A pre-employment medical examination is an absolutely necessary event in many situations.

In what situations are medical examinations organized?

According to Art. 212 of the Labor Code of the Russian Federation, the employing company is obliged in the cases specified in federal legislation:

  • organize periodic medical examinations of specialists, including on the initiative of the workforce;
  • refer persons applying for a job to a preliminary medical examination.

Applicants for a vacancy must undergo a medical examination in the following situations:

  • the applicant is a person under 18 years of age
  • working conditions in the company are recognized as harmful and/or dangerous based on the results of a special assessment;
  • the vacancy requires rotational employment;
  • the work of the hired specialist will be related to child care, consumer services for citizens, interaction with food products and other areas specified in federal laws.

Medical examination of persons employed by the organization is financed by the employer. The basis for passing it is a referral form issued by the HR department. If medical examinations demonstrate unsuitability for a certain type of activity, the applicant will be denied employment under Art. 84 Labor Code of the Russian Federation.

Algorithm for organizing a medical examination at an enterprise

When organizing activities to check the health status of employees, it is necessary to rely on the procedure described in regulations and developed in practice. It includes the following steps:

  • compile a list of contingents of employees required to undergo testing;
  • send it to the territorial office of Rospotrebnadzor;
  • enter into an agreement with a medical institution;
  • draw up a list of names, a schedule and determine the timing of the event;
  • issue an order to conduct a medical examination and familiarize staff with it;
  • prepare and issue a referral for periodic medical examination (form 302n);
  • collect conclusions with the results of the inspection;
  • receive a final report from the medical institution.

How to make a referral for a medical examination

It so happens that the referral form for a preliminary/periodic medical examination is not approved by law. However, by order of the Ministry of Health and Social Development No. 302n, a standard list of its details has been developed:

  • OKVED and type of ownership;
  • the name of the company sending the specialist to the medical institution, according to the statutory documents;
  • actual address and full name of the health care institution where the employee is sent + OGRN;
  • type of upcoming medical examination - preliminary or periodic;
  • FULL NAME. and date of birth of the hired specialist;
  • the name of the department, position where the citizen works or is employed;
  • a short list of job responsibilities of a hired specialist;
  • characteristics of working conditions – listing of harmful and/or dangerous factors.

As stated, there is no mandatory referral form. Therefore, the company has the right to develop its own sample, which includes all the necessary information about the employee, employer and the upcoming medical examination. That is, use a standard version of the details. Practice demonstrates that commercial structures prefer to adhere to this option because it is easier to implement and minimizes the likelihood of violations.

The form for referral to a medical examination upon hiring is filled out by an authorized person of the employing company. For example, a future specialist manager or HR employee. The compiler must indicate his full name, position and handwritten signature.

Information about issued directions is entered into a special registration journal, which companies maintain in free form. When the specialist receives the document, he puts his handwritten signature in the appropriate column. Refusal to take the paper is interpreted as a violation of obligations arising from the employment contract.

When an applicant goes to a health care institution, he takes with him a referral certified by the employer and a general passport.

The law does not prescribe strict deadlines for passing a medical examination. Usually up to 1 week is allotted for this, after which the citizen brings the doctor’s report to the employing company

How is a referral for a preliminary medical examination issued?

A referral for a medical examination on the employer’s letterhead is given to the specialist applying for a job in person against signature. Refusal to receive a referral or undergo a medical examination means the applicant’s failure to fulfill his obligations, as a result of which the employment contract (if it was signed) is canceled.

The medical examination is considered completed if the specialist has visited all doctors, and all planned laboratory and diagnostic tests have been carried out. Based on the results of the examination, the person applying for work is given a conclusion.

The second copy of the report remains in the medical institution and is attached to the outpatient medical record, which is created immediately after presentation of the referral for a medical examination.

What form should the organization use?

A standard form for submitting a referral for a medical examination is presented in the Appendix to Order No. 302n.

It is important to remember that using it is not necessary, but it is advisable.

The form only contains the information required to be reflected:

  • information about the employer company. All available information about the company is indicated here - its name, form of ownership, address of the main office, OKVED;
  • information about the medical institution to which the citizen is sent. Just as in the previous paragraph, the full name of the organization, the address of its location, OGRN are indicated;
  • date of issue of documentation;
  • name of paper;
  • assigned serial number;
  • the type of medical examination that the employee must undergo;
  • information about the employee. It is important to reflect the citizen’s initials and date of birth. His status is indicated - working or getting a job;
  • characteristics of professional activity - type of work for which a medical examination is required;
  • the citizen’s work experience;
  • the name of the structural unit in which the employee will work/is already working.

The referral must be signed by the employer or his responsible person who has the right to prepare documentation of this nature.

How to fill out correctly from the employer?

A referral for a medical examination must be issued in accordance with the rules specified in Order No. 302n.

The document must be free of errors and corrections.

To undergo a medical examination from the enterprise, the employee must receive this form.

An examination in an institution with which the employer has entered into an agreement is carried out only if this document is available.

The referral must include detailed information about the employer, medical institution, prospective employee and the specifics of his work.

More detailed information required to be reflected is indicated in the previous paragraph.

The document must contain information about harmful or dangerous factors, according to which the examination is considered a necessary procedure.

After receiving the referral, responsibility for its safety and timely completion of the inspection is transferred to the employee.

For a preliminary medical examination upon employment, the employer issues a referral indicating the name and address of the medical institution for this procedure.

Agreements are most often concluded between an employer and a medical institution licensed to conduct medical examinations .

If no agreement has been concluded between the employer and the medical institution, then the future employee undergoes a preliminary examination by specialists in any medical institution licensed to carry out these procedures.

City, district, republican, and village clinics have such a license. When contacting private medical centers and clinics, it is necessary to clarify the availability of such a document.

Who gives directions

A referral for a medical examination is issued to a future employee by the employer. In this case, each issued direction is subject to registration.

You can register a document in the Outgoing Documentation Journal . But if the number of directions issued is large, a separate journal is started.

There is no unified form for such a journal, so it is filled out in free form. But the required columns must be included:

  • date of registration;
  • registration number;
  • FULL NAME. to whom the referral was issued;
  • the position for which the future employee is applying;
  • the applicant's receipt and date of receipt.

A preliminary medical examination can be completed at any medical institution that has the right to conduct such examinations and issue conclusions. But it is better to be examined at the organization specified by the employer.

Medical reports issued after passing a medical examination are valid for a limited period. After this period they cannot be presented. Question No. 1: Is it possible to undergo a medical examination without a referral?

Answer: No, you can't. Since the candidate for the position must provide a medical report on the possibility (impossibility) of working in specific working conditions. Peculiarities

Each profession has its own characteristics of undergoing a medical examination procedure, which must be observed. Otherwise, the employer will be issued a fine if he employs an employee who has not passed the inspection.

For minors

According to Article No. 69 of the Labor Code of the Russian Federation, persons who have not reached the age of majority, but wish to enter into an employment contract, are required to undergo a medical examination.

Until the age of 18, the procedure is performed every year. This is carried out in order to find out whether the teenager is able to fulfill certain requirements without harm to his health.

There is no specific procedure for undergoing a medical examination for adolescents, so the procedure follows a general procedure. Some organizations may turn a blind eye to contraindications identified after a medical examination if the child is employed for a short period.

However, if this fact is discovered, the employer will be fined by the labor inspectorate and must take the following actions:

  • find another place of work for the teenager;
  • terminate the employment contract with subsequent payment of benefits, which is the average monthly salary.

When employed in a preschool educational institution, an employee must undergo a full medical examination and visit the following doctors:

  • dermatovenerologist;
  • dentist;
  • infectious disease specialist;
  • otolaryngologist.

In addition, fluorography, a certificate of passing an STD and a test for helminth infections are required.

What kind of health certificate must be issued?

The final decision of the therapist that the applicant for a vacant position has passed a medical examination is a certificate issued on the basis of the opinions of other specialists of the medical institution. There are two forms of certificates:

Document 086/у

Document 086/у is in A5 format and must be filled out on both the front and back sides . This certificate contains the following information:

  1. Document Number.
  2. Information about the medical institution.
  3. Information about the applicant receiving the certificate (full name, date of birth, residential address).
  4. List of diseases suffered previously and vaccinations performed.
  5. Doctors' reports along with signatures and seals.
  6. Fluorography and analysis data.
  7. Medical report on professional suitability.
  8. Date of issue.

Fill out document 086/у with exclusively dark blue or black ink . Signed by the doctor who issues the certificate and the head physician in charge of the medical examination. They put a rectangular stamp of the medical institution, a stamp indicating the completion of fluorography, and a round stamp of the therapist.

Attention! Document 086/у is drawn up in two copies, one is issued to the applicant, and the other is entered into the employee’s outpatient card.

Medical certificate 001ГС/у

Contains information indicating that the applicant does not have diseases that prevent him from performing civil or municipal service. To obtain a certificate 001ГС/у, it is enough to obtain permission from a psychiatrist and narcologist . And also take a blood and urine test. After which the therapist will issue a conclusion on professional suitability. Signed by the same persons as the certificate form 086/у.

Employer's liability

Due to the fact that the state does not provide employees with funds to undergo a medical examination, the employer must pay for medical services. If a potential employee paid for the examination at his own expense, then the employer’s responsibility is to reimburse him for the money spent.

An employer can pay for a medical examination in different ways:

  1. Transfer funds to the account of the medical institution with which the company has entered into an agreement.
  2. Reimburse the employee for all expenses if the procedure was completed at his own expense (if there is a receipt for payment for medical services).

According to the law, an employer cannot hire an employee without undergoing a medical examination, since this entails administrative liability:

individual entrepreneursa fine of 5,000 rubles or suspension of the company for a period of 90 days
officials5000 rub.
legal entities50,000 rub. or suspension of the company for a period of 90 days

If the employer repeatedly violates the requirements, the company’s activities will be terminated for a period of 1 to 3 years.

An employee must undergo a medical examination, which is regulated by Article No. 213 of the Labor Code of the Russian Federation. If the employee refuses, the employer has the right not to hire him.
