apartment: owners, increase your vigilance

It is not yet very clear how the process of canceling illegal temporary registration will take place. We remind you that registration documents are issued for a certain period - for three months, six months. It is also unclear in what way it will be possible to force an illegally registered person to come to the registration point and hand them over.

The main problem is that now, according to the innovation, knowing the passport details of the owner of the property, you can register in the apartment without the written consent of its owner. This method of registration, according to lawyers, can result in big troubles, even leading to the forced entry into the place of registration of “someone else’s uncle.”

How to find out who is registered in an apartment: step-by-step instructions

Other persons can obtain this information only with a notarized power of attorney, which is also certified by the signature of the responsible tenant. It allows you to obtain complete information about registered people, acting solely in the interests of the tenant of the living space.

  1. On weekdays, contact the passport office or other management organization of the building in which the property is located.
  2. Be sure to present the relevant documents.
  3. Receive an extract within a few minutes in front of the applicant. The service is completely free.

  2. Obtain an extract from the house register through State Services.
    The statement indicates how many people are registered in the apartment.

Third parties can also check the temporary registration of another person by personally contacting the relevant authorities with a request, justifying the purpose of the application. You can check the authenticity of a foreign citizen’s registration by writing or personally contacting the territorial body of the FMS, or by calling them.

  • Persons undergoing military service were temporarily discharged.
  • Persons, if they previously lived, but were subsequently declared missing. Upon return, such people have the right to register and live in their own premises.
  • Elderly people living in specialized nursing homes.

There are several ways to do this.

How to obtain information from government organizations

Passport office employees have the right to issue information only to those people who have rights to property. These include property owners and registered occupants.

Procedure for obtaining a document:

  • personal presence at the passport office is required;
  • You need to take your passport or driver’s license with you;
  • a written statement is issued that a certificate is required confirming the number of people registered in the living space;
  • After some time, pick up a document that will indicate how many are living and registered in the apartment.

You can make an extended version of the help, which will add archived data. They will confirm the total number of people who lived in the apartment over the entire period of time. In addition, the certificate contains information about why people were checked out of the apartment.

Since the data can only be obtained by homeowners or people who have registration, one caveat arises. If, for reasons beyond his control, the owner of the apartment cannot appear for a certificate, then he should contact a notary. He will certify the power of attorney to a third party who will deal with all issues.

You can find out about registered residents by contacting the Federal Migration Service . In order for the request to be completed in the shortest possible time, you should do the following:

  1. Come to the local Federal Migration Service with an identification document. To write an application. It is worth noting that in this case you will not even need to pay state duty. The service is free.
  2. You need to wait 30 days, and the certificate will be in your hands.

But do not forget that there is a law that protects the rights of citizens and does not allow information to be published without reason. In this case, the specialist dealing with the issue will notify the owner that an application has been submitted. You should also indicate the purpose of the requested information.

People living in the apartment will have the right to choose. They can either refuse or agree to make the information public.

When contacting the management company, such questions do not arise, since only the owner of the living space has the right to do this. He comes with a document and fills out a request.

Most often, citizens who want to purchase inspected housing are interested in such information. In this case, the State Register helps. The buyer requests information regarding existing encumbrances. As a result, he will have information about the person who sells the property. It is very important to find out whether the property was purchased together with those who are already registered in the apartment.

If you contact the MFC, this issue can be resolved even easier. Since the owner of the property is removed from the chain, his presence is not necessary.

List of residents of the house by address

Many individuals and organizations have a list of apartment building residents, but not everyone will share this information.
These full names are considered personal and are subject to the “Law on Non-Disclosure of Personal Data”. For an outside individual who has no legal basis for making a formal request, it may be difficult to obtain a comprehensive response. There is a register of apartment building owners , where you can get the necessary data about any apartment owner and in full. The following organizations have access to this register and information about residents at a specific address:

  1. Passport office at your place of residence.
  2. District police officer.
  3. Registration Chamber.
  4. Management Company.
  5. Websites and online services.
  6. The Federal Migration Service.

Not all methods can help in every case, since there are restrictions due to the current law on personal data. Let's consider each point and its pitfalls in detail.

Passport Office

The passport office has the most complete information about individuals in the authority’s area of competence, but only the owner of the property can access it at will. When making a request regarding someone else’s apartment, the passport office may request a preliminary DCP for the apartment. It is better to prepare this document in advance and take it with you.

But there are nuances:

  • If a person is in prison, he is discharged from the apartment until he is returned to society. Such citizens will not appear in the extract from the passport office. The main problem is that it is absolutely unknown how many months or years you can wait for an unpleasant surprise in the form of a person returning home, and the apartment has long been sold. The worst thing is that the law allows a citizen to re-register in this housing, even if it is already owned by another person.
  • By the time the apartment is sold, usually all the residents have already moved to a new place of residence and are registered there. As a result, ideally there should be no one on the statement.
  • When visiting the passport office, it is better to immediately ask for an extended certificate. If a regular certificate contains only current information, then the extended version contains data on all persons who have ever been registered in a particular apartment. This will avoid the problem of people returning from prison and their re-registration in the purchased apartment.

District police officer

Each local police officer is obliged to know all persons registered and living in the area assigned to him.
When buying an apartment, getting to know the local police officer is useful in itself, plus this method of obtaining information is absolutely free. It would be useful to clarify other important data: are there any noisy, drinking, conflict-ridden personalities among the neighbors. You can also ask a friend of a local police officer from another area - for example, from your own apartment, especially if the geographical difference is small. Police officers can easily clarify basic information from their colleagues and provide a list of residents of the house by address.

Registration Chamber

How to find out a person's first and last name by residential address? Contact the registration chamber with a passport and a preliminary purchase and sale agreement. The register of owners available in the Unified State Register contains 100% reliable information.

Additionally you can find out the following:

  • All encumbrances imposed on the living space.
  • Public information about minor residents who have the right to property.

Additional information can save you from problems in the form of courts declaring the transaction invalid if the seller manages to hide the facts. A certificate from the Registration Chamber is provided only on a paid basis - from 45 to 60 rubles per extract.

Management Company

In the management company you can find out who is registered at the address and find out the names of all the residents. The management company needs this data to calculate and charge utility bills, and they do not know the details. It will not be possible to obtain any specific information about registered persons other than last names (or full names) and the number of registered people.

Websites and directories

On sites with databases, the search is usually carried out using personal information: address, full name, year of birth.
The completeness and relevance of databases is almost always questionable. Many sites sell significantly outdated information (up to 5-7 years and older), or deliberately false or public information (from open access, telephone directories). Important : It is not recommended to use sites that promise to provide a large amount of data for a small fee. The Personal Data Protection Law prohibits such activities; the sites are most likely fraudulent. Even if any information was obtained from such unofficial sources, it cannot be trusted. In addition, in any proceedings, only certificates and documents obtained legally will have legal force.

The Federal Migration Service

You will have to wait up to a month for a response from the FMS to your request.
To send a request, you must provide an application and a passport to the Federal Migration Service. Important : personal data will not be disclosed without the knowledge of the apartment owner. A request from the FMS will be sent to the apartment owner's postal address indicating the purpose of the application and the applicant's personal data.

FMS employees will provide information within 30 days only if permission has been received from the owner.

Required documents

If a person needs to find out how many people are registered in a living space, regardless of the method of obtaining information, then one must be prepared for the fact that any organization will require a civil passport. In some cases, a driver's license will be sufficient.

It was noted a little higher that if a citizen does not have time to fill out requests or go to organizations, they can entrust this to a third party. A power of attorney is issued for him, which must be certified by a notary office. In this case, all issues can be resolved officially.

It is worth recalling the fact that information about registered residents can be obtained by apartment owners or citizens registered in them. Accordingly, all this should be documented. For example, if you have a passport, your registration is checked. If it is not there, then documents must be submitted that confirm that the person owns this property.

Information access level

There are two categories that have access to information:

  • property owner;
  • the one who has a residence permit in the apartment.

An interesting nuance is that an apartment can be owned by several people at the same time. And everyone has the right to contact the relevant authorities to obtain information about registered residents.

Future buyers of living space belong to another category of people for whom information about the people registered in the apartment is fundamentally important. Even realtors advise finding out as much information as possible about it before purchasing a home.

How can an owner find out who is registered in an apartment?

Housing encumbered by the property rights of the categories of citizens listed above is, in most cases, sold significantly below market value. Sometimes such real estate is purchased deliberately in order to save money, and then the new owner removes the residents from the registration register through the court.

The right to receive information about registration

For the same reason, you should not respond to dubious offers to provide information from information databases for a fee. Most likely, in this case, the customer will receive the same information that can be found in the public domain.

In my region (Stavropol Territory), registration information is stored in housing departments. There you can obtain free information about persons registered in the apartment. I would also like to draw your attention to the need for competent drafting of purchase and sale agreements in terms of indicating the persons registered in the residential area.

Reasons for searching for registered citizens

There are many life situations in which information is required about who is registered in the apartment:

  1. If housing is purchased on the secondary market. For such cases, finding out the number of citizens who are officially registered is a very important point. For example, a person buys an apartment, but people are registered in it. If they are not issued on time, rent and utility bills will be assessed.
  2. When moving into public housing. Since it is limited to a set area, only a limited circle of people can occupy it. If this issue is not clarified in time, then the buyer will not be able to register himself in the apartment.
  3. When selling housing. When an apartment is sold, the first question that future owners ask concerns the number of people registered in the premises. The presence of minor children makes the transaction very difficult, since by law children must have their own shares in the housing.

Do not forget that there are citizens who can live in an apartment without being the owners of the property. If a buyer thinks that by purchasing a living space, he will evict them, then this is a delusion. At the time of the transaction, they can be anywhere. This does not make their rights any less.

If the situation becomes a conflict, then you will have to go to court, because eviction can only be carried out by its decision. But, as practice shows, this takes a lot of time and effort. Whether there will be a positive result is unknown.

How to find a person if only the address is known?

The category of this problem is serious. After all, not all property owners meet halfway. Some refuse to submit requests to find out where the registered person is located. Because they have no motivational interest, for example, there is no sale of an apartment, and there is no data.

There are several ways to resolve the issue. But it’s worth saying right away that it’s difficult to do this alone:

  1. A citizen may be a defendant in a lawsuit. Then, if you have a competent lawyer, you can try to find out where the person is. But even lawyers are not provided with complete information. Therefore, we must only hope for the best.
  2. The police can help in the search, but only if the citizen was detained or involved. Otherwise, it is impossible to establish his location. Since the police have access to information sources, it is quickest to learn everything from them.
