Report to a parent about the parent’s inappropriate behavior towards the teacher

Cruelty to children, 156 of the Criminal Code of the Russian Federation

Criminal cases for crimes specified in part two of Article 20 of this Code are initiated against a specific person by filing an application to the court by the victim or his legal representative, except for the cases provided for in paragraph 2 of part one and part four of Article 147 of this Code.

In the event of the death of the victim, a criminal case is initiated by filing an application by his close relative or in the manner established by part three of this article.

The entry of a prosecutor into a criminal case does not deprive the parties of the right to reconciliation. The mother beat the child.

The father filed a statement with the police to prosecute him for child abuse, but they refused. The father filed a complaint for additional inspection. THREE months have passed and the police are being fed breakfast. You need to complain to the prosecutor's office about the actions of the police. When beating a minor, the investigative body must, with the consent of the prosecutor, initiate a criminal case.

If they refuse, then the father himself can, having previously examined the child at the emergency room, submit an application addressed to the magistrate in accordance with the requirements of Article 318 of the Code of Criminal Procedure of the Russian Federation. How to file a claim with the prosecutor's office for mental violence against minor children. G. Request to bring the specified citizen (group of citizens) to criminal responsibility. If we are talking about appointed representatives of the PLO (guardians, trustees) who abuse their duties, then the guardianship will be terminated and the child will be returned to the shelter. Such persons have the right to appeal, but filing a claim is usually pointless.

Social workers only remove a guardian or trustee from the position of a guardian or trustee if there is strong evidence. The list of grounds on which authorized persons have the right to petition the guardianship authorities to check the child’s living conditions is given below: The importance of the work of the district police officer lies in the fact that the responsible employee himself can initiate an check with by the guardianship authorities if they suspect concealment of facts of child abuse by parents. The child’s appeal can be of a concrete nature, if the child precisely indicates the one who is being rude, or of an abstract nature, if the child simply complains of beatings or violence against him.

Also, if available, photographs or videos relating to this issue can be attached to the application.

For those who find it difficult to compile, sample applications to the guardianship and trusteeship authorities, as well as a sample application for guardianship, are provided on the Internet on the website of the Ministry of Education.   • consideration of citizens' appeals on public education issues;
  • monitoring the correction of found violations.

The work of the department is also monitored by the department for supervision and control of the activities of executive authorities of the Russian Federation.

After receiving a complaint, executive authorities consider the request within 1 month (in extreme cases, the period may double). After which they are obliged to provide the applicant with an official response with the decision made. The processing time directly depends on the accuracy of the data provided. If the complaint was filed without justification, due to personal animosity, the family has the right to file a claim for false information.

If, after an inspection, employees establish facts of non-compliance with parental responsibilities, they make a decision to register the family.

Prosecutor's office

If the parents or legal representatives of a minor have failed to protect his rights and interests in higher authorities, then they should contact the Prosecutor's Office. However, if we are talking about serious offenses (beatings, moral pressure, extortion, failure of parents to fulfill their duties), then, having received such a signal from citizens, the Agency (for example, the Social Security Administration) can independently initiate a prosecutor’s audit to ensure the reliability of the information and bring the perpetrators to justice as provided by law.

If a child is in danger, lives in unsatisfactory conditions, his parents practice cruel treatment or shirk their duties of upbringing and maintenance, then you should contact the Social Security Administration of your administrative district as soon as possible, whose specialists should immediately verify the facts identified (in Due to the reorganization, the powers of the guardianship and trusteeship authorities were delegated to them).

So, the legislator included two components in the definition of a homeless person. First main part

: a neglected person is a minor whose behavior is not controlled. It is necessary to pay attention that control should be absent at all, that is, it should not be bad, satisfactory, but rather absent.

In addition, there should be no control over the behavior of a minor, which suggests that the lack of control, for example, over a sleeping child cannot be considered a lack of control over his behavior.3. Declare the premises illegal. (child’s full name, date of birth) to hospital no. as a neglected person and his further placement in. (name of shelter, social institution) Thus. Child abuse

Violence against a child (adolescent) is any action or inaction of adults or peers that causes psychological or physical harm to a child.

Coprogram Determination of caloric intake Conducting a tuberculin test Examination of sweat for chlorides (if cystic fibrosis is suspected) Determination of protoporphyrin levels (if intoxication with zinc and lead compounds is suspected) Examination by medical specialists (neurologist, psychiatrist, ENT specialist, surgeon, etc. according to indications) and pedagogical workers (speech pathologist, speech therapist, psychologist).

Emotional abuse is also committed against a child if: they humiliate his dignity, use offensive nicknames, use him as a confidant, show inconsistency when communicating with the child, shame the child, use the child as a transmitter of information to another parent (adult), use of the power of public institutions - religious organization, court, police, school, special school for children, shelter, relatives, psychiatric hospital and so on. What should parents do when they become aware of facts of violence against their child (teenager)?

Where and how to complain about a kindergarten teacher - sample and procedure for filing a complaint

Parents are the legal representatives of the interests of their children (Article 64 of the Family Code). And if the interests of the child are violated, they have the right to their protection.

Sometimes this happens in preschool educational institutions, where instead of comprehensive development, children sometimes go through a harsh school of life, facing violence, humiliation or indifference.

A complaint about a negligent teacher often helps to get rid of workers who do not belong in a kindergarten.

What can you complain about?

When it comes to criminal actions on the part of a teacher, parents should not file a complaint, but a statement to the police. It is necessary if a child is beaten in kindergarten, sexual violence or other criminal acts are committed against him. This is a reason to initiate a criminal case and isolate the sadistic teacher.

A complaint against a kindergarten teacher is usually written when parents become aware of the following facts:

  1. The teacher does not organize children's leisure time: does not conduct developmental activities, does not offer games, does not take the pupils for a walk.
  2. The employee does not monitor the lives and safety of children, constantly being distracted by personal matters.
  3. The funds collected for the needs of children are fully or partially appropriated by the teacher.
  4. The employee working with children is very rude and irritable when communicating with them, allows himself to use profanity, offensive nicknames, and constantly raises his voice at his charges.
  5. Inappropriate methods of punishment were used against the child. Numerous television stories on this topic tell of the unhealthy imagination of some members of the teaching staff: children are sealed with tape, tied to chairs or beds, deprived of food, left alone in a closed room, and other cruel methods of influencing the child are used.
  6. The teacher is engaged in assault. He does not beat children, but allows them to be spanked, pinched, slapped, and lightly hit with foreign objects. You can guess about such methods of education by the bruises and scratches that periodically appear on the child’s body.

The above circumstances are sufficient grounds for a complaint against a kindergarten teacher.

Where to complain to a student's parents

Let's take a closer look at where to complain about a teacher if a conflict arises.

When the reason for the statement is not related to the commission of a crime against the baby, you should try to resolve the issue peacefully.

This will not only save nerves and time, but also thoroughly understand the conflict situation. It often happens that in reality it turns out to be different from what it seemed to the child’s parents.

Report to the management of the educational institution

First you need to file a complaint with the head of the kindergarten. This is the right option, especially if the parent’s dissatisfaction is related to the organization of the educational process or the suitability of her subordinate for the position held.

For example, you can ask why a teacher certified to the highest category cannot get along with children.

Or why, in response to the harmless pranks of children, an employee of a kindergarten or children's summer camp bursts out with obscene language.

In the report, the child’s representative sets out in detail why the teacher is not satisfied with him, confirming the words with specific facts. The accusation must not be unfounded. In particular, if an employee is accused of assault, it is necessary to describe specific cases when he was noticed in this:

  • indicate the date and time of the event;
  • which child was physically abused;
  • for what reason;
  • what was it expressed in;
  • How did the applicant know about what happened?

Before writing a complaint, it is advisable to collect evidence of the facts stated: photographic materials, a medical examination, a conclusion from a psychologist to whom the parents were forced to turn. Or refer to an existing audio or video recording that the applicant is ready to demonstrate in person.

When a father or mother complains about a teacher-educator, at the end of the report they usually indicate what the kindergarten head’s response should be. The most common is a parent’s demand to fire a preschool employee who is unable to cope with his job duties.

You can write a complaint against a kindergarten teacher according to the sample, or in any form. A ready-made example of a complaint against a teacher is valuable only for its general plot and arrangement of details. But since the parent is complaining about a certain conflict situation, when drawing up a statement, he will have to proceed from specific circumstances, and not a template.

If, despite this, a response to the complaint is not received, or the parent is not satisfied with it, you need to contact the higher education department.

At the behest of the relevant ministry, direct management of preschool institutions was transferred to their management.

Appeal to a higher authority

The Department of Education is sent not just an application against the teacher, but a complaint against the kindergarten, or more precisely, against the actions or inaction of its director.

The parent first talks about the teacher’s inappropriate behavior, and then reports that, despite his written appeal, the kindergarten management did not take measures to solve the problem.

The complaint against the inactive director of the kindergarten is supported by a copy of the certified application that was submitted in her name.

Either a qualified lawyer or a ready-made template will tell you how to correctly write a complaint to a higher authority. For a sample complaint against the teacher and the kindergarten management to the authority that controls its work, see below.

The weight of the document increases if it is submitted not individually, but collectively, with a message about numerous facts of failure by the teacher to fulfill official duties, unacceptable attitude towards different children.

A collective complaint must be signed by all its compilers.

Department officials are given 30 days to respond to a parent’s complaint against the head of the kindergarten (Article 12 of the Federal Law on the Procedure for Considering Citizens’ Appeals). In exceptional cases, it is allowed to be extended for another month. To speed up the consideration of the application, at the end of the text there is sometimes a note that a similar paper has been sent to the prosecutor’s office.

Appeal to the prosecutor

A complaint against a higher authority is submitted to the prosecutor's office. In it, the parent sequentially says:

  • what was the reason for writing the initial statement (claims against the teacher are indicated);
  • about a written appeal to the head of an educational institution (and reaction to it);
  • about a complaint about a kindergarten sent to the Department of Education (and the reaction of officials).

Letters are written to the prosecutor's office not only in the absence of a proper response from other officials.

The supervisory authority should be informed about the teacher’s inappropriate actions if they constitute a crime: extortion, theft, negligence.

If a child is subject to an absolutely serious or especially serious act (rape, significant harm to health), the Investigative Committee becomes involved in the case.

The prosecutor writes a response to the received complaint using a departmental form. The document is issued within 30 days from the date of registration of the parent’s application.

Application to Rospotrebnadzor

Rospotrebnadzor is the authority to contact if kindergarten employees:

  • sanitary and hygienic standards are not observed (teachers go without gowns, there are cockroaches in the premises, toilets are poorly cleaned, etc.);
  • Poor quality food was provided for children;
  • it is allowed to place a dormitory on the territory of the kindergarten;
  • other violations that jeopardize the child’s health are allowed.

Having witnessed such facts, parents have the right to contact Rospotrebnadzor with a statement describing them in detail. This paper will become the basis for an extraordinary inspection of the kindergarten. If the circumstances specified in the complaint are confirmed, the perpetrators will suffer administrative and disciplinary punishment.

A parent, in the interests of the child, has the right to complain about any inappropriate behavior of a teacher or other employee of a preschool institution.

A timely reaction from adults will protect children from moral and physical suffering and will not allow them to become victims of the negligence of a careless teacher.

Cruelty to children: Article 156 of the Criminal Code of the Russian Federation with comments

As for domestic legislation, liability for committing such actions is provided for in many areas: criminal law, family law, administrative law and others.

In accordance with this article, criminal liability arises if cruel treatment of children is combined with failure to fulfill the duties of raising them. How to correctly draw up a sample application to the prosecutor's office against neighbors? In this case, cruel treatment must be expressed in the commission of deliberate actions against the child.

For example, they can manifest themselves in the formation of negative life attitudes, delays in physical and mental development, a decrease in the ability to learn, a loss of respect for adults, as well as serious changes in the psyche that are almost impossible to correct in the future. But if the child’s health is seriously or moderately harmed, such actions may require additional qualifications. In accordance with Article 156 of the Criminal Code of the Russian Federation, child abuse means not only the use of physical force, but also failure to fulfill responsibilities for raising children and creating comfortable living conditions for them.

If a child is deprived of food, basic necessities, or if the child lives in unsanitary conditions, these can all be considered abuse.

The legislation allows the case to be considered in a judicial body related to the place of residence of the plaintiff, but only if there are serious grounds: he has a disease that makes it difficult to move to the place of trial, or the presence of a small child or a disabled child. The judicial authority may, but is not obligated to, take these circumstances into account and accept or not accept the claim at the place of residence of the plaintiff.

  • reflection of the stated requirements
  • indications of the violation of the plaintiff’s legal rights and interests
  • references to the circumstances justifying the claims made
  • providing evidence and confirmation of the circumstances stated in the claim
  • links to legal regulations confirming the legality of the requirements

As a result, with some persistence, you can either punish the criminal according to the law, or at least intimidate him. Demand identification from the police officer who refuses you (generally speaking - this should be your first step in the police - write down the details of the person you are communicating with).

What responsibility do parents have?

In case of improper performance of their duties, parents or legal representatives may be subject to punishment. Types of responsibility:

  1. Family law. Occurs due to a socially dangerous situation. The family is put in control.
  2. Administrative. If a mother or father cannot ensure the safety of the life and health of their children, they are subject to administrative liability (a warning or a fine).
  3. Civil law. For harm caused to a minor, a parent or legal representative may be deprived of parental rights.
  4. Criminal. A serious crime against a child faces criminal liability and a real prison term.

It is important to remember that deprivation of parental rights and imprisonment do not relieve parents from the obligation to support a minor.

Reminders for parents “Child Abuse”

It has always been said that there are no recipes in education. And, nevertheless, we will try to give you some commandments that will help make your work easier in raising a child:

Education is a sequence of goals. Help your child build a system of long-term goals - from distant to medium and from there to today's. Stop! If you are “sick of crying,” ask a friend, relative, or neighbor for help, ask them to sit with the child for at least ten minutes while you take a shower or just go outside, calm down. Learn to ask and accept help from other people.

As a last resort, leave the baby in the crib or playpen and take a shower for 5 minutes - it’s better to let the baby cry than for you to cause irreparable harm to him. Rejection: the child’s individuality, his originality, character traits.
