Is it possible to obtain citizenship for a child at the MFC?

In order for a minor to confirm Russian citizenship, for a long time it was not enough to have only a birth document. To do this, you had to get a separate insert for it. Without it, it was impossible to obtain a Russian or foreign passport. The situation changed after the Law “On Citizenship of the Russian Federation” dated May 31, 2002 No. 62-FZ came into force (as amended on May 1, 2016). Since July 1, 2002, newborns required an insert only in rare cases, and in 2007 they began to replace it with a citizenship stamp on the birth certificate.

Citizenship stamp according to law

According to the new version of the above law, children born after July 1, 2002 automatically become citizens of the Russian Federation under the following conditions:

  1. Both legal representatives or one of them have Russian citizenship, regardless of place of birth.
  2. Both legal representatives or the only one who reside on the territory of the Russian Federation are foreign citizens or stateless persons. There is one condition here: the state of which they are citizens does not grant the child its citizenship.
  3. One of the legal representatives has a Russian passport, and the second is a stateless person or his whereabouts are unknown.

In the above cases, putting a stamp confirming a legal connection with the state can be done voluntarily at the request of the parents; moreover, it is recognized as the fact that minors have Russian citizenship and the entry made about them in the Russian passports of their legal representatives.

Obtaining Russian citizenship for children

The grounds, conditions and procedure for acquiring/terminating the status of a citizen of the Russian Federation are regulated (as amended on July 29, 2017).

Children acquire citizenship by birth if at least one of the parents is Russian, and this does not depend on the child’s place of birth. This also happens if the child was born on the territory of the Russian Federation, but both parents (or the only parent) living in Russia are foreign citizens or, and the state of which they are citizens denies the child its indigenous status.

As a rule, the procedure for obtaining civil status for children is simplified.

In what cases is a stamp required?

Let's try to figure out whether it is necessary to put a mark on citizenship on the birth certificate and in what cases. Despite the presence in the certificate of information about the parents’ affiliation with the Russian state or a record of the children in their passports, in practice they still continue to require this mark.

This happens especially often when minors travel with their parents to visa-free countries with Russia, so it is recommended to do it anyway.

The mark is placed very simply and, as a rule, immediately on the day of application.

The most common cases when a mark on a birth document is required to be presented are:

  • registration of a certificate for maternity capital;
  • ;
  • with some countries;
  • registration of Russian and.

In addition, if the birth document does not indicate that both or only parents are citizens of the Russian Federation, it is better to put a mark confirming citizenship.

There are a number of cases when a birth certificate alone does not confirm the fact of Russian citizenship, and it is necessary to check the box:

  1. If a child was born outside of Russia and was not granted indigeneity of a foreign state by right of birth, and one of his legal representatives is a Russian citizen, and the other is a foreign state citizen.
  2. If the child was born in Russia, and both of his legal representatives (or the only one) at the time of birth were foreign nationals or stateless persons. The state of which they are citizens did not grant their citizenship.

In addition, according to Russian legislation, full-fledged documents confirming that a minor has Russian citizenship are a foreign passport or an internal Russian one, which is issued upon reaching the age of 14. If you have these two documents or one of them, there is no point in getting an additional mark on the certificate.

In what cases is a stamp (seal) required on a child’s birth certificate confirming Russian citizenship?

The national citizenship of children born after July 1, 2002 does not require confirmation with an additional stamp and follows from their fact of birth in cases where:

  • information about the citizenship of the Russian Federation of the parents (the only parent) is contained in the birth certificate (CoP), regardless of the place of birth of the child;
  • one of the parents at the time of the child’s birth (regardless of its place) had Russian citizenship, and the second parent of the child is stateless (stateless person), or the status of a missing person is legally assigned to him;
  • the child was born in the Russian Federation in an international marriage (between a citizen of Russia and another state);
  • to a child born directly in Russia, whose parents are foreign citizens, their states do not represent their citizenship.

A note on citizenship on the birth certificate may be needed in the following cases:

  • When you need to take your child abroad to obtain a foreign passport for him.
  • When you need to get a main identity document at 14 years old.
  • When registering maternity capital. Registration at place of residence.

The absence of a stamp does not entail a fine, but without it the child’s parents will not be able to apply for maternity capital, nor will they be able to include their children in their passports. However, this is not all cases. Stamp required:

  • when crossing the state border,
  • receiving a passport,
  • registration at the place of residence.

The birth certificate always indicates the citizenship of the parents. If this is not done, then such a document will not serve as evidence of the existence of grounds for obtaining Russian citizenship for the child. There are other situations where evidence alone is not enough to prove:

  • the fact of birth was recorded in another country, and one of the spouses is Russian.
  • the fact of birth was recorded in Russia, but the parents are not citizens of the Russian Federation or LBG.

From the age of 14, a Russian passport will serve as confirmation, and at any age - a foreign passport. If the child already has a foreign passport, then there is no need to worry about additional marks.

What documents are needed to affix a stamp?

A number of different aspects influence what documents are needed for a citizenship stamp, such as the date and place of birth of the baby, and the nationality of the parents. Let's consider this in relation to different situations.

  1. To affix a stamp on the birth certificate of a child born on the territory of Russia after July 1, 2002, only the parents’ passports and the document itself are required. If available, one of the parents can do this. If the moment of birth of the baby preceded the date specified by law, it is necessary to confirm the residence of his parents in Russia and whether they had Russian citizenship during this period.
  2. If one of the legal representatives indicated on the birth certificate is absent, you will need to submit one of the following documents:
      ;
  3. a certificate from the police that his location was not established during the search activities;
  4. court decision on deprivation of parental rights;
  5. a certificate from the registry office stating that the parent was recorded in the certificate from the words of the mother.
  6. If the baby was born on the territory of the Russian Federation, and his legal representatives are foreign nationals, in this case it is necessary to collect the following package of documents:

  9. a document from the authorized body of the country of which they are citizens, stating that the newborn cannot be granted citizenship of that country.

  10. After confirming the child’s Russian citizenship, his legal representatives can also apply for a Russian passport.

  11. If the baby was born in the Russian Federation from parents who have stateless status, documents establishing this fact.
  12. If parents - citizens of the Russian Federation do not have passports due to their replacement or loss, they will need to submit a document confirming their residence in Russia as of February 6, 1992. It could be:
    • extract from the house register;
    • employment history;

  13. military ID with a mark on completion of military service;
  14. registration card according to form 9.
  15. This also applies to children born before July 1, 2002. Their legal representatives will need to provide proof of residence in the country as of February 6, 1992.

  16. If one of the legal representatives is a foreigner, then the process of admission to citizenship is initiated, the following is necessary:
      consent from a foreign parent to grant Russian citizenship, executed and certified by a notary;
  17. application of the established form;
  18. passport of a foreign parent;
  19. registration for a child in the Russian Federation or residence permit;
  20. 2 photos;
  21. translation of the birth certificate, notarized with an apostille (if the baby was born abroad);
  22. If the child is already 14 years old, then his consent to acquire Russian citizenship is required.

Thus, if Russian citizenship was assigned to the applicant before the beginning of 2007, an insert for the certificate was issued as confirmation of this procedure.

If the status was assigned later than the specified date, the person was given a stamp on the birth certificate.

The insert could be issued at the department of the Federal Migration Service (from 2021 - Main Directorate for Migration Affairs of the Ministry of Internal Affairs).

You can also affix a stamp at the department of the Main Department of Migration of the Ministry of Internal Affairs of the region of residence of the citizen.

If a woman is involved in registration, then confirmation from the other party is not required.

  • Close relatives do not have to consent to registration, even if they have the right to own housing.
  • Registration is possible for any share of the residential premises.

Instructions: you need to go to your personal account and select “Registration at place of residence or stay” and click “Get service”. Next, you will have to fill out a questionnaire and an electronic application and choose the method of obtaining the result.

Where can I put a mark?

Now let’s find out how and where to put citizenship on a child’s birth certificate in 2021.

To affix a stamp, you must submit an oral application to the territorial unit of the Main Department of Migration Affairs of the Ministry of Internal Affairs at the place of registration of the child or his legal representatives.

Abroad, this can be done at a consular office or diplomatic mission of the Russian Federation.

Receipt procedure

This procedure has been significantly simplified since the introduction of the stamp in 2007. Parents of children born after July 1, 2002 only need to submit an oral application and a passport. After filling out the required application and submitting documents, as well as after checking them by an employee of the Main Migration Department of the Ministry of Internal Affairs, a mark is placed. This is usually done on the day of treatment.

What are the costs and processing times?

This procedure is voluntary and is not subject to state duty. The exception is children born outside the Russian Federation, one of whose legal representatives is a foreigner. In this case, it is necessary to pay a consular fee for the procedure for accepting minors as Russian citizenship, which is 65 US dollars.

Since July 1, 2002, you can receive this service within one day. If the baby was born before this date, then due to bureaucratic difficulties the period may be extended.

What does a mark represent?

The mark is a rectangular imprint, which necessarily contains the following information:

  • that the minor has citizenship of the Russian Federation;
  • the article of law on the basis of which the status is acquired;
  • name of the authorized body;
  • date of issue;
  • signature of an authorized person.

The stamp is affixed with the round official seal of the government agency that made the record of citizenship.

What is the penalty for missing a mark?

There is no legal provision for any liability if citizenship is not indicated on the birth certificate. Such a mark is placed solely at will, but, as practice shows, it is better to do it.

The requirement for a mark when issuing a passport for children born after July 2002 and reaching the age of 14 is unlawful if the certificate clearly states that the legal representatives of the teenager are citizens of the Russian Federation.

If a minor was born before the specified period and still does not have a citizenship stamp or insert, then the passport may be refused.

As you know, according to the law, a passport must be issued within 30 days after reaching the age of 14 years, so in order to avoid problems, it is better to put a mark in advance, especially since the procedure for obtaining it is simple.

When is it necessary to prove an indigenous person?

In certain situations, government officials have the legal right to demand additional confirmation of being an indigenous person of the Russian Federation. The claims of officials are justified if:

  • the subject permanently resides on the territory of the Russian Federation, but does not have documents proving a legal connection with the said state;
  • an individual intends to apply for benefits or a mortgage;
  • a minor needs to obtain a general passport in connection with his fourteenth birthday, and at the same time he does not have the appropriate stamp on his birth certificate or a special certificate proving his affiliation with the Russian Federation;
  • a person who has reached 14 years of age will have to obtain an internal passport, but the birth certificate has been lost;
  • A child who has not reached the age of obtaining a general Russian passport must obtain a foreign passport.

If a person is going to travel abroad, it is advisable to issue a certificate of citizenship in any case - this will prevent problems that may arise from the possible loss of an identity card.

If the child was born abroad

Now let's look at how to indicate citizenship on a birth certificate for a child born abroad.

A child born abroad, whose both parents or one of them are Russian citizens, can also count on receiving the status of a citizen of the Russian Federation, but if in the first case this is done automatically, then in the second the procedure for admission to citizenship is carried out in a simplified manner.

To do this, you need to contact a consular office or diplomatic mission of the Russian Federation in another country. The documents you will need are the parents' passports and a birth certificate issued by the medical institution where the baby was born. It will need to be translated into Russian and notarized, then stamped on it, after which a mark on citizenship will be placed.

If one of the legal representatives is a foreigner, the newborn does not receive Russian citizenship by right of birth. In this case, the process of accepting Russian citizenship for the minor is initiated, for which you will need to provide:

  • completed applications from both parents;
  • their ;
  • consent of the foreign parent;
  • birth certificate with a notarized translation into Russian, certified by an apostille;
  • photographs of the child;
  • marriage certificate, information about place of residence;
  • document confirming payment of the consular fee of 65 US dollars.

A child born abroad is not issued a Russian certificate. As a rule, along with a note on the certificate from the place of birth, he, as a full citizen of the Russian Federation, is issued a foreign passport.

In addition to the consular fee, you will need to pay for the following services:

  • for issuing an old-style foreign passport to a child - 10 US dollars, with an electronic storage medium - 40 US dollars;
  • for certification of correct translation from a foreign language into Russian – 25 US dollars (per page);
  • for certifying the authenticity of a signature on documents - $10;
  • for consular legalization of documents – $30 (for each document).
