Can an employee undergo a medical examination on his own and is it enough to simply have a medical book at the workplace?

- the number of workers engaged in heavy work and work with harmful and (or) dangerous working conditions;
- number of workers employed in jobs that require periodic medical examinations (examinations) in order to protect public health, prevent the occurrence and spread of diseases, including women, workers under 18 years of age, workers who have been diagnosed with a permanent degree of disability ;
- the number of workers subject to periodic medical examination, including women, workers under the age of 18, workers who have been determined to have a permanent degree of disability;
- the number of workers who have undergone periodic medical examinations, including women, workers under the age of 18, workers who have been diagnosed with a permanent degree of disability;
- percentage of employees covered by periodic medical examinations;
- a list of persons who have undergone a periodic medical examination, indicating gender, date of birth, structural unit (if any), conclusion of the medical commission;
- the number of workers who have not completed periodic medical examinations, including women, workers under the age of 18, workers who have been determined to have a permanent degree of disability;
- a list of employees who have not completed periodic medical examinations;
- the number of workers who have not undergone periodic medical examinations, including women, workers under the age of 18, workers who have been determined to have a permanent degree of disability;
- a list of employees who have not undergone periodic medical examinations;
- the number of employees who do not have medical contraindications to work;
- the number of employees with temporary medical contraindications to work;
- the number of employees with permanent medical contraindications to work;
- number of employees requiring additional examination (no conclusion given);
- the number of workers who need examination at the occupational pathology center;
- the number of workers in need of outpatient examination and treatment;
- the number of workers in need of inpatient examination and treatment;
- the number of employees in need of sanatorium-resort treatment;
- the number of employees in need of dispensary observation;
- a list of persons with a preliminary diagnosis of an occupational disease, indicating gender, date of birth, structural unit (if any), profession (position), harmful and (or) hazardous production factors and work;
- a list of newly diagnosed chronic somatic diseases indicating the class of diseases according to the International Classification of Diseases - 10 (hereinafter referred to as ICD-10);
- a list of newly identified occupational diseases indicating the class of diseases according to ICD-10;
- results of implementation of recommendations of the previous final act;
- recommendations to the employer on the implementation of a set of health-improving measures, including preventive and other measures.

When checking compliance with sanitary and epidemiological regulations in a clinic or beauty salon, representatives of Rospotrebnadzor also have the right to check the list of workers according to the final act with the list of contingent.

Referral for a pre-employment medical examination
For some categories of citizens seeking employment, a medical examination is required. A medical examination from the enterprise is carried out only on the basis of an issued referral. This document must include information about the employee himself, the nature of the upcoming work and the planned position, as well as a list of negative (harmful) factors, according to which the commission is necessary.
The conclusion is drawn up in two copies. One is given to the enterprise, and the second copy of the report remains in the medical institution and is attached to the outpatient medical record, which is created immediately after presentation of the referral for a medical examination.

Who bears the cost of a medical examination?

Money for the medical examination will be reimbursed upon written request from the employee. Supporting documents must be attached to the document: receipts for payment of medical services and a referral previously received from the employer.
Is it possible to fire an employee if the medical examination does not go well?
And if the medical examination is paid for by the employer, and all this is carried out during working hours, then why not go through all the “necessary” and “unnecessary” specialists? Try in your free time to get an appointment with a female doctor at the clinic at your place of residence; success is not guaranteed. How to organize a primary medical examination
Only specialized institutions - clinics, hospitals, medical centers - have the right to conduct official medical examinations. The employee cannot go to the doctors of his choice: the employer gives him a referral to a certain medical institution with which he has an agreement for medical care for employees.

Passed a medical examination - what was the result?
What documents should the applicant receive after passing the medical examination? These papers will serve as confirmation of suitability for the chosen occupation and a “ticket” to work: they will need to be provided to the employer. Depending on the position and field of activity of the person being examined, after the medical examination he will be given one of the following documents:
- Certificate of completion of a medical examination (form 086).
- An extended medical report containing recommendations and contraindications. It is drawn up in two copies, one of which remains in the outpatient card filed in the clinic.

Is it possible to get a job without passing a medical examination?
In addition to the Labor Code, medical examination of potential employees is covered in Appendix 3 to the order of the Ministry of Social Development of the Russian Federation No. 302n dated April 12, 2021. And finally, the Decree of the Chief Sanitary Doctor of Russia dated 06/03/2021 obliges those workers whose work takes place at the computer for half the working time or longer to undergo medical examinations.

Accounting for medical examination funds
PBU 10/99 in paragraphs 5, 7 prescribes that these costs should be included in “expenses for ordinary activities”. These costs can be written off in different ways, depending on where exactly the funds were paid:
- if the medical examination was carried out in the organization’s own medical center, the expenses will be considered “expenses for maintaining the medical center”: debit 26 (44), credit 02 (10, 70, 68, 69, etc.);

Who is required to undergo an examination?
The labor legislation clearly lists the categories of workers (Article 213 of the Labor Code) who are subject to examination in a medical institution immediately before drawing up an employment contract.
This:
- drivers and persons involved in the maintenance of public transport (for example, conductors or conductors);
- citizens who want to get a job at a commercial enterprise;
- persons employed in public catering and food industry enterprises, as well as public water supply;
- workers who directly communicate with children (caregivers, teachers, teachers) and adults (medical workers);
- workers applying for a vacant position with conditions harmful to health (for example, at a chemical industry enterprise);
- persons who have to work in difficult or dangerous conditions (for example, in the Far North).
According to the order of the Ministry of Health, reflected in order number 312N of April 2011, hazardous working conditions include:
- presence of allergens or other hazardous chemical compounds in the workplace;
- the presence of unfavorable physical factors, such as vibrations or noise,
- electromagnetic fields;
- the presence of biological hazards (for example, contaminated materials, enzymes, etc.);
- the presence of factors that provide additional stress on the body (for example, working with optical instruments puts a strain on a worker’s vision, and the work of a pilot is a test for the whole body).
If a person related to these categories submits documents without a medical certificate, the employer has the right to refuse to hire him.
These actions on the part of the management of the organization or enterprise in this case will be lawful.
The presentation of a medical document by minors and young workers is required on the basis of Article 65 of the Labor Code. This category of workers must be provided with special working conditions, and it is generally prohibited to employ minors in some positions. Therefore, it is extremely important for the employer to have accurate information about the health status of a minor applicant for a vacant position and his age.
Is it possible to undergo a medical examination by a doctor and take tests on your own?
Not all employers have agreements with medical centers, and in such cases the employee himself chooses a clinic and undergoes a medical examination there. And here you need to remember some important nuances:
- If you decide to undergo a medical examination for a fee in a private clinic, the employer must still pay for it - this is the requirement of the law. To reimburse expenses, you must provide receipts to your place of work.
- If you go to a health center without a referral from your employer, you may have problems. The fact is that it is from the referral that medical workers learn what list of doctors and studies is needed in your case. If you come without a document, the medical examination may be carried out according to a general scheme, without taking into account the nuances, and it may turn out to be inappropriate; you may be refused employment, removed from your duties, or fired.
- If your employer referred you to a certain clinic, by law you have the right to refuse and choose a medical facility yourself. But there is one pitfall here. If violations are discovered, the employer has the right to invalidate the results of the medical examination. For example, if the clinic does not have a license to provide occupational pathology services.
Where to carry out periodic medical examination
All medical examinations must be carried out in a medical organization licensed to conduct them. The employer will pay for this mandatory filter. (Article 213 of the Labor Code of the Russian Federation).
Therefore, the only answer to the question of where to go or undergo a periodic medical examination for employees is to choose a medical organization that is convenient for you, enter into an agreement with it for the provision of services and agree on the start date for periodic medical examinations.
Previously, it was possible to conduct medical examinations on the territory of the enterprise, for this we entered into an agreement with a medical organization that has specially equipped equipment, they came to us and examined everyone on the list.
It was very convenient, since there was no long interruption from the work process! But at present this is unacceptable (clause 8 of article 3 of Federal Law No. 99).
I would like to draw your attention to the fact that under no circumstances should employees undergo periodic medical examinations at their place of registration, instead of the organization with which the company has an agreement!
This is important because in the event of an inspection, there must be not only a conclusion about passing a periodic medical examination, but also a final report, which includes all employees who need to undergo a periodic medical examination in the current year.
If there is no report, or it is incorrect, and this becomes clear during the inspection, then a fine will be imposed for non-compliance with labor legislation in the field of labor protection from 50,000 to 80,000 rubles.

Everything regarding the timing of periodic medical examinations at the enterprise
- 2 months before the start date of periodic examinations, you need to provide a list of names to the medical institution.

In order for your employee to go for an examination, you must issue a referral for a periodic medical examination.
The referral is completed by an authorized representative of the employer. If there is a health worker, then it is him; if not, then it is a representative of the labor protection service or the human resources department.
All issued referrals are recorded in the journal for issuing referrals for periodic medical examination, in which the employee signs for receipt of the referral.
In addition to directions for a medical examination, the future employee must take with him:
- passport;
- compulsory health insurance policy;
- insurance certificate of compulsory pension insurance;
- military ID (some medical institutions ask you to provide it);
- extract from the clinic at the place of registration / results of medical examination;
- results of mandatory psychiatric examination, if previously conducted.
Final act based on the results of the periodic medical examination
As soon as the employee successfully completes the medical examination, the hospital issues a report in five copies .
Since 2021, the number of conclusions issued by a medical institution at the end of a periodic medical examination has increased and they are now sent to:
- To the employee
- To the employer
- Health care facility where the medical examination was completed
- Health care facility, at the place of registration of the employee
- FSS.
A report on undergoing a periodic medical examination is sent within five working days .

Based on the results of a periodic medical examination by all employees on the list, the medical organization must put all the results together. 30 calendar days are allocated for this, then a final act is drawn up.
The final report of a periodic medical examination is a summary of information on all employees who have undergone a periodic medical examination, which indicates the suitability of employees to work in harmful or dangerous working conditions.
The final act will be prepared in five copies , approved by the chairman of the medical commission, then certified by the seal of the health care facility, signed by the head of the employer and a representative of the territorial body of Rospotrebnadzor.
Within 5 days from the date of approval of the document, it must be sent by the medical organization:
- employer;
- to the territorial Rospotrebnadzor;
- FSS;
- to the center of occupational pathology of a constituent entity of the Russian Federation.
The hospital keeps one copy for itself, and it must be kept there for 50 years, the same storage period for the employer.
So, if this happens, then the final act will also be removed from the archive and added to the case materials.
A new change in the order of the Ministry of Health and Social Development No. 302n from July 1, 2020 obliges employers to send a certain group of workers to a periodic medical examination at the occupational pathology center (clause 37 of Appendix No. 3). How to choose the right clinic

- Be sure to make sure that the clinic has a license to conduct preliminary and periodic medical examinations.
- Make sure that all doctors and tests can be done in one clinic, so that later you don’t have to travel to different parts of the city.
- If a clinic offers to issue a medical examination report and a medical record in one day, without the employee’s appearance, then it is breaking the law. And along with her - you, with all the ensuing responsibility.
- A private clinic can conduct an examination by a psychiatrist-narcologist only if there is an entry in the license to provide this medical service.

Who is responsible for medical examinations?
In general, the employer is responsible for organizing and conducting medical examinations. Therefore, from among his employees he selects those responsible for:
- compiling a list of professions to undergo a medical examination. Typically these are OT employees;
- preparation and issuance of an order to undergo a medical examination at the enterprise, a sample of which is kept by the clerk, the health care service or other persons involved in the process;
- organizing the medical examination itself - preparing documentation for the hospital, sending employees for a medical examination, monitoring its completion;
- prohibition from work of persons who have not passed the examination. Most often these are the immediate supervisors of the work (site managers, foremen).
The day or days on which workers undergo a medical examination are paid “on average”. If a worker refuses to undergo a medical examination, he is not allowed to work, and the days during which he did not work for this reason are not paid.

Are medical examinations required for remote workers?
According to Part 2 of Art. 312.3 of the Labor Code of the Russian Federation in relation to remote employees, the employer is obliged to comply with the labor protection requirements provided for in paragraph. 17, and 21 hours 2 tbsp. 212 Labor Code of the Russian Federation. These include, in particular:
- investigation and recording of industrial accidents and occupational diseases;
- compliance with the instructions of the state labor inspectorate;
- insurance of employees against industrial accidents and occupational diseases.
Comply with the others specified in Art. 212 of the Labor Code of the Russian Federation, the employer is obligated only if this is specified in the employment contract with the remote worker.
