When needed

The current ADV-2 form was adopted by the 2016 Pension Fund Resolution No. 473p. Companies or workers themselves hand it over to the Pension Fund divisions when they change their last name. For example, as a result of marriage or vice versa – divorce. Or when this happened simply at the request of a person. Today there are practically no legal restrictions.

True, life sometimes brings surprises. Both completely unexpected and exotic. Therefore, the ADV-2 form requires registration in the same way as filling out the ADV-2 sample when changing your last name . We are talking about when other personal data changed. For example:

  • Name;
  • patronymic (if it is gone, in ADV-2 they write “Canceled”);

Why are forms needed and who approves them?

To receive SNILS, an employee contacts the Pension Fund of the Russian Federation, fills out a special application form in the ADV-1 form and waits for the issuance of a document confirming registration. If the insured person has a personal account in the pension insurance system, but his personal data (last name, first name, patronymic) has changed, he should update all documents. To make clarifications in the system, submit an application for exchange of an insurance certificate in the ADV-2 form to the territorial office of the Pension Fund of the Russian Federation.

The application form for changing SNILS was approved by Resolution of the Board of the Pension Fund No. 485p dated September 27, 2019. The document is divided into 4 blocks:

  1. Existing data - insurance certificate number and full name indicated in SNILS.
  2. New personal data - full name, date and place of birth, citizenship, address of registration and actual residence, telephone.
  3. Identity document - type, series, number and by whom it was issued.
  4. Date of filling out the form and signature of the insured person.

The same resolution No. 485p approved the ADV-3 form, which is used to obtain a duplicate of SNILS in case of its loss. The application for the issuance of a new document contains the same blocks, and filling out both forms is identical.

How to get ADV-2

Application form ADV-2

An insurance certificate containing a unique SNILS number is mandatory for every able-bodied citizen. If the employee does not have this document, the responsibility for preparing it falls on the employer. What if an employee has a SNILS, but the information in it does not match the data in other documents, for example, an employee got married and now has a different last name in her passport?

A citizen has the right to change not only his last name, but also his first name, patronymic, and even place and date of birth. Such situations occur quite rarely, for example in newly discovered special circumstances.

In such a situation, it is necessary to draw up a special appeal to the Pension Fund of the Russian Federation in the form approved by Resolution of the Pension Fund Board No. 485p dated September 27, 2019.

Employer's actions

Having received the ADV-2 application from the employee, the policyholder must check the accuracy of the information specified in the application and, within 2 weeks, send it along with an inventory in the ADV-6-1 form (clause 30 of Appendix 2 to the Resolution of the Pension Fund of the Russian Federation Board of June 1, 2016 No. 473p) to its branch of the Pension Fund (clause 27 of the Instructions, approved by Order of the Ministry of Health and Social Development dated December 14, 2009 No. 987n).

Throughout life, a person may experience changes in life circumstances that will lead to the need to change not only his job and place of residence. Sometimes a person has to change personal data. For example, when a woman gets married, she takes her husband’s last name, or a person himself decides to change his first or last name. Often new circumstances are discovered due to which a citizen has to change the information about his place of birth. Recently, cases of gender reassignment have become common.

A person needs to change all documents, even if only one detail has changed, because according to the law, these documents contain outdated information. This mainly concerns a passport or other identification documents, as well as documents related to taxation and insurance.

Regulatory regulation

The regulatory framework regarding writing applications in form ADV-2 is regulated by Resolution of the Board of the Pension Fund of the Russian Federation No. 192 dated July 31, 2006, edited on January 20, 2015. This document sets out the rules for filling out and provides a single sample form. The form can be obtained from the Pension Fund itself, or on its official website.

The application must be submitted within two weeks, especially if the person has just started a job. An employer who fails to submit an application on time faces penalties (Government Decree No. 318 dated March 15, 1997). The absence of an insurance number or incorrect submission of details does not pose any threat to an employee.

How to get it in 2021

The employer is obliged to submit documents to the local Pension Fund office no later than 14 days from the date of writing the application. An inventory must be attached to the documents (form ADV-6-1).

  • Studying data, entering changed information and issuing a new certificate takes a lot of time, so the Pension Fund of Russia is legally given 1 calendar month for all these actions. After this, a new document with a covering letter is sent to the organization’s address.
  • The employer must provide a new certificate to the insured employee no later than 1 week. In this case, the employee signs the accompanying statement from the Pension Fund of Russia. This statement is sent back to the Pension Fund.
  • If your personal data changes, you should immediately start exchanging SNILS, because the employer will continue to transfer money to the current account, but due to the change in data, it may go to the wrong address.

It should not be assumed that if the account number is assigned to the insured person forever, then there should be no errors in pension insurance. The funds may even simply freeze and not reach the policyholder’s account.

Application for exchange of insurance certificate

An insurance certificate is of great importance not only for the employee, but also for the employer, since they are both participants in the pension system. This means that the correctness of the personal data contained in this document is very important. Otherwise, a failure may occur in the system for recording insurance premiums.

If a certificate has been received that contains any errors or is not at all readable, then in this case it is necessary to immediately replace the outdated certificate with another, correct document, which will correctly indicate the person’s last name, first name and patronymic, date and place of birth and gender.

The insured person must immediately contact the employer, for example, the human resources department, after receiving documents confirming changes in personal data. After this, you should fill out an application in form ADV-2, sign the form and then submit all the necessary documents to the employer. In addition, an employee can fill out this form not independently, but by entrusting this to employees of an authorized structure in the organization.

In other words, when employing a citizen who does not have and has never had a SNILS issued, the employer is obliged to send information to the Pension Fund for the creation and issuance of a mandatory document - an insurance certificate. Officials have set specific deadlines for those who must take ADV 1.

Why does the last name change?

The surname is part of the status of a citizen, which is an indispensable and obligatory attribute. People carry out all legally significant actions, sealing them with their last name and first name (except for cases of using a pseudonym, which are established by law). A surname is given to a person at birth. However, this part of individuality is not immutable; the surname can be changed in accordance with the procedure established by law. The law provides for 3 possible reasons for this.

  1. When changing marital status . When starting a family or divorcing a marriage, one or both spouses have the right to change their surname, and take any of the two surnames they want, or a double one consisting of both surnames. You cannot take a double surname if at least one of them already has a compound surname. Divorce provides grounds for returning the previous surnames or keeping the current ones.
  2. For a child when changing the parent's surname . If one of the parents of a child under 14 years of age changes his last name for some reason, or a parent with a different last name enters the child’s life through adoption, the guardianship authorities, at the request of the parents, may decide to transfer the child to a new last name. If both parents change their surname at once, the child will be changed without asking his wishes. If the father’s name changes by law, then the baby’s middle name will be changed without fail, without the right to choose (Part 3, Article 62 of the Federal Law “On AGS”).
  3. At the request of the citizen . Any Russian citizen who has reached the age of 14, who has or is receiving a passport for the first time, can change his last name by expressing his desire and justifying the reason. The registry office at the place of birth, having received such an application, will consider which acts will have to be amended, and if these changes do not violate the law, permission to change personal data will be given.

How to change SNILS after marriage

If after registering a marriage a woman changes her last name, then she needs to reissue her identity documents. SNILS is not such a document, however, the last name is indicated there, and its replacement is also dictated by the requirements of the law on individual (personalized) accounting. First of all, the card itself or the certificate of registration in the Pension Fund system must be replaced. The account number allocated to the citizen earlier will remain the same.

Be careful, if the SNILS is not replaced and the employer continues to transfer pension contributions using the old passport data and old last name, your savings may be lost.

For now, we just note that the period for exchanging the certificate is not established by law (this does not apply to the case of loss). But it is advisable to do this as quickly as possible, so that in the future the information about the name of the insured person will always be reliable.
