Extension after childbirth and cesarean

A pregnant woman at 30 weeks has the right to take maternity leave. It is issued for a period of 140 days. If the birth occurs with complications - bleeding, the development of various types of inflammation, or the birth of the child occurs through cesarean section, the woman is required to extend her sick leave.

The decision to extend is made by the attending obstetrician who monitored the woman during pregnancy.

After discharge from the maternity hospital, you must provide the doctor with an extract from the maternity hospital. Then the doctor assesses the woman’s condition and concludes whether there are grounds for extending sick leave. If they exist, it issues another sheet.

Caesarean section gives the right to extend the period of sick leave by 16 days.

Who makes the decision to extend sick leave?

After the expiration of the certificate of incapacity for work, the issue of extending sick leave is submitted to the medical commission for consideration.

The competence of the medical commission includes the following issues:

  • examination of the patient;
  • studying medical documentation;
  • referral of a citizen to ITU to establish disability.

The medical commission is approved by the head of the medical institution. It consists of at least three specialists qualified in the field of examination of temporary disability.

How is sick leave extended?

Extension of the certificate of incapacity for work is carried out taking into account the requirements of Order of the Ministry of Health of Russia dated September 1, 2020 No. 925n.

The procedure includes several stages:

  1. During the examination of the patient, reasons for extending sick leave are identified.
  2. The attending physician applies to the head physician of the medical institution with a request to create a medical commission.
  3. The chief physician approves the medical commission.
  4. The medical commission examines the patient, gets acquainted with his medical record and examination results.
  5. Next, in the absence of the patient, a meeting is held to discuss the issue of extending sick leave.
  6. Finally, a decision is made to extend the sick leave or to close it.

Important! If the medical commission has extended the certificate of incapacity for work, the citizen is obliged to come to see the attending physician for examination every 15 days. If there are grounds, sick leave is again extended to the maximum possible time.

For how long can it be extended?

The duration of sick leave depends on who issued it:

  • The attending physician can extend sick leave several times, but the total duration of sick leave cannot exceed 15 days.
  • After two weeks, to extend sick leave, you will have to assemble a medical commission, which, if there is a reason, can extend the certificate of incapacity for work up to 30 days. It includes doctors who already have a license that allows them to practice medicine and who have completed courses that explain the rules for conducting an examination of temporary disability.
  • A dentist, in the presence of dental disease requiring outpatient or surgical treatment, has the right to issue sick leave and extend it, but the total period of the temporary work certificate cannot exceed 10 days.
  • The paramedic can also issue sick leave, the total period of which, including extensions, cannot exceed 10 days.

At the next visit, the doctor can extend the sheet for a period of no more than three days per visit. That is, if, after the opening of sick leave, you came to renew your leave, for example, on Monday, then it will be extended to you until Thursday. On Thursday you should come to the hospital again, and if necessary, your treatment period will be extended for another three days (until Monday).

What guarantees does a certificate of incapacity for work provide?

Officially employed citizens registered with the Social Insurance Fund have the legal right to interrupt their work due to illness or injury. If health problems require serious treatment at home or in a hospital, then the person may temporarily stop performing duties.

However, in the future, the existence of grounds for absence from work will need to be certified. This is why a sick leave is needed.

The document gives the employee the right to the following guarantees:

  • maintaining a working position during treatment and recovery;
  • calculation of cash payment on the ballot for the period of absence.

In addition, an employee on sick leave has some protection. As Art. 81 of the Labor Code of the Russian Federation, the dismissal of a citizen at this moment is unlawful. The grounds on which the contract is supposed to be terminated do not matter in this case. Only the employee himself can initiate the procedure while on sick leave.

Female employees can also be issued a certificate of incapacity for work in connection with future motherhood. We are talking about maternity leave. Maximum periods of sick leave

Temporary disability certificates are not provided on an indefinite basis. There is a fixed period regulating the duration of sick leave depending on the grounds on which it was discharged. The procedure for opening a document is regulated by the provisions of Order No. 624n.

The maximum values ​​for the sick leave period are:

  • for outpatient treatment of injuries, diseases, poisonings and other conditions, the bulletin is provided for up to 15 days;
  • registration of sick leave by a dentist or paramedic is allowed for a period of no more than 10 days;
  • the period of incapacity for work due to future motherhood is 140 days (based on 70 days before the day of birth and the same amount after the birth of the child).

Sick leave for caring for a family member also has fixed terms. It all depends on the age of the patient and his diagnosis. The periods are indicated in Chapter 5 of Order No. 624n.
