The Verkhovna Rada has made changes to the legislation, significantly tightening liability for damage to housing and communal services. According to the calculations of deputies, legislative changes will affect those who unauthorizedly remodel apartments, which causes premature destruction of building structures, damages ventilation systems and gas flues in residential apartment buildings, steals fire hydrants, breaks electrical switchboards and elevator equipment, stores explosive substances at home, gas cylinders, steals manhole covers, causing people to fall into sewer wells.

An article has been added to the Criminal Code of Ukraine according to which the intentional destruction or damage of housing stock, improvement facilities, heat supply, water supply and drainage, as well as their networks or components (manhole covers, gratings), if the losses exceeded 5,100 hryvnia, is punishable by a fine of 100 to 250 non-taxable minimum income of citizens (1700-4250 hryvnia) or correctional labor for up to two years. Restriction or imprisonment for up to three years is also possible.

The same actions, committed repeatedly or in a socially dangerous manner, are punishable by imprisonment for a term of three to eight years. If damage is caused on an especially large scale (17 thousand hryvnia), the death of a person or other grave consequences, the offender faces imprisonment for a term of five to twelve years.

The greatest public outcry was caused by the provision on criminal liability for illegal redevelopment. It’s no secret that in most cases, owners make major renovations in their apartments without the appropriate plans and permits. People complain about the length and cost of obtaining documents for redevelopment, as well as about the bureaucracy in this procedure. Indeed, this is a complex process that requires not only time and nerves, but also a lot of money. Although a little over a year ago the state somewhat simplified the procedure for registering redevelopment.

Let us remind you that, according to the government decree “Some issues of granting permits for preparatory and construction work,” the procedure for obtaining permits for the construction, repair and redevelopment of houses and apartments has changed significantly.

In particular, it is now possible to redevelop apartments in residential buildings and rooms in dormitories, as well as public facilities, without permission from the State Architectural and Construction Inspectorate.

But only with the preservation of load-bearing structures, without exceeding the permissible loads on floors, walls and foundations and subject to compliance with architectural and planning requirements, state building codes and local development rules.

When permission is not needed

But don’t think that any repair requires contacting the Housing Inspectorate. A large number of works can be carried out completely calmly, without fear of fines. These include:

  1. Any cosmetic repairs: painting or wallpapering, replacing floors, ceilings, some external elements, if they do not affect the functionality of the building, for example, installing a new drain or installing an air conditioner, television dish, protective nets.
  2. Rearrangement or removal of built-in furniture: cabinets and mezzanines, if they are not a separate room and are not specified in the technical passport. That is, it is impossible to remove the wall between the pantry and the room - it may turn out to be load-bearing.
  3. Rearranging or replacing gas and water heating elements, if it is not necessary to lay additional networks, you can also rearrange the electric stove.
  4. Replacing doors and windows, replacing the material of balconies and loggias: you can put a plastic window in place of an old one, but you can’t “cut through” a larger one. The same applies to glazing: it is discussed below.
  5. Replacement of engineering equipment with something similar in all respects without rearranging it.

In other words, any work that does not affect the technical parameters of the apartment does not need to be legalized. It is important to remember that there are some types of repair work that do not require approval from the Housing Inspectorate, but they must be notified upon completion.

Methods for determining load-bearing walls

So, the first, simplest and most accurate is to find the structural plan of the house, which is stored in the capital construction department, which is located in the city Executive Committee, also known as the Executive Committee. There is also a technical passport of the apartment, which all apartment owners have, but you can understand it only if you know how to read construction drawings.

If you were unable to get a plan, then you can try to determine the load-bearing wall by its thickness and location.

In a brick house, all walls thicker than 38 cm are load-bearing. The thickness of the walls in such houses is determined by the number of bricks laid out in a row. One brick is 12 cm, which means simple arithmetic works: 250 mm is a wall of two bricks + a 10 mm seam between them. 380 mm is a wall of three bricks + 2 joints of 10 mm each. 510 mm is a wall of four bricks + 3 joints of 10 mm each. 640 mm is a wall of five bricks + 4 joints of 10 mm each. and so on. Interior partitions are built from brick or concrete blocks and range in thickness from 12 to 18 cm. The walls between apartments are slightly thicker - 25cm.

All walls thicker than 14 cm are load-bearing in the panel type. Unfortunately, in these types of houses it is very difficult to realize all your ideas, since most of the walls in such houses are load-bearing. Partitions in panel houses are much thinner than load-bearing walls - only 8-10 cm. There is also a nuance - the thickness of load-bearing walls in panel houses can be 12 cm, it depends on the series of the house. So what should we do? Should such a wall be considered a thickened partition or a load-bearing wall? The final answer will only be given to you by an engineer in the relevant organization that issues an opinion on the terms of reference for your project.

In monolithic houses there is a load-bearing wall thicker than 20 cm. The surest way for such houses is to take a floor plan from the developer. Since there is now a huge variety of design solutions, in such houses it can be very difficult to determine the load-bearing wall simply by its thickness. For example, in a monolithic frame house, there may be no load-bearing walls at all. And there are cases when a simple partition is thicker than 20cm. So only an architectural plan can clarify this issue.

Notification without consent

In some cases, you do not need to receive it, but after completing the repairs, you must notify the Housing Inspectorate and make changes to the documents.

If this is not done, then when selling an apartment, exchanging or inheriting it, difficulties may arise due to the difference between the plan of the living space and the actual condition. Such cases include:

  1. Rearrangement in the kitchen, bathroom and toilet without changing the dimensions of the premises.
  2. “Cutting through” or sealing passages in walls between rooms.
  3. Glazing of balconies and loggias.
  4. Analysis of non-load-bearing walls.
  5. Construction of additional walls, if this does not increase the load on the floor, the partitions should be fairly light.
  6. Changing the shape of vestibules or eliminating them completely.

It is important to remember that demolishing walls or installing doorways in them can only be done between rooms - neighboring apartments cannot be combined in this way; this requires prior approval.

Any change that does not pose a potential threat to the entire house and neighboring apartments, but changes the overall plan, must be reflected in the BTI documents. If the repair does not affect the layout in any way and eliminates any threat, it may not be approved at all.

if it is planned to carry out global repairs, including the demolition of walls, installation of house communications and other serious work, the Housing Committee must be notified about this in advance and all changes must be agreed upon, taking into account all the nuances.
