A citizen living on the territory of the Russian Federation is required by law to have a residence permit. The registration indicates the place of stay. When living in non-owned real estate, a citizen must obtain a temporary registration. The validity period depends on the circumstances of receipt of the document. Registration must be renewed after the expiration of the registration period.

Mandatory registration of persons in the Russian Federation: what the law says

The rules for drawing up a document at the place of stay are regulated by Federal Law 5242-1. In accordance with Art. 5 of the regulatory legal act, citizens are required to obtain temporary registration at the address if the period of stay exceeds 90 days. Visiting Russians have the right not to cancel their permanent registration if they stay in another place for less than a specified period. According to the law, citizens may not draw up a document if the temporary residence premises are located in the same city where the permanent residence permit was issued.

About registration deadlines


Temporary registration at the place of stay differs in terms of validity. The minimum period is one month. It is issued if a person plans to visit a city in the Russian Federation and stay in it for less than 30 days. Such registration will not be needed for people who have Russian citizenship. But for foreigners it is mandatory.

Temporary registration of citizens in the Russian Federation

Russians have the right not to receive registration at their place of stay when the period of stay there does not exceed 90 days. Temporary registration is provided when changing the address of residence, renting premises, staying at a sanatorium-resort treatment, in a medical institution, hotel or boarding house. Advantages of registering a document at a short-term residence address:

  • receiving payments at the place of registration;
  • the ability to obtain loans, borrowings, and make money transfers;
  • employment in government departments;
  • placement of minor citizens in kindergarten, school;
  • free medical care in case of illness;
  • social security for students and pensioners.

With temporary registration, you can open a private commercial enterprise, undergo training to obtain a driver’s license, register a car, receive a medical book, and a foreign passport. Short-term registration does not allow you to take out an insurance policy, take out a mortgage to purchase real estate, or pay for utilities at standard rates. Citizens who have provided an incomplete set of papers or who are in debt will not be able to register at a temporary address. Russians wishing to stay in premises that are pledged or purchased with a mortgage are refused. A foreigner cannot register documents if migration rules are violated.

What happens if temporary registration ends?

A person is automatically deregistered at the place where he was registered when the registration certificate becomes invalid. When this moment comes, a citizen of the Russian Federation will be obliged to leave their temporary place of residence; the state obliges foreigners to leave the Russian Federation.

If temporary registration at the place of location has expired, a person can extend it, although this procedure is not much different from registration of regular registration. In other cases, you will have to leave your place of temporary registration. It will be impossible to use an expired certificate, and a citizen caught red-handed in such actions risks receiving a fine of up to 2.5 thousand rubles, equivalent to a lack of registration.

Conditions and procedure for registration

The basis for obtaining temporary registration is staying in the premises. This could be a rental property or a hotel room. When registering in an apartment, the consent of the owner is required, which is indicated in the rental document. When registering in non-privatized real estate, the accounting norm of square footage per person must be observed. It is prohibited by law to register without the right to reside in the premises. When staying at a hotel, the owners of the establishments independently determine the conditions for providing registration. There are several ways to complete short-term registration:

  • appeal to the FMS;
  • submission of documents through the multifunctional center;
  • filling out an application online on the electronic portal of public services.

Contacting the migration service involves submitting documents in person or sending them by mail. When visiting the Federal Migration Service, the testimony of the owner of the property where the citizen is temporarily moving is taken into account. If at the time of filing the application the period of permitted stay in Russia without temporary registration has expired, registration begins with the payment of a fine. Three working days are allotted for consideration of the application. When contacting the MFC, the time for providing registration increases to 7-10 days. Submitting an application through the State Services portal obliges citizens to create a personal account and attach documents electronically. After processing the data, a message will appear about the date and place of registration issuance.

What should foreigners do?

What to do if the registration at the foreigner’s place of stay has expired? In this case, the renewal will be more difficult. If a person has already missed the moment when it was necessary to contact the FMS, he will be required to leave the Russian Federation. At the same time, many begin to panic, others act in a simple way: they travel abroad to the nearest point, stay outside the country for an hour or two, then use a return ticket to go to their previous place and calmly issue a new registration, which from the point of view of the law will be considered a new registration of a new certificate .

In other cases, those whose registration at the place of residence has expired will have to provide compelling reasons for its renewal. For example, one of these reasons is not pregnancy. The only exception can be the presence of compelling medical indications that prohibit a pregnant woman from moving.

Another opportunity to stay where registration at the place of residence has ended for foreigners is to conclude an employment contract giving the right to reside at the place of work. Then the FMS will extend the registration for the required period while the person works in this company.

Temporary registration can become a transit point for those applying for a residence permit or citizenship. Another option when completed registration does not become an obstacle to residence is a visa.

Registration of minors

A short-term document is necessary for children to enroll in educational institutions, receive medical care, issue certificates and receive cash payments under the social security program. A minor citizen is registered at the place of temporary residence of his parents. Children over 14 years of age have the right to submit documents independently. To register a newborn child in someone else's apartment where married legal representatives live, the consent of the property owner is not required.

Registration validity periods for Russians

The minimum validity period is 30 days. When applying for registration at the place of sanatorium-resort treatment, medical care, business trip, the time of legal stay is determined by the duration of the voucher, hotel or boarding house reservation. Extension of temporary registration is permissible for a maximum of 5 years in accordance with Art. 683 Civil Code of the Russian Federation. An exception is the registration of a minor. According to the law, one of the representatives of a citizen under 14 years of age has the right to issue a short-term registration until the child reaches 18 years of age. In this case, the validity period of the second parent’s registration cannot exceed 5 years.

The owner of the property, who has officially concluded the contract, has the right to register strangers in the apartment. When renting municipal housing, the maximum stay is 6 months. When renting real estate, the period of residence is determined by the agreement with the owner of the apartment in accordance with Art. 685 of the Civil Code of the Russian Federation.

Required documents for renewal

It is necessary to provide documents for the extension of temporary registration in advance, no later than seven days before the end. This must be done by the receiving party who is applying for the extension, and not by the foreigner himself.

Conditions for extending the registration period

Termination of short-term registration is the reason for prolongation of the document. For legal residence, citizens must know how to renew temporary registration at their place of stay. To obtain repeated short-term registration, the maximum period of which should not exceed 5 years, you must submit documents in a timely manner. No more than 7 days are allotted for re-registration from the date of expiration of the registration period. Required list of papers:

  • application form No. 1;
  • applicant's internal passport (copy, original);
  • lease agreement, social tenancy agreement;
  • identification card of the property owner;
  • documents confirming the right of ownership of the premises;
  • written consent of other owners and residents;
  • house book (for the private sector).

When applying in person to the migration service, an application is issued on the spot; when submitting an application through an electronic portal, a sample document can be downloaded on the department’s website. The form must be filled out with a black or blue pen in legible handwriting without any amendments. The paper is signed by the applicant and the property owner. Russians are not charged a state fee for services provided.

Legality of extension

From the point of view of Russian legislation, there is no extension of temporary registration. A resident of Russia who needs to renew the document is simply issued a new one. In this case, renewal and issuance of a new certificate are one and the same.

The main requirement for issuing a certificate is the consent of the property owner. The basis may be:

  • Increasing the duration of a business trip;
  • Family or business problems;
  • Health problems;
  • Employment.

The period for obtaining a new certificate should not exceed 90 days from the date of expiration of the last one.

Responsibility for missing or late registration

In case of illegal stay in a residential premises, the citizen and the owner of the property are held criminally liable. The law does not allow overstaying your registration. For failure to register, a fine of 2 to 3 thousand rubles is provided. according to Art. 19.5 Code of Administrative Offenses of the Russian Federation. The owner is credited 2000-5000 rubles. If the employer is a legal entity, the fine is 200-800 thousand rubles. In cities of Federal significance (Moscow, Sevastopol, St. Petersburg) the price can be increased several times. If evidence of delay is provided for valid reasons (illness, business trip, emergency), the sanction is not applied.

Registration of foreign citizens in the Russian Federation

An individual from a foreign state temporarily residing in Russia (example: Ukrainian, Belarusian, Kazakh, Uzbek from Tashkent, native of the CIS, USA) must register with migration authorities upon entry no later than 7 days from the date of arrival in accordance with Art. 20 Federal Law No. 109. The regulatory legal act defines exceptions for a certain category of citizens who stay in a hotel, sanatorium, rest home, social institution, or place of detention. Highly qualified specialists, heads of state, sailors, aircraft crew members, and foreigners who come to Russia for a period not exceeding 7 days are exempt from migration registration at their place of stay. Stages of obtaining temporary registration by representatives of foreign countries:

  1. Providing a foreign passport or migration card by a foreigner.
  2. Receiving notification of arrival in the Russian Federation from the receiving party.
  3. Submitting the tear-off form to the migration registration authority at the location of the provided living space.

Emigrants have the right to obtain a temporary residence permit for legal residence in Russia for a period of three years. Temporary residence permits are issued to representatives of foreign states according to quotas evenly distributed across regions for the calendar year. Providing a document without a benefit is possible to persons who have citizenship of the USSR or the RSFSR, an incapacitated Russian relative, contract employees making investments in the economic development of the Russian Federation, and participating in the resettlement program.

How to renew registration for a foreign citizen?

Russian legislation imposes more stringent requirements on foreign citizens: all visitors from abroad are required to obtain temporary registration within one week.
This requirement applies to all guests, regardless of which country they arrived from: with a visa or without a visa. There will be no problems with paperwork if the foreigner is staying in a hotel or student dormitory for the duration of his studies.

Procedure

The registration of foreign citizens in Russia and the procedure for legalizing a foreigner are regulated by Federal Law No. 163 as amended in 2018. This document provides for the possibility of a foreigner staying in Russia for 90 days from the date of initial migration registration.

Then foreigners have three options:

  1. Leave Russia for six months;
  2. Drive back;
  3. Renew your registration.

What documents need to be collected?

The following documents are provided to the territorial migration service to extend the temporary registration of a foreigner:

  • A petition from the receiving party or an application from a foreigner indicating the basis for extending the registration. The application must indicate complete information about the foreign citizen: first and last name, date of birth, citizenship, details of an identity document, address at the place of stay.
  • Personal documents in original.
  • A document confirming the right to further stay in the Russian Federation.
  • Migration card.

Department employees will make copies of documents, and the originals will be immediately returned to the applicant.

The issue of extending the period of stay is considered within three days. At the end of this period, the foreign citizen must again visit the migration service to find out about his future fate: stay in the country legally or leave it.

The procedure does not provide for the issuance of a certificate to a foreigner regarding the renewal of registration, so you will have to carry with you a migration card with a mark of permission and a new deadline.

Validity periods and extension of temporary registration for foreign citizens in the Russian Federation

In accordance with Art. 5 Federal Law No. 115, the period of legal stay of foreigners in Russia may end upon expiration of a tourist, student or work visa. In the absence of an entry document, the maximum period of stay in the Russian Federation is 90 days. The legislation provides for the extension of the temporary registration of a foreign citizen who has a visa-free regime and has grounds for staying in Russia. A foreigner has the right to renew registration under a patent. In the absence of valid reasons, an individual is obliged to leave Russia or apply for a residence permit. Other reasons for rejecting an application are inaccurate indication of personal information, provision of an incomplete set of certificates, lack of consent of the homeowner to provide real estate for stay. Restoring temporary registration

It is permissible to re-issue a certificate again if a citizen was deregistered by his own consent or when leaving his current place of stay, or when conscripted for military service. You can restore a document in the same way as extending temporary registration: a citizen must write an application according to the sample and submit the relevant papers to the migration service department.   • a statement written by a parent on behalf of the child;
  • child's birth certificate or passport.
