The upper part of the order must contain information about the name of the enterprise, the registration number, place and date of registration, and also a brief indication of the content.

The preamble begins with the words “In order to carry out ...” or “In pursuance of ...”, after which references to legislative and regulatory documents should be reflected (Article 212 of the Labor Code, order of the Ministry of Health and Social Development dated April 26, 2011 No. 342N). An agreement is always drawn up for the performance of workplace certification services, the details of which (number, date) must also be included in the text of the order.

The administrative part of the document begins with the word “I order”, followed by:

  • list the members of the appointed commission, one of whom must be an employee of the certifying organization;
  • indicate the details of the chairman of the collegial composition;
  • reflect the name of the certifying enterprise;
  • provide information about the responsibilities of the certifying organization;
  • appoint a responsible person who is entrusted with the function of monitoring the execution of all points of the order.

The order must be certified by the signatures of all responsible persons: the director, chairman and members of the commission.

Types of commissions

The commission is a collegial advisory body consisting of several employees of the enterprise with the necessary qualifications. As a rule, the creation of a commission is due to the need for the most complete and, most importantly, objective solution to certain production problems.

Commissions are created either by decision of the head of the enterprise, or on the basis of existing regulations, such as, for example, guidelines No. 49 of the Ministry of Finance of the Russian Federation dated June 13, 1995 on the procedure for conducting inventory.

To implement regulations, permanent commissions are usually created, and to carry out one-time actions, temporary or working commissions are created. Examples of permanent commissions include:

  • the labor dispute commission, whose activities are regulated by Article 387 of the Labor Code of the Russian Federation;
  • inventory commission, whose activities are regulated by the Law of the Russian Federation “On Accounting”;
  • Labor Safety Commission, whose activities are regulated by Art. 218 of the Labor Code of the Russian Federation and Order No. 412n of the Ministry of Labor of the Russian Federation dated June 24, 2014.

Temporary or occasional commissions are created spontaneously, in connection with the emergence of a particular situation that requires collegial consideration. An example would be the creation of a commission to investigate an industrial accident.

A subtype of temporary commissions is the so-called working commission, created to assist a permanent commission for the period of performing a specific task with a large amount of work.

The commission does not have any administrative functions and this is what explains the term “advisory body”. The tasks and powers of the commission include:

  • providing the manager with the most complete and objective information on a specific issue;
  • providing recommendations on the optimal solution to a particular problem identified as a result of the commission’s work.

The time characteristics of the commission must be indicated in the order. So:

  • for a permanent commission the deadline is not specified in the order;
  • for temporary commissions, a specific task and a deadline for completing this task are indicated. The deadline for completing the task also includes the time allotted to the commission members to compile the report.
